One can hardly draw any comfort from a series of recent reports from the Kashmir Valley particularly its northern districts. These have once again brought into sharp focus the unholy alliance between unscrupulous officials and business persons with the nefarious objective of looting the State's forest wealth. That they enjoy political patronage at some level is also evident. In a short spell there has been a sequence of instances underlining the ugly presence of timber mafia in this region. In one the Forest Protection Force (FPF) has seized 200 cubic feet of fresh wood from a sawmill at Delina in Baramulla district. It was meant to be a perfectly legitimate transfer of green gold from one place to the other. However, three dishonest employees (they have since been suspended) accompanying the material in a truck sold it off on the way. One is about the surrender of an arms manufacturer working for the Maoists along with his wife to the police in Warangal in Andhra Pradesh. The other is about the recovery of nearly 200 kg RDX, 60 detonators and 25 kg of wire fuse from a militants' hideout in Doda district in the State. Is there any link between the two? These have once again brought into sharp focus the unholy alliance between unscrupulous officials and business persons with the nefarious objective of looting the State's forest wealth. That they enjoy political patronage at some level is also evident. In a short spell there has been a sequence of instances underlining the ugly presence of timber mafia in this region. In one the Forest Protection Force (FPF) has seized 200 cubic feet of fresh wood from a sawmill at Delina in Baramulla district. It was meant to be a perfectly legitimate transfer of green gold from one place to the other. However, three dishonest employees (they have since been suspended) accompanying the material in a truck sold it off on the way. It seems that certain police men had also sought to be in cahoots with with the forest staff only to be timely pulled up by their boss. The concerned deterrent machinery has been spurred into some action following this episode. Two unauthorised mills have been dismantled and 130 cubic feet of timber seized in at least three raids in Kupwara district. No less a person than Minister for Forests Qazi Mohammad Afzal himself has given the most stunning piece of information. According to him, he had received a telephone call from a ministerial colleague seeking release of a truck and its contents seized near Badgam because, according to him, these were being carried for the renovation of a mosque. Since the other minister's reaction is not immediately available it is possible that he may have been misled into asking for a reprieve. The available information suggests that the driver of this vehicle had tried to steer past the forest checkpost and escape. Moreover, he raised additional suspicion by carrying the highly precious wood during night. The Qazi has promised a thorough inquiry to ascertain the truth.

Three murky facts have come to light in the wake of these occurrences. One is that there are sawmills working in prohibited zones. Secondly, there is movement of forest goods between dusk and dawn which is again not permissible. Thirdly, the immunity provided for religious places is being misused. Over a dozen cases have been recorded in which the people after being caught in the acting of smuggling have claimed that they were carrying material "actually for mosques". One hopes that these disclosures will lead to necessary correctives without further loss of time. It does not serve a lasting purpose to swing into momentary action and then suffer from a relapse. For his part the Qazi has decided to directly assume the authority of sanctioning timber for shrines across the State.

Does one require conducting a deeper study to know that the State has lost much of its forest cover? A close look is enough to reveal bald patches all over. By and large the mystery of forests fires including in government depots remains unresolved. There are enormous financial losses on this count. At least one matter of forest loot is pending probe by the Central Bureau of Investigation. The Government has to do its job of protecting forests. The people also need to be watchful. What the State is without is thick green carpet?

Although a native of Andhra Pradesh he had chosen Chennai in Tamil Nadu to complete his two-fold project of making rockets with a launch pad and developing shoulder-mounted rocket launchers and rockets. Paid Rs 30 lakhs for the job he went on to create 1600 rockets and 40 launch pads He dispatched all but 50 of rockets to Vijayawada in Andhra Pradesh for their transfer to Maoist locations elsewhere. The Andhra police had smelt the rat when it seized 875 rocket shells and launchers in September. He and his wife who was also a Maoist activist had decided to give up in order "to lead a normal life." There is nothing new so far as the story of the material captured in Doda district is concerned. Such seizures are more a routine than a rarity on either side of the Pir Panjal. For the sake of record the latest catch has been made from a terror den near a school in Ramban. Kalashnikovs, rifles and other explosives have also been picked up from Mendhar (Poonch) and Basantgarh (Udhampur). At times it appears as if there is no remote hilly area without clandestine militant shops of unauthorised armaments of high quality.

Put together these incidents reveal an almost similar tale of two states. There are certain obvious conclusions. The people hostile to the country have plenty of money. Moreover, they can easily arrange the necessary bits and pieces for creating dangerous bombs. There is no doubt that they have gained the requisite expertise in this behalf. Inimical foreign forces too are at work and keen to fish in any trouble that can damage this country. There can't be two opinions about this. The Maoists and other terrorists can obtain a part of cash and artillery through loot and extortions but not all of it to fund their wicked actions. Therefore, one can safely conclude that they have developed unholy alliances and linkages even across the borders. We in this State are witnesses to the huge inflow of not only arms but also trained militants from the other side of the Line of Control. There is a strong possibility that these elements out to challenge the unity and integrity of the country have an internal nexus as well. How can one explain that the militants active in the State are able to secure objects to carry out hits as far as in capitals of western and southern states? Do they carry bombs and Kalashnikovs along with them all the distance? It does not stand to reason. Apparently there is a connection that has to be snapped.

If a common man owes a paisa to the Government he will be grilled in a court of law, and finally made to cough up that small amount.

On the contrary hundreds of former MPs and ministers owe the national exchequer crores of rupees in the form of illegal house occupation rent and outstanding telephone, electric and water consumption bills to the tune of Rs. 886.47 crore as per the latest assessment made by the Estate Department. No government for the last 15- years has been able to recover such dues, and no legal proceedings have been initiated in that direction. It is a scandal which has no parallel anywhere in any democratic country.

The controversy regarding unauthorised occupation of government accommodation by VIPs has given rise to a question of considerable constitutional and legal importance whether the government can with the limits of its powers, waive rent dues from such occupants, and whether any rules made by Government authorising such a waiver would be constitutional.

The fundamental principle of law is that a claim to a debt is a right to property. Just as person can deal with his personal property as he likes, one having a claim to a debt can deal with it as he wishes. He can allow it to lapse by not initiating action for its recovery within time allowed by law. He can waive it according to his whim with no reason. He can also take recovery proceedings knowing full well that enforcing recovery from the debtor may involve risk and at the same time may not mean much for him. He is the master of the claim if it is a personal debt.

But unlike a personal debt there are cases in which the creditor is not the owner of the debt claim personally but has the obligation to recover it. If one forms a trust for the benefit of some persons and makes himself the trustee, he ceases to own it personally and gets only the right to manage it for fulfilment of the object of his own choosing. If somebody finds that the founder of the trust has done anything destructive of the trust property or the purpose for which he himself established the trust, through judicial proceedings he can be removed. Again if one appoints an agent to look after his business and gives him the authority to manage things, the agent will be presumed to act honestly in a way that will not be destructive of the property itself. While the owner of the business could waive a debt or allow it to lapse by law of limitation the agent by acting so may incur the liability to pay damages to the employer for the loss suffered by his omission or negligence.

In constitutional scenario of administrative action in a democracy it should be remembered by the holders of power that they are just agents of the people who have to work not as master but agents. Just as an agent cannot, but the credit-owner can, write off a debt, the Government cannot. To do that the state has to do it by distinct and articulated authorisation through legislation and not by self-appropriated guidelines framed by themselves under conduct of business rules. Conduct of business rules can cover procedural part of Government working. The rules cannot dilute the substantive part of legal obligation in a constitutional government. Unless it can be shown that the legislature in express terms has provided the right to waive a debt owned to the state, it cannot be presumed as a normal government function to do it. There are countless precedents in India, the US and the Great Britain holding that if by any administrative action a loss is caused to the state, such of the functionaries to whom the decision is traced was guilty of corruption.

In matters of debts due to the state, it has been held that only under two circumstances can the debt due to the state be waived. First, when it is felt that the cost of realisation may exceed the likely realisation. Second, when the debt has become bad or sticky or unrealisable. The debt cannot be waived by Government acting in a way as though it were the private property of the decision-taking authority. If the waiver of debt cannot be justified in terms mentioned, the waiver order can be quashed by appropriate writ or order.

In India, there is no statute providing that in appropriate cases a debt owed to the state by someone may be waived. If there were a statutory provision, the decision to waive the debt would be subject to judicial review for satisfaction that the right has been used reasonably. In the absence of any statutory conferment the power to do that is unthinkable. The waiver order will be beyond the powers of the Government, even if it be the authority of the Cabinet. The Government decision will be ultra vires in the absence of statutory right to do so. The Government arming itself with weaponry manufactured in its own dump of business rule making power to do it will be glaringly unconstitutional. It will amount to making an unauthorised gift to the debtor of the amount waived.

This theoretical constitutional landscape has been articulated in express terms in our Constitution. Even in the absence of any law made by the appropriate legislature, the Executive powers of the Government will extend to all matters on which the legislature has the right to make laws (Articles 53 and 154). In hypothetical case of legislature not having enacted the law appropriate Government can do in these matters what they like subject to the provisions of the Constitution and observance of the three principles of natural justice. But in matters of money, in other words imposing taxes which are the main source of state revenues, and incurring expenditures, the government is anchor bound to law.

Article 265 provides that no tax shall be levied or collected except by authority of law. "Article 266(2) provides that all public money received by or on behalf of the Government of India.shall be credited to the public accounts of India." (Article 266 (3) provides that "no money out of the Consolidated Funds of India shall be appropriated except in accordance with the law for that purpose and in the manner provided in the Constitution." It has, however, been provided under Article 266(1) that the condition of no disbursement without legislative approval will be subject to providing for contingencies, which has to be established under Article 267 providing that "Parliament may by law establish Contingency Fund in the nature of an imprest to be entitled the Contingency Fund of India" into which shall be paid from time to time such sums as may be determined by such law and such Fund shall be placed at the disposal of the president to enable advances to be made to him out of such fund for the purpose of meeting unforeseen expenditure pending authorisation of such expenditure by Parliament by law under Article 115." Article 115 provides for post factum approval of such expenditure by Parliament.

In pith the articulated constitutional limitations prohibited waiving off of an actionable claim except subject to its approval by Parliament. Writing off will require specific parliamentary approval which can be given only on satisfaction of two conditions already mentioned, namely, the debt being bad or irrecoverable, or sticky or its recovery expenditure being likely to exceed the amount due. The possibility of writing it off as a charge of Contingency Fund being off, the only way to help this luckless segment would be to transfer to the public accounts fund of the Government from the Prime Minister's Fund, which may not be difficult for them to manage.

It is a sad commentary on the working of our Government if the waiver is exercised for the benefit of a select few who have capacity to pay but lack decency to do it while day in and day out the government is kicking out the overstayed class III and IV employees, realising the arrears, and allowing the favoured group of political portages to live and continue to live at Government largesse. Talking about the term "Gandhigirri"which rhymes with the another invention i.e. "Bhaigirri", represents the Gandhian image in a scornic or sardonic manner. All we need is to say or do, is to confine the movie to just a three hours affair, a good entertainer and a commercial hit of the Munna Bhai sequal. Precisely talking about business, our film makers can adopt any strategy to generate quick money keeping national interests aside at its first place. May be our Munna or Circuit join Nelson Mendela, Mother Terasa or Bill Gates depending upon the market strategies.

No doubt our father of nation guided us to freedom, but can we ever forget Bhagat Singh, Subash Chander Bose, Chander Shekar Azad,Mangal Pandey, Balwant Phadke and many more? Were they all the extras or the spot boys, if our freedom struggle is considered a movie? Here we can say that it was a collective effort at that time, but things will not work in current scenario with regard to Ahimsa or offering your face to be slapped second time, because one can't offer himself or herself for the second time when shot by a bullet in now a day situation.

Our Ghandian principles completely fail today. Be it the recent Mumbai Blasts or the parliament attack. It may help against spitting as shown in the movie but won't work against felons.

Our father of nation was very wise to practice Ahimsa or disobedience and used it pragmatically, with full gumption in a particular time against one such an authority, government or civilization who believed in law, judiciary and human rights to some extent if not completely.

Just imagine Hitler or Nazis as colonial power in India or in recent past Iraqis using it against Bush and company. Civil disobedience or so called "Ghandigirri" can only work if both the sides agree to play by rules, which seem to be quite impossible now days.

If Gandhi appears today in real life, like he appears in reel life, he would approve the strict and stern enforcement of law against anything that is illegitimate or illegal.

Again talking about "Lage Raho Munna Bhai" some critics called it a patriotic movie and many TV channels started discussions and debates on Gandhigirri, its nation wide effect, and its application. But in real sense it is just the business and we all enhance it by the name of entertainment, which is not a bad practice. But just like the ghost like appearances of Gandhi or the introduction of a cricket match (Lagaan) doesn't confirm patriotic approach completely.

No doubt the movie has a strong message message but we all are skeptical on its application today. Apart from this we miss the main feature of the Gandhism in the movie that it wasn't the patriotic sense that made the fictitious appearance of Gandhi possible, but the crusade to win the lady love which seems to be the main theme or a mission of almost every hindi movie.

Some experts also say that we are the lost or confused generation without a sense of history and they need to make the new generation aware of Gandhi and his principles. If they think so, then why a complete movie excluding "Munna Bhai and company" is not made again on Gandhi and the freedom struggle, after going through all the references, monographs and biographies? Infect today no one will dare to do so because no wants to feel insecure in terms of business or commercialism especially on the cost of Gandhi or Gandhian principles. The movie was made (1982) and won eight Oscars too, but it is sad to mention that it was called a "Richard Attenborough's Film". It was obvious to be called so, because it was made by the people other than Indians and on top of that a Non-Indian (Ben Kingsley) playing the role of Gandhi. It was only Roshen seth, Amrish Puri and Sayeed Jaffery , who managed to get some role to play in the movie.

So in the end we can conclude that, let it be just a nice movie or a good entertainer, made skillfully with a good sense of humor.

Society, being the mirror of culture and civilization tries to balance its strengths, exhibits positive traits and gathers different experiences of people in their living. It also reflexes its needs, requirements, weaknesses and deficiencies. Similarly, school is an instrument to dislodge evils of the society and to impart values as well as education.

Finally the Government helps to develop the academics as per the need of the society and manages education of the common masses with the financial resources. It also lays down Principles, objectives and criterian for various educational agencies working for the welfare of the society. It develops the society, it transfers the sentiments, emotions and culture of the society and helps to bring the changes according to the nature and environment around the society framing a revised curriculum with modified changes from time to time.

Today, eastern culture has been deeply impressed over by the western culture with the faster growth of science and technology there is urgent need to bring transformation in our lives in this competitive age by virtue of adaptability and dynaminism, which is more or less a prerogative of the society, school and the Government.

The Government can implement any scheme while financing education. By and large, the Govt exchequer plays a great role in the progress and prosperity of the society. Many centrally sponsored schemes are also looked after by the State Government. In our state, to our dismay, the grants are mostly sanctioned in the last month of the year that too during the last week. This legacy has become so customary especially in the school education department that the material so procured does not reconcile with the quality due to lack of proper planning and ill defined schedule. Consequent to it, the Senior authorities float the grants from one quarter to the other shifting their responsibilities over the Junior officers who inturn direct the various heads of the institutions for immediate utilization of grants. The result is that the process of purchasing becomes faulty and ineffective. There is less time to consult, reflect and synthesize the needs. This leads to blind purchase of Science Laboratory equipments and other costly apparatus in haste and haphazard manner without taking notice of the needs. Sometimes, grants are spent over such articles which are already available or surplus or not required at all in offices, school laboratories etc. Thus the conditions of the schools remain passive and the grants are exhausted or wasted in haste. In this context the proper utilization of grants, few facts are pin-pointed below for further planning, budgeting and implementing grants keeping in view present scenario of changing needs of the society as per the requirement of modern age. We need to reform and rejuvenate the education set up at different levels.

At Pre Primary Level :

No doubt, the Pre-Primary classes have been started in most of the schools yet the standard of teaching has remained very poor when compared to private schools. There is need to purchase electronic goods, toys for games and play so that reading and writing may be made very simple and interesting as if it were a joyous activity.

At Elementary Level :

There should be incorporation of maps, charts illustrative aids of local nature to study History and Geography of Jammu and Kashmir too besides current events pretaining to the State/Country, J&K Board of School Education may be directed to structure a Mini social science premier for J&K State having two parts; viz

Part-I soil & Surface : For all three regions (Jammu, Kashmir & Ladakh) representing each one separately identifying rivers, hills, mountains, planes, cities etc of each region explaining their people, customes, language, culture with economic, social, political and historical background of the State.

Part- II : Current events profile pertaining to state/nation in a brief and concise form. This social science premier may be provided to each student of class V free of cost as a bonus after its procurement from J&K Board of School Education Jammu which may go on supplementing study alongwith other normal text books upto Post Primary stage.

At Secondery Level :

Grants have to be allotted for organising Multi Tier Co-curricular Activities Competitions for each zone, tehsil, District, Province or State to be organised by a precise school Academic Council which will also be authorised to look into the work of inspection and supervision of High and Higher Schools. This school Academic Council may be raised at provincial level with the appointment of members under the guidance of Joint, Director Secondary Education. The members can be selected out of retirees having high reputation.

This will be a positive measure to improve teaching. More to say, the council will recommend incentive in favour of those teachers who show good results for the Board classes in form of one time annual incentive of Rs 500/- for those who show 75 percent and above result and Rs 300/- for others who how 60 percent and less than 75 percent results in their teaching subjects. Similarly, the students (regular) who come up in merit (only Distinction holders) from a particular school may be recommended by the Council an amount of Rs 1000/- and Rs 500/- to be paid out of either school funds (Mutual Benefit Fund) or from Pool Money grants (CEO office grants). This will encourage the students also thus activating teaching and learning process.

At Senior Secondary Level :

Some grants may be kept reserved for the introduction of a vocational cum Academic subject. This introduction of optional subject which will be granted only after successfully passing aptitude test by the student for a definite trait soon after qualifying matric examination. On the basis of interest, creativeness and curiosity, the candidate will be allowed to appear for any of these following options under this scheme.

For instance, Medical Education, Engineering Education, Administrative Education, Military Education, Teaching etc. Since these options will be of vocational nature there will be need to recruit skilled teachers on contractual basis on a large scale. Infrastructure, Lab. equipments and machinery may cost more. In order to meet up these requirements, additional grants are required to be made available before beginning of the teaching session. These all are the fundamentals which need to catch imagination of the society and the Government.
