Excelsior Correspondent

JAMMU, Feb 6: D K Kapoor, Judicial Member of Special Tribunal has directed Ram Lal, a resident of Bohri, opposite Poonch House to voluntarily remove super structure of shops, dairy farm and balconies which were built in violation of Municipal Laws.

The Tribunal while dismissing the appeal against the final notice of Municipal Authority, also directed the Municipal authorities that they may grant sufficient time not more than one month to the appellant to voluntarily remove the super structure, failing which they may proceed in terms of Rule 73 (3) of COBO Act.

Court acquits BDO, VLW as VO fails to prove case

Excelsior Correspondent

JAMMU, Feb 6: Special Judge Anticorruption Kartar Singh acquitted Altaf Hussain, the then BDO and Prem Raj, Village Level Worker (VLW) Bhaderwah of corruption charges as the State Vigilance Organisation (SVO) failed to prove its case against them.

According to the Vigilance case, on the report of Incharge Vigilance team of Doda, a preliminary enquiry was initiated against Altaf Hussain, then BDO and others and a case under Prevention of Corruption Act and RPC was registered.

During the investigation, it came to fore that the BDO purchased 2620 bags of cement during his tenure of service at Bhaderwah and allegedly embezzled 500 bags thereby causing loss of Rs 70,000 to the State exchequer. After completion of the investigation, the Vigilance Organisation presented challan in the Court of Special Judge Anticorruption.

After hearing both the sides, Special Judge Anti-Corruption observed "it is the case of SVO that the cement was received in the office of BDO on April 7, 1994, April 27 and April 31, 1994 respectively for which BDO has even issued receipts", adding "this document has been produced by the prosecution and as such it cannot be ignored".

Since it was for the Investigating Officer to explain as to whether the receipts were original but the same was not done so it casts a doubt on the credibility of the Vigilance story, the Court further observed and said that defence taken by the accused stands proved and corroborated by the prosecution evidence.

"In order to prove its defence the accused is at liberty to produce evidence in defence or rely upon the prosecution case and indirectly introduce such circumstances by way of cross-examination and rely on the probabilities and other circumstances", the court further said.

After considering all the facts and circumstances, the Court said that Vigilance Organization has failed to prove its case against the accused beyond any reasonable shadow of doubt and acquitted them of the charges.

Shivani returns after a long interval with 'Haadsa:Haqeeqat'

By Ravinder Kaul

Every time Shivani Cultural Society returns with a new play, I see a glimmer of hope that the group will reactivate itself and give a new fillip to the theatre of Jammu with the thematically stimulating and artistically creative plays, that the group was once known for. However, gaps between two performances keep increasing and starts, more often than not, turn out to be false ones. This time the group has come with an added flavor. 'Haadsa : Haqeeqat', the play presented by the Shivani at Abhinav Theatre here today, has also been written by one of the old Shivanians, Vikram Sharma.

It is a bold effort and, as was revealed during the course of the concluding ceremony, the play has already been performed earlier last year. The theme of the play reveals around the unexpected and unsavory turns that the lives of people take during the attempts at making ends meet. It is a cruel world out there and those of us who have not suffered the misfortune of choosing between the devil and the deep sea must thank our stars rather than criticize and comment on the acts of those who are not so fortunate.

The play is a slight deviation from the traditional style of Shivani. Although it carried forward the trademark legacy of realism, there was some deliberate absurdity embedded into the theme. Speaking about the artistes, one must give a standing ovation to Himanshu Darshan. He is an ace actor and given proper opportunities and some luck, he can truly excel at the national scene. Jatinder Dhameer and Sapna Soni are also now gradually moving to the category of veterans. One can always expect a competent performance from them. They did well. Neha Lahotra was the find of the performance. She truly did very well and deserves to be integrated into the hallowed circle of Shivanians. Master Siddharth Vikram Sharma also exhibited confidence in his brief appearance.

Dr Sanjay Gupta, the director of the play had done well to make this complex theme palatable for the common viewer. The inclusion of Greek gods into the theme and the court room enactments had been handled creatively.

One does have a feeling that the dramatic sequences in the play could have been kept as just dramatic and not allowed to slip into the realm of melodrama. It is a stark play, without a glimmer of hope.

The Kafkaesque situations in life and the futility of existence is the lasting impression that a viewer carries home.

One hopes that this play will prove to be a harbinger of many new performances by Shivani Cultural Society and one will see more of their plays in not too distant future.
