NOTICE

It has been observed that despite repeated instructions issued earlier through notices in the leading news papers and the media for general information of the public that some private Educational agencies are still imparting Education for courses beyond 10+2 level and are not affiliated to any University in J&K State, such study centers/franchises are admitting students on their own & continue to run unauthorisedly. The University of Jammu has also already issued notification in compliance to the University Grants Commission directions that no University should be premitted to go for off campus study centers. The department of Higher Education J&K is also receiving some complaints about the functioning of these study centers/franchises and taking huge amount from the students.

Further, these franchisee are running in contravention of the Jammu and Kashmir Private Colleges (Regulation and Control) Act. 2002 and the SRO-339 dated 20-12-2005 and are liable for penal action.

Since these institutions are unauthorized and are liable to face legal action under the provisions of The Jammu and Kashmir Private Colleges (Regulation and Control) Act. 2002 and the rules notified under SRO-339 of 2005 dated 20-12-2005 and the validity of the courses offered by them for securing attractive jobs is in doubt, students are advised in their own interest to ensure that the private institutions in which they seek admission are authorized and affiliated to the University of Jammu Kashmir/IGNOU or have obtained accreditation from DOEACC Society, New Delhi and also sought permission from the Government.

General public is accordingly advised to be careful in the matter so that they are not carried away by the misleading advertisements issued by any un-authorised institutions/study centres etc through the Local Daily News papers/media etc.

Whereas, use of public streets, roads & footpaths for dumping of building materials, mulba & other articles for sale, construction or otherwise within the Jammu Municipal limits is an offence under the provisions of J&K Municipal Corporation Act, 2000.

These acts cause inconvenience, nuisance to public at large and also damage public property.

Now therefore, in exercise of the powers conferred upon me under the J&K Municipal Corporation Act, 2000, I hereby require all to remove all types of construction materials/other articles dumped on public streets/roads & footpaths within a period of 7 days from the publication of this notice, failing which same shall be removed by the JMC at his/her risk and cost. In the case of mulba/waste materials and other articles, if removed by the Corporation, charges @ times of the actual expenditure (in lifting and transportation) shall be recovered from the defaulter/s.

It is Notified for the information of all the concerned that the students who are more than 40% Physically disabled (Deafness, Dumbness, Blindness, Lower Vision, Leprosy Cured, Hearing Impairment, Loco-motor disability, Mental retardation, & Mental Illness and the like) of permanent nature, of Secondary School Examination (Class 10th) & higher Secondary Part -II (Class 12th) have to pass the examination if he/she secures, atleast only 28% marks instead of 33% in Secondary School Examination and 31% marks instead of 36% in case of Higher Secondary Part - II Examination in each of the five subjects save in English, where only 28% marks are required to pass. Where-ever practical examination is involved. This percentage of 28% and 31% shall be required by a candidate in theory and practical examination separately.

This Regulation is in addition to chapter X (Examination General) 17, (iii) and 24, (i). It is also mentioned here that physically disabled candidates have to produce a certificate from District Medical Board (Competent Authority appointed by Directorate of Health Services Kashmir/Jammu) or documentary proof from Department of Social Welfare J&K in support of their claim.

Moreover, no Examination fee/other fees shall be charged in cases of Disabled students (Deafness, Dumbness, Blindness, Lower Vision, Leprosy Cured, Hearing Impairment, Loco-motor disability, Mental retardation & Mental Illness) who are more than 50% Physical handicapped of permanent nature.

Application on prescribed proforma for grant of scholarship for Post Matric Level courses are invited from the students belonging to SC/ST/OBC and physically Handicapped categories studying outside and within State of J&K. The scholarship includes tuition fee and all compulsory non-refundable fee paid by the students studying in Govt. or private Institutions recognized by the Govt/UGC/Board of Technical Education as per fee structure approved by Govt. Besides maintenance allowance is also admissible under rule. The application forms should be accompanied with the certificates mentioned hereunder duly recommended by the Heads of concerned institutions and forwarded through the concerned District Social Welfare Officers.

c) Parents/Guardian Income Certificate from concerned Tehsildar in case of students whose parents guardian are non Govt. employees. In case of employed parents/guardians salary certificate issued by the concerned Drawing & Disbursing Officer is required along with affidavit that the income from all sources does not exceed the prescribed limit, which is as under:-

1. For SC students Rs. 1.00 lakh per annum.

2. For ST students Rs. 65,290/- per annum.

3. For OBC/Physically Handicapped students Rs. 44,500/- per annum.

d) Marks certificate (duly attested by a gazetted officer) for the last three years examination passed.

e) Bonafide certificate of the concerned institution.

f) Passport size photographs to be pasted on application forms.

g) Receipt of fee of the concerned course.

h) Promotion certificate in case the student has passed the previous examination for which scholarship already received.

i) Hostel certificate (in case the applicant desires to avail the Hostel facility).

j) The scholarship to the students of private institutions is admissible only to the institutions affiliated with the universities recognized by the Govt./UGC/Board of Technical Education.

k) Utilization certificate of previous amount of scholarship.

Social Welfare Officers in case of students studying within the State and Directorate of Social Welfare Jammu in case of students studying outside the State by or before 30th of November 2006.
