Jammu, Dec 27: Justice Mansoor Ahmed Mir of the State High Court Jammu wing today in a writ petition filed by Suman Bala and Kamla Devi, challenging the induction in KAS of 12 Child Development Project Officers and District Social Welfare Officers of Social Welfare Department J&K, after hearing Advocate Abhinav Sharma appearing for the petitioners issued notice to State of J&K, through Commissioner/Secretary to Govt Social Welfare Department, Commissioner Secretary GAD, Directors Social Welfare Jammu and Srinagar, Chairman J&K Public Service Commission and 12 private respondents returnable within six weeks.

Subject to objections of other side and till the next date of hearing the status-quo viz-a-viz service status of petitioners and 12 private respondents be maintained, the court held

This Court direction was passed in a writ petition filed by the petitioners, seeking directions to the official respondents to regularize/confirm the promotion of the petitioners as CDPO with effect from July 22, 1997 and further seeking direction to official respondents to reckon and fix the seniority of the petitioners as CDPOs over and above the private respondents as the petitioners are senior to private respondents.

During the course of argument, it was prayed for prohibition, restraining the official respondents from conferring selection grade upon the 12 respondents before conferring the selection grade upon the petitioners and restraining respondents from inducting the 12 private respondents into KAS without considering the case of the petitioners. The Court after hearing counsel for the petitioner ordered status-quo maintained.

 

Perverted definition of secularism responsible
for KPs’ agony: Jaitly

JAMMU, Dec 27: Maintaining that perverted definition of secularism in India has been a reason for Kashmiri Pandits’ agony and pain, Bharatiya Janata Party (BJP), national general secretary and former Union Law Minister, Arun Jaitly today accused the United Progressive Alliance (UPA) of bringing dead issues to central stage at the cost of those who have actually suffered during the 17 year long terrorism in the State.

Mr Jaitly, who was the chief guest at the "Chetna Divas" function at Abhinav Theatre here this afternoon organized in connection with 17th Remembrance Day of Pt. Prem Nath Bhat, a KP leader and social activist, said this perverted form of secularism in India is focused on to make people sympathetic with Gujarat and reject the cruelties and pain perpetuated on Hindu minorities in Kashmir.

The BJP leader who termed the Article 370, a historical blunder blamed the ideological milieu of that time for incorporating this Article in the Constitution that gave the special status to J&K state.

This Article which was not totally needed is the root cause of all problems as its objective was to create a separate society in Kashmir, he said, adding the KPs have become the victims of this blunder that resulted in conspiracy hatched during 1989 to force their migration from Valley and the Government was caught napping.

Expressing his full solidarity with the Kashmiri Pandits whom he termed the "victims of ethnic cleansing", he said hundreds of members of the community were killed but no FIRs have been registered.

This is called the ethnic cleansing where one community is eliminated on the name of religion. Had this happened in any other country with Christians or Muslims, the world from UNO to BBC and CNN would have made it an issue. But the reasons why the KPs have been neglected here is the result of this perverted definition of secularism in India, he maintained.

The BJP leader said though Pakistan failed to snatch Kashmir during past three conventional wars , it changed its policy and resorted to unconventional type of war in 1989 to succeed in her vicious designs. In this unconventional war it was the community of Kashmiri Pandits which suffered the most, he added.

Earlier BJP state president Ashok Khajuria also paid rich tributes to Prem Nath Bhat whom he termed a voice of oppressed and suppressed people in Kashmir.

Dr R L Bhat on the occassion highlighted the plight of the displaced people.

The function was presided over by V R Wazir, president Jammu Bar Association.

Mr H N Pandita, Trustee of Pt. Prem Nath Bhat Memorial Trust highlighted the contribution of Mr Bhat. On the occasion, two martyrs —Tej Krishen Pandit and Ashok Kumar were felicitated posthumously.

Patwar Association highlights demands

JAMMU, Dec 27: A meeting of All J&K Patwar Association was held under the chairmanship of Shello Ram Manyal, provincial president.

According to a press release, grievances of Patwaries including pay anomalies, enhancement of RS, SK, FTA etc and conducting of DPC of Patwaries were discussed in detail.

The members alleged that besides await for redressal of long pending genuine demands of the Association in the Government, Patwaries have always experience delay tactics by the office of the authorities in Jammu division for issuance of promotion of the Patwaries.

Attempt to grab 40 kanals of land foiled, 3 arrested

JAMMU, Dec 27: Police today foiled an attempt to grab 40 kanals of State and Forest land at Bathindi and arrested three brothers including a Panch.

Police spokesman said that one Anayat Ali approached Bathindi Police and lodged a complaint that some persons including a Panch of Bathindi Panchayat were making attempts to encroach upon 40 kanals of land.

Subsequently, a police party led by Incharge Bathindi Police Post Sub-Inspector Shakti Sharma swung into action and visited the land where a bulldozer was pressed into service by the land grabbers.

The land labelling work was immediately stopped and bulldozer seized. All the three land grabbers and driver of the dozer were also arrested and taken to Bathindi Police Post.

They have been identified as Panch Lal Mohd, Saif Ali and Ghulam Rasool, sons of Rahim Ali of Bathindi and dozer driver Vikram Singh.

A case under Section 447-A RPC was registered against them.

During questioning of the land grabbers, police came to know that they were assigned the task by some influential people, who wanted the accused to grab the land first and sell out the same to them later.

This was further established when several political leaders started ringing up police officers to get the arrested persons released at the earliest.

The land grabbing attempt was foiled under the direct supervision of Sub-Divisional Police Officer (SDPO) East Mamta Sharma and SHO Trikuta Nagar Parshotam Mengi.

JMC to construct 50 Sulabh Shochalyas in Jammu city

JAMMU, Dec 27: Jammu Municipal Corporation (JMC) has decided to construct about 50 Sulabh Shochalyas in different parts of Jammu city for the general public.

This was disclosed in a meeting of the Corporation held under the chairmanship of Mayor Ch Manmohan Singh. It was stated that 25 sites have already been identified and construction work was in progress at 12 sites.

It was stated in the meeting that the projects undertaken by Economic Reconstruction Agency (ERA) for construction, improvement and upgradation of drainage and sewerage system will solve the problem of drainage and sewerage in the areas falling under the jurisdiction of JMC.

The ERA officers said that project of sewerage and drainage improvement in Talab Tillo area was in progress for the last three months and will be completed within two years.

The other projects of sewerage and drainage improvement in area between Akhnoor Road and Janipur Road for rehabilitation and channelisation of existing primary drains and construction of new secondary drains upstream of Akhnoor road will be undertaken within one month.

It was apprised in the meeting that Landoi Choi drain will also be made pucca with side walls and pucca bed having cunnet channel. It will benefit the residents of Trikuta Nagar, Nanak Nagar, Sanjay Nagar, Narwal Pain and Jeevan Nagar and will provide respite from floods during rainy season.

PIL seeking development of Urdu as state language

Jammu, Dec 27: In a Public interest Litigation filed by Shiekh Abdur-Rehman, former MP and one of the members of committee set-up by the Government to make recommendations regarding Urdu as the language of the state, the Division Bench comprising Chief Justice BA Khan and Justice JP Singh after hearing Advocate S H Shah Ashrafi appearing for the PIL and Additional Advocate General BS Salathia appearing for the state directed State Govt through Chief Secretary to ascertain the fact of the committee's recommendations from the concerned quarters.

The Division Bench while Directing the State Govt, observed that respondents have filed objections, but these fall short of requirements because they have maintained curious silence on the fate of recommendations of the committee set-up by the Govt for "development, improvement and popularity of Urdu language" which comprised 21 members. As a matter of fact, petitioner's case is based on the report and it is alleged by him that Urdu language, even though a language of State and judiciary had been neglected and no steps were being taken for its growth and promotion or even its preservation in which context the committee was set-up by the Govt to examine the matter and to make recommendations for discharging constitutional obligation which makes Urdu as the language of the State.

The DB took serious note of the matter and further observed that it is surprising that the committees recommendations should have been put in the archives and no worthwhile steps taken for according due consideration to the same.The court while directing State said that the issue shall be examined within four weeks from receipt of this order and report of the outcome submitted to the Court within two weeks thereafter.

Consolidated 10+2 Lecturers demand regularisation

JAMMU, Dec 27: Demanding their regularisation on the pattern adopted for filling up migrant vacancies in Kashmir, members of All J&K Consolidated Lecturers 10+2 Forum held a demonstration, here today.

Holding banners and shouting slogans in support of their demand, the consolidated Lecturers took out a procession in the city and later submitted a memorandum to the Divisional Commissioner, Jammu.

They were demanding regularisation of the adhoc candidates through an empowerment committee, as was done in Kashmir to fill up the migrant vacancies.

Later, talking to media persons, Arun Bakshi, State president of the Forum, highlighted the grievances and demands of the Consolidated 10+2 lecturers who were engaged under arrangement scheme in higher secondary schools across J&K since 1998.

He lamented that despite issuance of a Government order vide number 1301, dated 31-7-03, according to which the adhoc lecturers were to be regularised after three years of their service, regularisation did not take place. "A number of engaged lecturers have completed three years in service and many of them are on the verge of getting overaged but the Government is not taking any action in this regard," Mr Bakshi said.

However, he added, on the other hand, some lecturers working on adhoc arrangement, were regularised against migrant vacancies by constituting an empowerment committee. "If the candidates in Kashmir can be regularised this way, why can’t we be selected who have been serving the education department for such a long time," he asked and also added that if teachers can be adjusted on ReT pattern, why not lecturers since both these schemes are the central aided.

The Forum leaders also reminded about the increased number of vacancies of lecturers in the wake of upgradation of various high schools into higher secondaries and appealed the Government to implement order number 1301 dated 31-07-06.

 

Cong to celebrate 121st foundation day today

JAMMU, Dec 27: In connection with the 121st foundation day of the party, Pradesh Congress Committee (PCC) is going to organise many programmes on December 28, 2006.

Talking to reporters, PCC chief Peerzada Mohammed Sayed said that like other parts of the country, flag hoisting ceremony will be held at Congress headquarters at Sheedhi Chowk on 11.30 am. After the flag hoisting ceremony, a rally will be organised in the city.

Mr Sayed said that the rally will start from PCC headquarters and will pass through different bazaars of the city including Residency Road, Raghunath Bazar, Purani Mandi, Rajinder Bazar and will later return to party headquarters.

The PCC chief informed that Chief Minister, Ghulam Nabi Azad and all senior leaders of the party will also participate in the foundation day celebrations. He said that Chief Minister will also address Congress workers at party headquarters.

Mr Sayed said that besides celebrations at party headquarters, functions will also be held at block level. "All Congress leaders have been asked to celebrate foundation day and involve people in the celebrations", he informed.

Meanwhile a meeting of the senior Congress leaders was held this evening to review functioning of the foundation day celebrations. All arrangements were reviewed in the meeting.

Rs 88 lakh approved under DRDA for Rajouri

RAJOURI, Dec 27: Rs.88.58 lakh have been approved at joint meeting of Bankes, sponsoring agencies and public representatives here today under the chairmanship of District Development Commissioner Rajouri Parvez Malik. The meeting was convened to review the financial and physical achievements of last financial year.

MLAs from Kalakote, Rajouri and Drahal Rashpal Singh, Th. Puran Singh, Mohd Aslam Khan and Vice Chairman Pari Advisory Board Mohd Shabir Khan were present in the meeting.

The meeting was also attended by Additional District Development Commissioner Rajouri K K Khajuria who is also chairman DRDA Rajouri and Chief Planning Officer.

While projecting the annual action plan, Project Officer R A Choudhary informed the meeting that out of the total amount of Rs.88.58 lakh proposed to be spent under Swaranjayanti Gram Swarozgar Yojna (SGSY) Rs.55.84 lakh are as central share for the current financial year, Rs.23.40 lakh as State share besides Rs.9.34 lakh on spent balance of last financial year. Of the total Rs.33.15 lakh will be utilized for providing subsidy to economic activities, Rs.298.70 lakh as credit mobilization to 620 Swrogaries will be provided by various bankers in the district.

The meeting was further apprised that Rs.77.71 lakh will be utilized on SGSY infrastructures including units relating to lives stock, Rs.8.92 lakh on training and Rs.8.80 lakh has been proposed for 88 Self Help Group (SHG) for which Rs.13.20 lakh as credit mobilization by various banks. In additional, 620 swarozgaries will also be assisted for establishing their own macro enterprises. Moreover, 465 swarozgaries will be assisted in cluster, SHGs and 155 under individual activities.

Make Kashmir centric parleys of Nehru,
Sheikh, Ayub public:Hakeem

JAMMU, Dec 27: Chairman PDF and Transport Minister Hakeem Mohd Yaseen has urged for making the Kashmir centric parleys of Late Sheikh Mohd Abdullah. Pt. Jawhar Lal Nehru and President Ayub Khan as public.

He said that all documents, letters and correspondence that took place between the trio leadership should be made basis for carrying forward the settlement of all issues relating to Jammu and Kashmir.

In a statement, PDF chief said that many formulae are being circulated with regard to Jammu Kashmir political scenario and settlement of issue without taking care of people’s aspiration and root cause of confrontation. He said time is ripe enough that people should know the details of the parleys that had taken place between Sheikh Mohammad Abdullah, Pt. Jawahar Lal Nehru and Gen. Ayub Khan adding that much headway during those days had been achieved in relation to the settlement of all issues regarding Jammu and Kashmir.

He said people presently wish to know the canvas of those parleys and proposals discussed between the three leaders and added that this document could prove highly significant in addressing the issues in its right perspective at present.

Mr Yasin underlining the importance of peace and tranquility for progress and prosperity of the State, country and the sub-continent said that cultivation of lasting peace should be the ultimate goal of all leadership collectively. He said before introducing formulae and strategies one should first know the grounds on which three leaders Pt. Nehru, Gen. Ayub and Sheikh Mohammad Abdullah had agreed to work on.

He asked for whole hearted cooperation and support from one and all rising above party politics and other considerations to seek lasting peace in Jammu and Kashmir.

 
 

Women wing of NC holds protest dharna against price rise

JAMMU, Dec 27: To lodge protest against price rise, women wing of National Conference organised a rally in the city. The protest demonstration started from Sher-e-Kashmir Bhawan and culminated at City Chowk where it was turned into a dharna.

While addressing the dharna, former MLA and provincial president of the women wing of NC, Bimla Luthra condemned both State and Central governments for their failure to contain prices of essential commodities. She said that during the last two years there was unprecedented hike in the prices of the essential commodities and those at the helm of the affairs seemed to be unconcerned.

She further alleged that both the governments have been serving interests of the big businessmen and common masses have been finding it difficult.

Another women wing leader, Veena Oberai, while addressing the dharna, said that it was high time for womenfolk to come on street to oppose anti-poor policies of both State and Central governments. She said that due to unprecedented hike in the prices of essential commodities, poor and lower middle class people have been bearing maximum brunt.

Roshni Act draconian, against POK refugees: RUF

JAMMU, Dec 27: Criticising the State Government for enforcing Roshni Act and sending notices to POK refugees in Jammu, Refugees United Front (RUF) has alleged that the Act was draconian and against the interests of the refugees of Pak Occupied Kashmir who still await final settlement.

Addressing a press conference here today, Rajiv Chuni president of the Front took serious note of the attitude of State Revenue authorities who have started sending notices to the POK refugee allottees to implement Roshni Act in the State. He pointed out that instead of sending notices to the land grabbers and land mafia people, the Revenue authorities at the helm of affairs, have started sending notices to the allottees of the POK refugees residing in Poonch, Jammu, Kathua, R S Pura, Akhnoor, Khour, Bishnah, Hiranagar and other places of Jammu region.

The refugee leader alleged that Roshni Act was an off-shoot of the policy of the J&K Government of 1948 by which no refugee from POK, West Pakistan or Chhamb was to be settled in J&K State. He said all the refugees organisations have resolved to oppose this law tooth and nail.

He disclosed that on January 8, Refugees will hold protest demonstration at Jammu and also at various district headquarters. The refugees also plan to throng J&K Legislature during forthcoming session if the decision was not reviewed by the Government.

State Unit president of Shiv Sena (Bal Thakrey) Anan Sharma while speaking on the occasion assured full support to the Refugees and said that Sena will strongly oppose the move and not allow the Government to do injustice with the refugees.

State general secretary Labba Ram Gandhi also spoke on the occasion. Others present in the conference include-Y R Gupta, Dr Gurmeet Singh, Sohan Singh, Harjeet Singh, Dr Gurvinder Singh, Om Parkash, Jaggu Ram, Lalit Kumar, R K Kohli and Mohan Lal.

JAMMU, Dec 27: A meeting of National Conference block Jammu East was held today at Gujjar Nagar under the chairmanship of Ayub Malik, block president. Rakesh Sethi, block president Jammu East, YNC was also present in the meeting.

According to a press release, in the meeting block committee for Youth National Conference was announced for ward number 6 by Ayub Malik.

He said that the Chief Minister Ghulam Nabi Azad has personally taken initiative in this direction to upgrade the sector with latest equipments and necessary infrastructure so that youth of the State would be able to obtain necessary training in the State colleges rather to move outside for the same. He said the recent shifting of engineering campus to new complex is timely step in this regard which shows itself how the present Government is sincere to its commitments.

Saying that in the contemporary world Information Technology rules the roost the Minister stressed the student community to abreast themselves with latest and innovative trends in Information Technology.

Gujjar-Bakerwal demand political reservation

POONCH, Dec 27: Gujjars and Bakerwals have demanded political reservation and creation of separate Tribal Ministry in the State.

Addressing members of the community at one-day convention held here today, Ch Mohd Yunis Chouhan, president of the organisation urged upon the Government to provide political reservation to the members of this community. He also demanded separate Tribal Ministry, inclusion of Gojri in 8th Schedule of the Indian Constitution, creation of separate Tribal Directorate, starting news bulletin in Gojri language from All India Radio and Doordarshan and releasing special package for educated unemployed youth of the community.

This convention had been organised by Jammu and Kashmir Gujjar-Bakerwal Welfare Organisation. A large number of people from the community from the district participated in the program. The speakers in the convention welcomed the opening of Poonch-Rawalakot road and strongly condemned violence which has not only destroyed peace but also damaged the social fabric here. They also demanded special recruitment drive for Gujjar-Bakerwal youth in Police, CRPF, BSF, ITBP and Army.

Others who spoke on the occasion include-Mohd Sadiq, Al Haq, Ch Abdul Ghani, Ghulam Mohd, Mohd Sabir, Mohd Din, Shabir- ul- Hassan, Mohd Sharief, Fazal Badana and Mohd Khaliq.

Kashmiri Pandits to launch Political Party

Kolkata, Dec 27: The three days Global Conference of Kashmiri Pandits which concluded here today resolved to launch a Political Party to take on the vexed issues confronting the community ever since it was displaced from the valley in 1990.

The need to float the party was felt by one and all as no national political party has shown its firm will to deal with this peculiar problem where 7,00,000 displaced people are living as refugees in their own country with no possibility of return in sight. AIKS writ petition is already in the Supreme Court to seek justice for the beleaguered community of which has issued notices to State and Central Government to file their responses within 4 weeks last month.

The leaders gave mandate to AIKS leadership led by Mr M.K.Kaw to take immediate steps to give a concrete shape to the political party. Once the steering committee appointed today by AIKS will give its report ( within one month) the party will be registered with Election Commission of India, followed by a political convention to be held at Jammu. Date and venue of convention will be announced separately, said an AIKS handout issued here today.

The party will work on the broader ideologies of AIKS. The conference decided to intensify the National Awareness Campaign to apprise the countrymen in every nook and corner of world the dangers posed by Jehadi terrorism to the unity and integrity of India.

On the issues of Autonomy, Self Rule or Trifurcation of the State, the AIKS has opposed tooth and nail all the three concepts as they are inimical and dangerous for the unity and Integrity of India. AIKS declared that while Autonomy and Self Rule were not acceptable at all, any plans of Trifurcation will be considered only if Kashmiri Pandits are given its due share.

The conference attended by delegates from different parts of the country and abroad sought involvement of Kashmiri Pandit refugees in the ongoing dialogue process. The conference resolved that whole of Kashmir belongs to them and any attempt to divide the motherland in the name of caste, religion and region will be opposed tooth and nail. it said they will return only when the conditions are conducive and entire infrastructure of terror is demolished.

With this the three days conclave of Kashmiri Pandits organized to mark the Golden Jubilee of Kolkata Sabha and Silver Jubilee of AIKS came to a close.

Tide Water Oil Ltd organises mechanics’ meet

JAMMU, Dec 27: Tide Water Oil Company (India) Ltd, manufacturers of Veedol lubricants, organised mechanics’ contact programme here today.

The meet was a part of sales promotion programme of the Company. Ashish Mishra, Territory Sales incharge of the Company in Jammu educated the automobiles- mechanics about the oil quality and oil usage and said that company was committed to come out with the products having longer life and service. He explained that products were better and provide full protection, security and required lubrication to the machinery and its vital parts.

Engineering students protest against faulty marking

JAMMU, Dec 27: Demanding re-evaluation of their answer scripts, the aggrieved students of Engineering, who have been awarded zero marks in two papers of the Computer subject, held a day-long protest against faulty marking in Jammu University.

Shouting slogans in support of their demand and also seeking action against the erring evaluators, the protesting students remained in front of the Controller examination office till they were telephonically assured by Vice-Chancellor Prof Amitabh Mattoo to personally look into the matter and take a decision by tomorrow.

It may be mentioned here that all the students of three Colleges of Engineering, affiliated to JU, have been awarded zero marks in two papers of Computer subject in VIth semester, result of which was declared recently.

Led by Students Socialist Federation president Rajinder Singh Jogi, the aggrieved students, including girls, assembled in front of the office of Controller Examination and held a strong demonstration.

As the Controller, Prof Lokesh Verma, assured the students to take up a decision by 4 pm today after discussing the matter with experts, the aggrieved students preferred to remain on the campus and wait for the report.

Later, Prof Verma informed that the expert would submit his report tomorrow following which the protest was suspended and the students dispersed off.

HC criticises Centre for failure to assess flood damage

SRINAGAR, Dec 27: The State High Court has come down heavily on the Union Government for not assessing the damage suffered to the Composite Regional Centre, set up for the handicapped people, here due to floods and directed it to depute within one week a team of senior officials in this regard.

A division bench, comprising Chief Justice Bashir Ahmed Khan and Justice Bashir Ahmed Kirmani, said it was surprising that the Union Ministry concerned did not so far assess the damage suffered by the Centre due to floods in Kashmir in June-July this year.

The court directed secretary to Union Ministry of Social Justice and Empowerment to depute within one week a team of senior officials on receipt of the order to survey and assess the damage suffered by the Centre due to floods and to repair it within two months after the report was submitted to him.

The Secretary should take all the necessary steps to restore the Composite Regional Centre and provide the requisite grants for its infrastructure, the bench said and directed him to submit a detailed report to the court on the next date of hearing.

The court said the appalling condition of the Centre, set up to provide trained manpower for development of and attending to the problems of the physically handicapped people, was not being dealt with by the social justice ministry.

"The only possible view to be taken in the matter is that the centre is existing only in name and not run on the expected lines and in consonance with the objectives for which created."

The court also said it had no clue about the action plan which the Social Welfare Department Secretary claimed to have formulated at the State Level Coordination Committee meeting.

He was directed to submit the plan to the court and show the methodology for its implementation along with the agencies involved in doing so besides indicating the target fixed for that.

The bench also said it was not known if the Government had incorporated any provision of reservation for physically challenged-handicapped people in services and educational institutions.

In case it had not been done so far, the court said the Government should examine the issues relating to reservations and grant of concessions in fee and other charges for public facilities.

The bench directed the Government to incorporate its decisions in the new policy or legislation, which was stated to be in the process of being amended. (UNI)

ZSWO provides relief to ex-servicemen, widows

JAMMU, Dec 27: Lt Col Karan Singh, Zila Sainik Welfare Officer, Jammu, visited tehsil Bishnah alongwith his staff to attend to the problems of ex-servicemen, widows and war widows and their dependents.

Col Singh apprised the gathering about the welfare measures being extended to them for their welfare through different schemes. He handed over a cheque for Rs 30,000 to Bansi Lal, Father of Late Rfn Pawan Kumar, cash relief of Rs 5000 to Mrs Sakundla Devi, widow of late Sepoy Gurdip Singh as daughter’s marriage relief.

Cash amount of Rs 1000 each was handed over to Mrs Swarna Devi widow of Hav Rattan Lal, Mrs Champa devi, widow of L/Nk Om Parkash and Mrs Gian Devi, widow of Sep Dev Raj as financial relief. Two sewing machines were provided to Mrs Neelam Kumari, widow of Nk Sat Pal and Mrs Krishna Rani, widow of Hav Gopal Krishan.

All routine documentation work like issue and renewal of Identity Cards, completion of different types of relief forms were done on the spot.
