SRINAGAR, Sept 30: "Siraj Bagh should emerge within two years as the biggest garden in Asia decorated with rare local, national and international flower species so that it becomes focal point of tourists", said Chief Minister Ghulam Nabi Azad while inspecting the garden adjoining cluster of gardens and nurseries here this morning.

The Chief Minister was apprised about the steps taken since last year for the development of Siraj Bagh. Last year, Mr. Azad had instructed that Siraj Bagh, covering about 700 kanals of land which was in a dilapidated condition and only some of its corners were being used for nurseries, should be developed. However, immediate steps were taken by the floriculture department and the garden was opened in April this year decorated with lakhs of tulip flowers.

Accordingly in April, Siraj Bagh got extraordinary fame being the only garden with such a large number of tulips in Kashmir. Thousands of tourists and local visitors visited the garden.

Today, the Chief Minister inspected all nook and corners of the garden and instructed the floriculture department to ensure terracing, landscaping and leveling of entire portion of Siraj Bagh.

The Chief Minister was informed by Director Floriculture S. L. Pandita and incharge officer of the garden Imtiaz Hussain that the plan envisaged for the garden covers 2000 kanals of land valuing Rs.2000 crore which is already available with the State.

He also visited hi-tech hothouse and green house and evinced keen interest in the plants kept and propagated in these modernized facilities.

Mehbooba for early decision on increase
of Hajj quota for J&K

Excelsior Correspondent

SRINAGAR, Sept 30: People's Democratic Party (PDP) president Mehbooba Mufti has said decision to increase Hajj quota for Jammu and Kashmir should be taken at an earliest to remove the uncertainty over the issue.

In a statement issued here Ms Mufti said in her recent meetings with UPA chairperson Sonia Gandhi and various Central Government functionaries in this regard, she was assured that all possible would be done to increase Hajj quota for J&K as was done in the recent past.

Ms Mufti added that she was even assured the reserve Hajj quota of the Union Minister for External Affairs would be diverted to J&K to accommodate as many pilgrims as possible, but with the passing of each day unrest was brewing among intending Hajis as there was no indication about increase in quota. She urged the Centre to take an early decision on the issue to remove ambiguity.

Ms Mufti said there were instances when some pilgrims have been disallowed from proceeding to Hajj on one pretext of the other at the eleventh hour creating an awkward situation for such pilgrims and in some cases a few selective pilgrims were forced to turn back from the airport even after being issued valid travel documents for undertaking pilgrimage.

Questioning such an unpleasant practice, Ms Mufti said being one of the fundamental religious duties in Islam, nobody should be, in the first instance, allowed to create hurdles in performing the same.

She said there was no logic in preventing a pilgrim from performing the Hajj merely on the basis of political affiliation.

Court acquits woman in family pension cheating case

Excelsior Correspondent

JAMMU, Sept 30: In an interesting case wherein accused Ram Piyari wife of Bindru Ram Brahman managed sanction of family pension worth Rs. 1,14,000/- of late Bindru Ram Rajput by showing herself widow of late Rajput inspite of the fact that Bindru Ram Rajput had not married, Second Additional Sessions Judge Jammu, AK Koul today acquitted Ram Piyari and Gian Singh both residents of Chowki Chora Akhnoor as the CBI failed to prove the case.

According to the CBI, in August 1999, on a source report that Ram Piyari w/o Bindru Ram Brahman and Gian Singh along with some other persons have entered in a criminal conspiracy to manage sanction of Family pension of late Bindru Ram Rajput in favour of Ram Piyari by showing that Ram Piyari is the widow of Bindru Ram Rajput whereas Rajput was unmarried. They forged the documents to support a fake claim and got an amount of Rs 1, 14, 000/- as pension dues and arrears through deceitful means and so defrauded the public exchequer.

A case was registered by the CBI and conducted investigation and after completion of the investigation presented Challan in the Court of law.

While acquitting the accused, after hearing Special Public Prosecutor Mr. SK Bhat appearing for the CBI and Advocate GR Asgar appearing for the accused, observed that Bindru Ram Rajput was unmarried as per the statement of Tota Ram and Ram Piyari was married to Bindru Ram Brahman. This version again does not lead anywhere, even if accepted this version, it does not prove exactly what was required that is accused Ram Piyari made false pension claim, the other witnesses also given the similar version. According to prosecution witness Bal Krishan Sharma that Ram Piyari was drawing pension of her husband, through her account, she may have drawn the sanctioned amount, but that is different issue.

The Court further observed that who sanctioned, it who applied for it, who verified the accused and withdrew particular amount, it may be a question of a mistaken identity and may ultimately give rise to a civil liability, but so far as penal liability is concerned, it cannot be fastened on the accused. Prosecution Witness Babu Singh is an official of DPDO, an agency supposed to deal with pension cases of retired Army personal. He says that pension of Ram Piyari, was settled before his posting in the said office. Court was with no option but to say that prosecution has failed to make out the case against either of the accused. There are so many doubtful areas, where one is not in a position to say anything with certainty.

Accused Ram Piyari might have received some amount in-genuinely, but that is not sufficient to hold that she had any role in all what is alleged. Investigating Agency (CBI) though a premier agency of India, has not been able to concentrate on main issues to create a link between accused and the crime, As such the prosecution agency failed to create a clear nexus between the guilt and so called guilty, the case as such fails and dismissed, accused are acquitted being giving the benefit of doubt.
