HC
stays recovery of electricity bill
Excelsior
Correspondent
Jammu, Dec 29 : In a writ petition
filed by Messrs Pee Ell Alloys Industries
challenging the electricity charges of
over rupees three crore, Justice YP
Nargotra of the State High Court Jammu
wing stayed the recovery proceedings
against the petitioners and directed that
electricity connection of the
petitioner's firm, if disconnected, shall
be restored subject to petitioner's
depositing rupees 50 lakh.
The money
is to be deposited with Registrar
Judicial High Court Jammu wing as
security amount to be adjusted towards
the liability, if any, comes to be
ultimately. The Court further directed
that the amount deposited shall be kept
in fixed deposit till further orders.
According
to the petitioner's firm, a demand for
payment of Rs 3, 35, 59, 071. was raised
against the petitioner on account
of electricity charges for the
period November 15, 2000 to February
15,2001 along with panel interest. The
petitioner challenged the liability on
the ground that this demand has invalidly
been raised, as the petitioners have not
consumed the electricity for which the
demand has been raised.
Their case
was that though the demand has been
raised from November 15, 2000 to February
15, 2001 yet the fact remains that on
February 24, 2001 and Marc 5, 2001, the
petitioner's firm deposited Rs 18, 82,
525 and 7, 41, 375 for the electricity
charges. The demand raised was not based
on correct assumption of facts.
Petitioners submitted no demand
outstanding certificate issued by the
department on December 26, 2004.
Justice YP
Nargotra after hearing Advocates Gourav
Pachnanda and Pranav Kohli appearing for
the petitioner, issued notice to the
respondents, which were accepted by
Deputy Advocate General S Hakim on behalf
of the respondents. She was asked to file
objections within four weeks.
JU
agrees for re-evaluation after fierce
protest by students of BE
Excelsior
Correspondent
JAMMU, Dec 29: After day long
fierce protest for the third consecutive
day, Jammu University authorities
ultimately conceded the demand for
re-evaluation of two papers of the
Computer stream of VIth semester
Engineering students.
The
decision was taken after four hour long
marathon meeting by the Vice-Chancellor
Prof Amitabh Mattoo with Controller
Examination, Dean Academic Affairs,
Registrar and some other officers, who
were virtually gheraoed inside the VC
chamber by the agitating students, led by
NSUI leader Varinder Singh Chib.
According
to a statement, issued by the University,
the Engineering students of VIIth
semester, who have been declared
unsuccessful in Analysis & Design of
Algorethem and Automata & Formal
Language, have been given the option of
re-evaluation or re-examination of these
two papers. The students have to decide
for any one within seven days, added the
statement which was issued around 8.30
pm.
However,
the confusion continued to prevail till
late night as the students did not call
off their stir even after their main
demand of re-evaluation was conceded.
They were insisting that the
Vice-Chancellor should personally assure
them for accepting their demand.
Earlier,
the campus witnessed a strong protest by
the agitating students of Engineering,
including girls, who were demanding
re-evaluation of the two papers of VIth
semester in which all the students have
been declared unsuccessful.
During the
protest, four girl students fainted and
were rushed to hospital. Soon the
protesters turned violent and they went
on rampage. They broke window panes and
several flower pots kept in the
administration block. Even as a strong
posse of cops was deployed on the campus
and senior Police officers had also
reached the site, the University
authorities maintained a restrain and did
not order use of force against the
students.
In the
morning, the agitating students faced the
wrath of JU non-teaching employees who
were also protesting against their
locking up by the former yesterday.
It may be
mentioned here that the protesting
students had locked up the Examination
Wing and did not allow the employees to
come out of the office till late evening.

Amateur or
Immature v/s Professional or
Mature
By Ravinder Kaul
Let
us for a change start with the
last things first. At the
culmination of todays play
"Passport", presented
by Natraj Natya Kunj, just before
giving the formal introduction of
the artistes, Kumar A. Bharti,
the moving spirit behind the
group, asked the judges of the
Festival to take note of the fact
that some groups were employing
the services of professional
artistes, while the Festival was
only meant for amateur artistes.
The apparent reason for this
vocal reminder was to ensure that
only the amateur artistes are
considered for awards and the
professional artistes
participating in the Festival are
ignored.
Now
this is truly food for thought.
What exactly is the distinction
between an amateur artiste and a
professional artiste? Although
the Oxford Advanced
Learners Dictionary
describes amateur as " a
person who creates something with
artistic skill etc. without
receiving money for it", it
is common knowledge that some
honorarium has always been paid
by theatre groups, particularly
to music directors, musicians and
female artistes, for covering
their conveyance and other
expenses. Can the artistes
receiving such honorarium be
termed as professionals? In some
of the sports, like Billiards,
Boxing, Golf and Lawn Tennis, the
distinction between amateur and
professional is well defined.
Anyone who participates in a
tournament carrying prize money
or earns ones livelihood
from the sport is said to have
turned professional. Hence the
example in the Oxford dictionary,
"After he won the amateur
championship he turned
professional."
Now
do we actually have any
professional artistes in Jammu
who are earning their livelihood
from theatre? Only one name comes
readily to my mind, but he is not
participating in the Festival.
Then who or what is Bharti taking
about? Did he actually mean
immature when he said
amateur or is he
talking about some artistes who
participate in television
programmes and get paid, whatever
insignificant amount, for it? But
then television is vastly
different from theatre and Bharti
himself has participated in a
number of television programmes.
If he is talking about the
theatre groups paying some
honorarium to the artistes for
acting in their productions, how
are the judges supposed to know
about such payments? Is he
thinking of deploying the CID, or
for that matter the CBI, to look
into such under the table
payments running into hundreds of
rupees? Lastly, does Bharti
actually believe that the play
"Passport", presented
by his group today, stands a fair
chance of winning an award in any
category that can be marred by
some unscrupulous professional
artistes, surreptitiously
participating in the Festival?
Well let me rest my case and talk
about the play.
As
per the brochure circulated among
the audience by the group, the
play is based on the story of
Rajinder Kumar Sharma and has
been written by Kumar A. Bharti.
The fact remains that this play
has been actually written by
Rajinder Kumar Sharma and
published under the title
"Swarg ka Passport".
The play has been performed by
many theatre groups at many
places all over the country,
including Jammu. By making a few
changes here and there, that
every theatre group does
routinely, one cannot claim the
authorship of the play.
The
play opens and ends in the court
of Dharamraj, who is considering
the applications of different
deceased persons for issuance of
a passport to heaven. Chitragupt
is presenting the applicants one
by one and narrating their deeds
or misdeeds. In this process a
government official, a
businessman, a priest, an
advocate, a religious head, two
eunuchs, a leader, two hippies, a
drunkard and a police official
present themselves in the court
of Dharamraj for pleading their
respective cases and asserting
their suitability for issuance of
the Passport. In the process, the
director Abhishek Bharti wants to
highlight the evils prevalent in
Indian society today. Noble
thought, but executed in a very
hackneyed manner. Almost all the
artistes were very loud. The
costumes, particularly those of
Dharamraj and the two yamdoots,
were quite good. The set was also
appropriate.
Manoranjan
Kala Kendra presents its Punjabi
play "Usnoon Kahin" in
the Festival on Saturday.

HC directive
to Govt on Akhnoor migrants
Excelsior
Correspondent
Jammu, Dec
29 : A writ
petition has been filed by
Sangarsh Yuva Morcha seeking
relief under relief package for
the Akhnoor migrants of villages
Chaprial and Samual from where
they had migrated on June, 1999
on account of cross-firing and
shelling on the border. After
their migration, they were
provided shelter at Govt Ramnagar
Migrant Camp (Bomal) Akhnoor. In
view of their migration, the Govt
passed various orders since 1999
for making provisions for
providing reliefs to the migrant.
In
the present petition, the
petitioners claimed that the
relief under the relief package
have not completely been released
in their favour, seeking
direction to the respondents to
provide the relief to which they
are entailed.
Justice
YP Nargotra of the State High
Court Jammu wing came to the
rescue of these Akhnoor migrants
and directed State Govt to depute
a team of responsible officers to
inspect Ramnagar Migrant Camp
(Bomal) Akhnoor within a period
of one week and if on inspection
the tents, in which the migrants
are putting up, are found to be
in bad condition, the same shall
be replaced by new one within a
period of next one week. The
Court took serious note of the
Union of India for not filling
the objections and directed Mrs.
Deepika Mahajan counsel for the
Union of India that she shall
file objections on behalf of
Union of India through Ministry
of Defence and Commandant 6
Rajput.
In
the meanwhile, Mrs. Surinder Kour
Advocate appearing for the
petitioners submitted that the
conditions of tents in which the
migrants are leaving have since
been torn due to normal wear and
tear and because of which the
petitioners are suffering badly.
According to Advocate Surinder
Kour, the winter season is at its
peak, but the respondents have
not bothered to replace the torn
tents by new one so as to protect
them from the cold. She further
submitted that till the petition
comes up for final disposal, the
respondents may be directed to
replace the torn tents of the
migrants. On the other hand
Additional Advocate General BS
Salathia appearing for the state
submitted that the respondents
would have no objection to look
into the issue and if the need be
provide to new ones for the
migrants. The Court after
considering both the sides,
directed State Govt that the
tents in which migrants are
putting up are found to be in bad
condition, the same shall be
replaced by new ones within a
period of next one week.
