Milk adulteration non-bailable offence in Maharashtra

MUMBAI, Jan 15: Food adulteration, especially in milk becomes a cognisable and non-bailable offence in Maharashtra from today with the government amending an act which gives sweeping powers to the police.

The Prevention of Food Adulteration (Maharashtra Amendment) Act, 2006 authorises police officials of the rank of inspector and above to arrest the culprits without warrants.

The Act has been amended specifically to check milk adulteration which has assumed alarming proportion in Mumbai and elsewhere, Minister of State for Food and Drug Administration, Baba Siddiqui said yesterday.

With the offence now becoming non-bailable, the government hopes to reach the kingpin of the milk adulteration rackets, the minister said adding, it would also help in police investigations.

There is an organised racket in adulteration and that is why the State Government amended the Act, the minister said. The Act was passed in April 2006. Maharashtra is the first state to enforce such provisions to curb food adulteration, he said.

Two new laboratories of the Food and Drug Administration have been set up at Mumbai and Aurangabad.

The state legislature had proposed amendments so that the Act can be strengthened to tackle the growing menace of food adulteration. The amendments received Presidential assent late last year. (PTI)

HC grants relief to woman sacked for immoral conduct

MUMBAI, Jan 15: A woman who was sacked by the district administration for alleged immoral conduct, was granted relief by the Bombay High Court when she challenged the dismissal.

Division bench of Justices Ranjana Desai and Roshan Dalvi yesterday observed that having an extra-marital affair was not a ground for termination of the petitioner’s services while setting aside the dismissal order.

The court also observed that her termination was "strange" and "shocking" as no action was taken against the man with whom she had the affair and was also a employed by the same Zilla Parishad.

However, the court granted liberty to the Zilla Parishad to take action, if necessary, in accordance with law.

The woman had moved the High Court in December last, alleging that Satara Zilla Parishad had not awarded her a single opportunity to be heard and neither conducted any inquiry before sacking her.

In November 2005, ZP terminated her service saying her character is questionable. According to her, the sole basis of this indictment was a resolution passed by village panchayat of Taldeo in Mahabaleshwar taluka, where she worked.

The Child Development Project Officer for Mahabaleshwar S D Shedge had said in an affidavit filed before the court that her "moral character is not good".

"She has committed sexual offense and extra marital relation and such a lady cannot be allowed to continue as Aanganwadi assistant which may have a bad effect on the character of the children, hence not fit to continue on the post", the affidavit stated.

A complaint regarding her affair had been made to the child development project officer by the village headman.

Her lawyer Uday Warunjikar had urged the court to quash and set aside the order, which was accepted by the court.

Warunjikar also argued regarding the right to privacy of a female employee, pointing out that anything she does, outside her nature of work, should not be the concern of the authorities.

The court, however, refused to deal with the larger issue but accepted that the dismissal was stigmatic and an allegation on the petitioner’s character, Warunjikar said.

The bench had earlier asked the counsel for the state government if an employee can be removed from services without conducting an inquiry. Assistant Government pleader Sudeep Nargolkar citing Supreme Court judgments told the court that post decision enquiry also can be done after suspending the employee.

According to the petitioner, before passing the resolution that she be removed, the Panchayat had allegedly forced her and her husband to sign a confession that she was having an extramarital affair. She stated that she had even received the Ideal Anganwadi Assistant Prize in the Mahabaleshwar Taluka. (PTI)

Better facilities for research in nuclear studies: Kakodkar

MUMBAI, Jan 15: India’s top atomic scientist today urged Government to create better facilities at centres like the Bhabha Atomic Research Centre to attract younger students and visiting scientists and to encourage research in nuclear studies and related subjects.

The number of students and visiting scientists for research in fields like nuclear studies in the country had been small so far and in this context moves had been made to create facilities to accommodate them at BARC, Atomic Energy Commission Chairman Anil Kakodkar said today.

"This will give a boost to scientific research and neutron-based research," Kakodkar said while inaugurating an International Symposium on Neutron Scattering at BARC.

"We were close to setting up a reactor in a university here but had to back off due to constraints, which we need to overcome," he said.

The presence of a nuclear reactor in a university would increase access to research in the subjects like nuclear sciences which could attract more students, he said.

Speaking on the need for self-reliance of research institutes, Kakodkar said it was important for researchers to help build scientific experimental facilities.

"Unless we are able to build our own experimental facilities we end up working on ideas that can be done on existing facilities and leave out those which require us to build our own equipment," he said.


Kakodkar also stressed the importance of international links and collaborations between institutes like BARC and foreign counterparts saying it helped in improving the scientific facilities Indian scientists had access to.

"These collaborations would result in a larger number of younger people being involved in scientific projects and can be utilised to create attraction for younger researchers to get into scientific research," Kakodkar, who is also secretary of the Department of Atomic Energy, said.

He pointed out that presently there was a global problem in attracting young students to nuclear research.

Kakodkar also praised the neutron scattering scientists of the country who were at the forefront of self-reliance in terms of scientific instruments.

The three-day-long symposium is to be held till January 18 and will feature about 100 papers being presented on neutron scattering by specialists from India and abroad.

Eminent scientist Dr G Venkataraman, who was also present at the innauguration, sought that a large neutron source be built in Indore which could cater to the needs of the African and Asian region.

He proposed the creation of centre for scientific research to facilitate greater studies in inter-disciplinary topics.

Teachers from universities should take a greater role in scientific research and experts from the industrial sector should also be allowed to participate in research projects along with Government scientists to ensure that all available talent is utilised to the fullest, Venkataraman said. (PTI)

NEW DELHI, Jan 15: The Central Government today placed before the Supreme Court the English translation of Argentinian Court order dismissing the application of the Central government seeking extradition of Ottavio Quattrocchi, a suspect in Bofors gun scandal, to India.

The bench comprising Chief Justice K G Balakrishnan and Justice R V Raveendran granted three weeks time to the petitioner Ajay Kumar Aggarwal, an Advocate of the Supreme Court to file his response to the stand taken by the Indian Government before the Argentinian Court.

According to Mr Aggarwal, the Indian Government was not serious in seeking extradition of Quattrocchi.

The Italian fugitive was nabbed by Argentinian authorities on January 23 last year and the Government of India was informed about his detention by the Interpol. Quattrocchi is wanted in Rs 64.5 cr payoff scandal since 1996 and he is facing allegations of receiving illegal kickbacks in the deal. (UNI)

Acquittal in criminal case no disqualification for job: CAT

NEW DELHI, Jan 15: The Central Administrative Tribunal (CAT) has directed the Delhi Police to reconsider a candidate for appointment as a constable whose application was rejected due to involvement in a criminal case, in which he was later found innocent.

A Bench of the Tribunal headed by Chairman V K Bali directing the Delhi Police to appoint the petitioner if otherwise found fit, stated, "It was not a case of acquittal on benefit of doubt. It was a case of clean acquittal."

The bench added, "In a case of clean acquittal, we are of the considered view that the involvement of a person in crime can well be said to be improper. A person with such acquittal has to be held to be innocent."

The bench also headed by Member Chitra Chopra observed, "The applicant (petitioner) had mentioned all the details of criminal case that stood determined 8 years before he sought appointment in Delhi Police as Constable (Driver). Concededly, it is not the case of concealment of any material fact."

"The involvement of a person in a criminal case alone would not be enough to deny him appointment in civil services for all times to come," it said.

Petitioner Virender Singh had earlier faced trial in a criminal case registered under Section 308 (attempt to commit culpable homicide) of the IPC.

Even though he was acquitted of the charges in 1997 his candidature for the post of Constable (Driver), for which he applied in 2005, was rejected through an order dated May 16, 2007 stating that he was found not suitable for the post.

He, in the relevant column of the application form, had clearly mentioned the details of the criminal case in which he was involved. He had mentioned that he was acquitted of the charges.

The Tribunal dismissed the arguments of the Delhi Police and said "We are surprised to see that how Section 308 of IPC would make it a case of heinous crime.

"Section 308 of IPC deals with attempt to commit culpable homicide not amounting to murder and the maximum sentence prescribed for the said offence is seven years. The impugned order, in our view, is wholly unjustified and illegal," it said. (PTI)

BIMARU status: MP, Rajasthan struggle to get out

NEW DELHI, Jan 15: Nearly three decades after the four states-Bihar, Madhya Pradesh, Rajasthan and Uttar Pradesh-were given the dubious distinction of being BIMARU (sick in Hindi), two of them claim they have managed to shed the image, at least on the economic front.

Madhya Pradesh and Rajasthan Governments, while stoutly defending their investment policies, say they are no more sick, although they admit that on social indicators like health infrastructure and human development, they have a long way to go.

As per 1991 census, BIMARU states contributed more than 35 per cent of India’s population and about 48 per cent of the illiterate population.

According to State Government figures, there are 24 lakh families in Rajasthan that live below poverty line. In Madhya Pradesh, the number of poor forms about 37 per cent of the state’s population of nearly seven crore.

The Rajasthan Govenment claims it attracted investment proposals worth Rs 1.55 lakh crore last year in all sectors of industries including IT and SEZ.

H S Bhabhra, the Vice-Chairman of the State Economic Policy and Reforms Council, told PTI that the financial situation of the state had improved with better tax realisation and Centrally sponsored schemes’ funds, leading to a surplus budget and zero revenue deficit.

And the Madhya Pradesh Government says that the year 2005-06 ended with a revenue surplus of Rs 33.32 crore.

According to MP Government figures, the state contributed 4.86 per cent of the national domestic product in the year 1993-94.

In 2003-04, the contribution went down to four per cent and 3.94 per cent in 2005-06. The decline shows that the national economy is growing at a higher rate than that of the state.

However, economist and demographer Ashish Bose, who coined the term BIMARU in the early eighties, feels otherwise.

"My 2001 study of 593 districts of the country establishes that a bulk of the poor districts falls within BIMARU states, which should now include Jhakhand and Chhattisgarh."

In Uttar Pradesh while Chief Minister Mayawati continues to clamour for a Central package of Rs 80,000 crore for development of basic infrastructure in Bundelkhand and Eastern UP, its over 32 per cent of over 16 crore population struggles to have one square meal a day.

Bihar is worst off in all development indicators. And whatever progress is there it’s very slow, says additional finance commissioner Alok Vardhan Chaturvedi.

State budget officer and joint secretary (finance) Tilak Rajgauri said before the Nitish Kumar Government came to power, out of the total fund of Rs 4000 crore earmarked for Bihar under Rashtriya Sam Vikas Yojna, the state government could get only Rs 1,019.59 crore during 2005- 06.

Similarly the state lost about Rs 505 crore during the period under Sarva Shiksh Abhiyan as it failed to submit the utilisation certificate on time.

"The state is absolutely dependant on central funds as state’s own revenue ---tax and non-tax combined, barely meets 20 per cent of its total expenditure and the rest has to come from the Central Government", Rajgauri said.

On the health care front, State Government said the Infant Mortality Rate (IMR) for rural areas was 63 which was slightly better than the all India average of 75.

"Bihar has experienced a clear-cut deterioration in urban IMR in absolute terms during the nineties, making it rise from 47 to 52 per 1000 live births which is little lower than the national average in the eighties and nineties," it said. (PTI)

for demanding extortion money

PATNA, Jan 15: An FIR against ruling party MLA Neeraj Kumar Singh alias Babloo has been filed for allegedly demanding extortion money and misbehaviour with the manager of a firm constructing the east-west corridor under the prime minister’s golden quadrilateral project in the state.

"JD (U) MLA from Raghopur in Bihar’s Supaul district reached the camp office of Gammmon India located at Madhubani village in the district on January six and misbehaved with the camp offic manager P K Basak and demanded extortion money from him," Gammon India local manager Ramesh Madhubhasi told reporters here today.

Babloo demanded an extortion money of Rs nine lakh per month from Basak to allow the company to work in the area, Madhubhasi alleged.

Madhubhasi said the head office of the company at Mumbai was informed about the incident and after getting a clearance by the company lodged an FIR against the MLA and his cohorts with Balua bazar police station yesterday.

When contacted Babloo said over phone from New Delhi today that he had gone to the camp office on January six to demand adequate compensation to the locals whose land been acquired for construction of the road as well as giving employment to the locals in the construction work

ECI instructs poll-bound NE states
to follow transparency guidelines

AGARTALA, Jan 15: With a view to ensuring transparency and preventing fraud votings during the polling process in the Northeastern states, the Election Commission of India (ECI) would henceforth follow a new procedure.

Referring to the ECI guidelines, Tripura Chief Secretary Shashi Prakash told UNI here today that the ECI would now adopt the application of indelible ink (a line running from top of the nail to the bottom of first joint of the left forefinger) in the forthcoming Assembly elections in Tripura, Meghalaya and Nagaland.

The indelible ink had been adopted recently by the ECI following certain complaints of fraud voting from different political parties, the Chief Secretary added.

He also stated that as part of transparency management, the ECI had issued detailed guidelines for video coverage of all critical events during the poll process at all vulnerable areas while digital cameras would be used in the polling booths as and when required.

He informed that a three-member commission, led by Election Commissioner Gopalaswami, would visit the state on January 17 to oversee the initial preparations for the elections and hold meetings with the state election officials and political parties.

"Considering the climatic condition, academic calendar and other ground situations, the ECI announced the date of elections and made it clear that the model code of conduct has come into force with the announcement," the Chief Secretary said, adding that the elections would be conducted on the basis of photo electoral rolls with reference to the final electoral rolls published on January one.

Mr Prakash, however, underlined that the commission had asked the state authorities to make video graph of all critical events in the ensuing polls to ensure free and fair elections and make it a model for the country.

He expressed satisfaction over the law and order situation in the state and informed that Central Paramilitary Forces (CMP) would be deployed in polling booths of the state and the hyper-sensitive polling stations would get at least three CMP companies.

Altogether 190 companies of the CMPs would be deployed across the state during the polling process, he added.

Meanwhile, both the state unit of the Congress and the CPI(M) expressed satisfaction over the poll preparations and ensured to give all-out support for free and fair elections in the state. (UNI)

LUCKNOW, Jan 15: Former Uttar Pardesh chief minister and Samajwadi Party supremo Mulayam Singh Yadav has alleged that he and his party leaders had been kept under house arrest on the behest of chief minister Mayawati on the occasion of latter’s birthday.

"A large posse of police has been deployed at my residence and the party office to avoid any protest from the partymen with no permission to move out,"Mr Yadav told reporters at his state party headquarters this afternoon.

The action from the state administration came to pre-empt possibility of any demonstration or potest from the SP workers on the occasion of the Chief Minister’s birthday. Several arrests have also been made of the SP-men who, as a mock excercise were collecting ‘alms’ on the street to send it to Ms Mayawati.

The SP President described the action as ‘against the democratic’ norms and said the ‘house arrest’ of SP leaders and workers clearly showed the undemocratic and dictatorial attitude of Ms Mayawati. "May be SP men had to stage some demonstration but this is the right of any opposition party to point out the mistakes of the ruling party," he said.

In reply to a question, Mr Yadav said the police erected a barricading around his residence and party office since early morning and banned any entry or exit without giving any reason for this. "Atleast, we should have been intimated of our fault," he fumed.

"Ridiculing the birthday bash of Ms Mayawati, the former UP CM said it was just another excercise of the BSP leader to collect money from all quarters. He questioned the conduct of some officers who were present at the ‘cake-cutting’ ceremony at CM’s residence singling out and alleging it was unbecoming of a senior officer like the Director General of Police (DGP) to be present in uniform.

Mr Mualaym Singh Yadav, who chose not to wish Mayawati on her birthday, replied to a poser in this regard saying "Woh Meri Shubhkamnayen Lena Hi Nahi Chahti Hain Jabki Main To Uneh Poora Ashirwad Seta (she does not want my greetings while I would like to give her all the bleassings)," he said.

Meawnhile, the SP workers tried to stage demonstration at few places in the state capital against the alleged ‘extravagance’ displayed on the birthday of the Chief Minister but the police deployed in plenty prevented them to do so and arrested several persons. (UNI)

Mayawati announces mega projects on birthday

LUCKNOW, Jan 15: After storming back to power eight months back, Uttar Pradesh Chief Minister Mayawati today celebrated her 52nd birthday with great fan-fare, launching the Rs 40,000 crore Ganga Expressway project to link Noida and Ballia besides a host of other schemes.

Cutting her birthday cake at a glittering function at her official residence, Mayawati critisised those opposing the expressway project, and the Centre for allgedly meting out step motherly treatment to Uttar Pradesh.

The Chief Minister also announced several projects including a Rs 1600 crore scheme for the nine drought affected districts in the state.

Mayawati lashed out at the previous governments in the state and the Centre for their "apathy" towards the drought affected Bundelkhand region.

She also announced a health insurance scheme for the people living below the poverty line and setting up of an ultra mega thermal project of 4000 mw with the cooperation of NTPC at Lalitpur.

To provide training to the State Government employees, a centre for good governance will be set up in the state capital, Mayawati said.

She later told reporters that her Government was committed to the welfare of ‘sarva jan’ (every section of the society).

Top civil and police officials including the cabinet secretary Shashank Shekhar Singh, Chief Secretary P K Mishra and police chief Vikram Singh were seen vying with each other to offer her the birthday cake.

Mayawati also announced setting up of two super specialty hospitals in the name of B R Ambedkar at Noida and Greater Noida.

About the Ganga Expressway project, she said a project of such magnitude was being implemented in the country for the first time.

"The farmers and industries would benefit from the project as products will reach Delhi faster," she said.

Mayawati said mostly infertile and barren land would be acquired for the project and that too with the consent of the owners.

Talking about drought-hit areas in the state, she said "despite non-cooperation of the centre, the state government has started relief and development works on a war footing for the people of Bundelkhand and other affected districts".

She said a Centre for good governance would be set up in the state capital for imparting training to officers. "It will also serve as a knowledge centre and think tank for good governance", she said. (PTI)

NEW DELHI, Jan 15: Those keen on embarking on a virtual expedition around the world in 30 minutes will have to wait till January 19 when the Indian version of the internationally renowned quiz show ‘Nat Geo Genius’ kicks off on National Geographic Channel with acclaimed director and actor Rajat Kapoor anchoring the 27-episode voyage.

Speaking at a news conference here today, National Geographic Channel-South-Asia Managing Director Nikhi Mirchandani said, Nat Geo Genius received a great response when its international version was first showcased in India a few years ago. We are confident that our viewers will definitely enjoy the Indian version of this acclaimed and popurlar quiz show."

Rajat Kapoor, who was also in attendance at the conference, said, I was quite reluctant when I was first asked to host this show as I had never earlier done such a thing. I was amazed at the kind of knowledge the contestants displayed during the show. Now, I can say that after anchoring the show, I am a more enlightened person than I was earlier."

Altogether 54 contestants will participate in the show, out of which 18 will make it to the quarterfinals. Out of 18, six will enter the semi-finals and three will be locking horns in the final. The winner will be entitled to travel business class to his dream destination by Lufthansa, which is a co-producer of the show, flight. Each show will be of 30-minute duration.

Kakodkar non-committal on ‘agreed text’ with IAEA

MUMBAI, Jan 15: Atomic Energy Commission Chairman Anil Kakodkar was today non-committal on when the "agreed text" on India-specific safeguards for civilian nuclear power plants with the IAEA will be finalised.

"It is a detailed technical exercise and no template exists for it....I would not like to predict on it (when the agreed text could be readied)," Kakodkar told reporters, a day ahead of scheduled talks between India and the International Atomic Energy Agency in Vienna.

The third round of talks in Vienna last week failed to ready the agreed text and the next round is scheduled to begin tomorrow.

Originally, the third round was considered to be the final round but there was no agreement on the issue of India’s right to hold its strategic reserve to cater lifetime supply to its civilian nuclear plants.

There was also no meeting point on the issue of corrective measures to be undertaken in the event of stoppage of fuel to power plants.

The fourth round is widely believed to be the concluding round but because of the complexities of negotiations on these crucial issues there is a possibility that the negotiations may spill over to another round of talks.

When asked if the negotiations was taking longer than expected, Kakodkar said; "I wouldn’t say so."

He also declined to say if the talks beginning tomorrow could be the final round of talks with the IAEA.

Kakodkar was speaking on the sidelines of an International Symposium on Neutron Scattering which he inaugurated at Bhabha Atomic Research Centre here.

India has to finalise the text only after which the US will be able to negotiate with the 45-member Nuclear Suppliers Group. The negotiations have to be completed before March to take forward the Indo-US civilian nuclear deal.

The talks, a follow up to the Indo-US civilian nuclear deal, is one of the pre-requisites for operationalisation of the deal, first mooted in July 2005.

Once the text on safeguards agreement is finalised with the IAEA, it also has to be approved by the UPA-Left committee.

International cooperation in nuclear commerce is possible only after the India-specific safeguards are finalised with IAEA followed by a ‘clean’ and ‘unconditional’ waiver for India from the 45-member Nuclear Suppliers’ Group and the "updown" vote of US Congress on the 123 agreement.

The first talks on the safeguards were initiated on November 21 last by IAEA Director General Mohammed ElBaradei and Kakokdar.

The talks began after the Left parties, which have opposed the Indo-US civilian nuclear deal, agreed to allow the negotiations with the IAEA. (PTI)
