Muthi
Excelsior

JAMMU, Oct 10: A massive
demonstration was staged by the people of
Muthi area today in protest against the
removal of 25 structures on the bank of
Ranbir Canal by the district
administration.
A team of
district administration alongwith large
number of police personnel reached Muthi
bridge this morning and started razing
structures made on the bank of canal.
Hundreds
of people gathered on the spot and
started raising slogans against the
district administration. While expressing
grave concern over the demolition drive,
the residents of the area asked why only
Laxmi Nagar was made a target and not
other places right from Canal.
Lashing
out at the authorities, Col. (retd) M S
Jamwal accused them of harassing the
people unnecessarily as the land which
comes under the Agrarian Reforms Act has
been purchased by the people from its
owners for which they have the valid
documents of Revenue Department.
He said in
various cases some Government officers
have constructed houses over two decades
back after seeking the loan to which no
objections certificates have been issued
by Revenue, Irrigation and Rural
Development Departments.
"This
is a dispute between the Revenue and
Irrigation Departments which they should
settle themselves instead of making the
residents a scapegoat", said Prof B
L Fotedar, who has purchased the land
falling under Khasra Number 736 in 1993
from one Chatter Singh.
Though
agitating people also disrupted the drive
for sometime yet the same was resumed
with the intervention of police. Deputy
Commissioner Jammu, Hirdesh Kumar Singh
and SSP Jammu Mukesh Singh were
personally supervising the operation.
During the
three and half hour long drive, a total
of 25 structures including some shops and
portion of some residential houses were
razed. "On the first day of the
special drive, we covered area from Muthi
bridge to BSF camp and the remaining
portion will be taken up after some
days", Deputy Commissioner told the
EXCELSIOR.
He
disclosed that as per the law there
should not be any sort of encroachment
upto 150 feet area from the centre of the
canal on both sides but people have made
constructions on the land in violation of
the law.

Nirmal
Singh criticizes Mehboobas
statement
Excelsior
Correspondent
JAMMU, Oct 10: President State
Bharatiya Janata Party (BJP), Dr Nirmal
Singh has strongly criticized the
statement of the People's Democratic
Party (PDP), chief, Ms Mehbooba Mufti on
restoration of Article 370 to its
original position would lead to the
settlement of self rule in Jammu and
Kashmir.
He said as
a matter of fact this article was
incorporated in the Constitution to
empower the Valley centric ruling elite
to exercise absolute legislative and
executive powers and harm the general,
political and legislative rights of the
people.
He also
said this Article was basically designed
to prevent the Union Government from
taking any action against the Valley
leaders of all hues whose activities all
along had been harmful for the national
cause in Jammu and Kashmir.
Commenting
on the PDP leaders concern for the
people of Jammu and Ladakh regions and
her assertion that the kind of self rule
she has been demanding, if introduced
would empower all the regions of the
state and that there would be no
discrimination against the people of
Jammu and Ladakh, Dr Nirmal Singh
reminded the PDP of its anti Jammu
activities during the time it led the
coalition Government in the state.
He said
who does not know that it was PDP which
opposed the Jammus demand for the
creation of additional districts in the
region and parity between the two regions
in the Secretariat, in the two regional
services of J&K, in technical and
professional institutions and other vital
spheres such as service sector and
economic institutions.

80 pc increase in
resin production fails
to meet local
units demand
By Gopal Sharma
JAMMU, Oct 10: Despite
eighty per cent increase in the
production of resin in the
J&K State, the Forest
Department has failed to meet the
demand of nearly 22 turpentine
and paints units in the State.
While
the State Forest Department is
meeting the demand of hardly a
dozen units with the local
production of resin from the
areas like Rajouri-Nowshera,
Kalidhar, Reasi, Udhampur and
Billawar, at least ten units here
are forced to import the raw
material for the paints based
units from neighbouring Himachal
or Uttranchal.
Principal
Chief Conservator of Forests
(PCCF) Irshad Khan told the
Excelsior that Government has
taken a decision to curtail the
production in view of increasing
pressure on the forests. He said
massive damage has been suffered
by the forests due to various
activities and keeping in view
this fact during 2002-03, it was
resolved to decrease the
production of resin by 20 per
cent.
Referring
to the consumption of this raw
material in industrial units
here, he said the forests here
are not able to meet the demand
now and many of them are managing
it from Himachal and even
Uttranchal. The unit holders here
also claim that they get this raw
material cheaper from Himachal
Pradesh as compared to J&K.
As per figures available nearly
12,000 m ton resin is the
consumption of the units here
every season while State is
meeting hardly fifty to sixty
percent of the demand, he
maintained.
Giving
figures, Chief Conservator of
Forests, Jammu, Abhay Kumar said
that with the production of 3934
m ton resin during 2004-05, the
State earned a revenue of Rs
10.12 cr while it earned Rs 1860
cr during 2005-06, witnessing
nearly 80 percent increase in its
revenue. Responding to a
question, he said there was
production of nearly 11,090 m ton
of resin during 2002-03 but
thereafter, the process of
curtailment started.
Apart
from resin, the revenue generated
from the other minor forest
produce like Guchhi, Rajma,
Anardana, Kuth, Discoria, Dhoop
etc. was to the tune of Rs 1.55
cr during last year, whereas, the
royalty outstanding as sale of
timber to the SFC has reached up
to Rs 311 cr. The revenue from
minor forest produce was just Rs
14 lakh recorded in 2002-03 while
it increased to Rs 55 lakh in
2003-04.

Bounce
cheque case against Shekhar Suman
HC
quashes proceedings initiated by
court below
Excelsior
Correspondent
Jammu, Oct 10: Justice YP
Nargotra of the State High Court
Jammu wing today quashed the
proceedings initiated by Court
below against Shekhar Suman a
Film/TV personality and allowed
all the nine petitions filed by
Shekhar Suman seeking quashment
of proceedings in the court
below.
Special
Excise Mobile Magistrate Jammu
had taken cognizance on the
complaints filed by M/s Shiv
Shanker and others Mrs. Krishna
Suri and Others and process has
been issued against Shekhar Suman
and others. The accused company
Growell Multi Trade India Ltd had
issued cheques in favour of
complainant, the complainant
while producing the cheques; the
same were dishonoured and
returned with memo that funds
were in-sufficient in the
account.
The
cheques were issued and signed on
the behalf of the company by the
accused Director and of Growell
Multi Trade India Ltd and not by
the accused petitioner, the
complaints have been filed by the
complainant for prosecuting
petitioner Shekhar Suman for
commission u/s 138r/w 141 of
Negotiable instrument act.
Justice
Nargotra after hearing Advocate B
S Salathia along with other
Advocates appearing in the nine
filed by the Shekhar Suman and
Advocate KS Johal appearing for
the respondents and also referred
various judgments of the Supreme
Court observed that in the
complaint it is specially alleged
by the complainants that accused/
petitioner Shekhar Suman was
In-charge and was responsible to
the company for conducting its
business. He has been described
in the complainant only as
Director, Coordinator/ Promoter
of the company, which according
to the counsel for the
complainants/respondents is not
in fact, yet assuming that
Shekhar Suman holds said
position, that by itself does not
made him liable for the
commission of the offence u/s 138
r/w 141 of the act.
The
contention of the counsel of the
respondents that the question
whether petitioner/accused is
In-charge and was responsible for
the business of the company at
the relevant time of commission
of the offences should be left to
be determined by the trial court
is without any merit. Such a
situation would arise only where
in a complaint, accused is
alleged to be In-charge of and
responsible to the company for
conduting its business and the
accused takes up a defence that
he is not In-charge and
responsible to the conduct of the
business of the company, in that
case the question would be
determinable being a question of
fact during trail. In the present
case as the necessary averments
in the complaint are lacking, the
process against the accused could
not have been legally issued
against the petitioner.
Justice
Nargotra further observed that
Mr. Johal submits that
complainants can demonstrate by a
CD in which the accused
petitioner Shekhar Suman has
claimed that he is responsible
for the business of the company.
He in fact seeks this court to
view it self the said CD. As the
said CD before the trial court,
the same cannot under law be
allowed to be introduced as
evidence in the proceedings in
hand. The Court declined the
prayer made by the counsel for
the respondents. The complaints
filed by the complainant/
respondents against the
accused/petitioner Shekhar Suman,
cannot proceed consequently, the
orders by which cognizance has
been taken by the court below
against Shekhar Suman and the
court complaints qua the
petitioner are quashed.
With
these observations the court
disposed of nine petitions filed
by Shekhar Suman u/s 561-A CrPC
for quashing the complainst
pending in the court below.
