'Power for
pardon subject to judicial review'
No
clemency on political, religious
considerations: SC
NEW DELHI,
Oct 11 : In an apparent message in
the midst of the controversy shrouding
the hanging of Parliament attack accused
Afzal Guru, the Supreme Court today held
that the powers of President and Governor
to grant clemency was open to
"judicial review" and
extraneous considerations like political
loyality, religion and caste cannot be
grounds for granting pardon to a convict.
The far-reaching judgement came from
Bench of the Apex Court that set aside
remission of a sentence given by the then
Andhra Pradesh Governor Sushil Kumar
Shinde to a Congress activist sentenced
to 10 years imprisonment in a murder
