Azad completes one month in office

JAMMU, Dec 2: One month is too short a period to gauge the merits of activities of any Government, however, Mr. Ghulam Nabi Azad’s one month in office speaks volumes of the vision he has conceived for the development, progress and prosperity of the three regions of Jammu and Kashmir.

From the day first, Mr. Azad presented the blue print of his vision for good governance wherein emphasis is on establishment of corruption free responsive administration, enriching work culture, clearly reflects that Chief Minister means business. His decisions for introducing reforms in administration and putting a hold on malpractices in public offices are hallmarks of his style of working that speaks loud and clear that he believes in deeds rather than words.

During a short period of 30 days when the priority of the government was quake relief centric and Chief Minister himself supervising day-to-day relief, rehabilitation and re-construction operations of quake affected areas, there is still a lot which could help to scroll through the road map Mr. Azad has sketched for good governance and khushali.

The Dynamism and leadership qualities of Mr. Azad are evident from the fact that he fixed 15th of December as dead line for completing construction of temporary shelters for quake victims and made it happen, as by now 75 percent of the work exists on the ground.

To crush nepotism and favouritism, he issued directions to all administrative heads and heads of departments that if any of his relative calls on them for any favour or makes recommendations for some one else, they should then and there inform him. This sent clear signals to all to follow the suit. He also asked the Ministers not to post any relative in their personal sections, an act often being questioned.

What a Chief Minister Mr. Azad is - before issuing directions for enhancing the working hours in all the government departments - he himself started working 18 hours a day thus conveying the message that "charity begins at home".

The Chief Minister declared that before revamping the work culture in all the departments directly linked with public welfare and initiating reforms for making them more responsive and accountable, he will first review their present functioning on one by one basis.

The Chief Minister’s directions to speed up the work on inter-regional and inter-district roads like alternate National Highway Srinagar-Jammu Mughal Road, Kishtwar-Simthan-Anantnag, Leh-Himachal Pradesh, Srinagar-Baramulla-Uri, Salamabad-Kaman Post, Narbal-Tangmarg, Khannabal-Pahalgam, Lakhanpur-Jammu and other such roads speaks of his concern for economic development of the State.

Mr. Azad’s directions for providing adequate protected water to entire state within next two years; bringing entire rural population under the ambit of modern health care facilities, revamping social welfare department to percolate its benefits to the poor and needy easily and management of its affairs in a transparent manner, launching of such a comprehensive planning for development that each district, tehsil, village and even pati and hamlet gets its due share and receives equal fillip for development are some of the many aspects of his policy conceived for prosperous Jammu and Kashmir.

To sum up, Mr. Azad’s vision for Khushal Jammu, Kashmir and Ladakh has started emanating rays of hope on State’s horizon.

HC quashes posting of Principal AMT School

JAMMU, Dec 2: The State High Court has quashed the posting of Dr Madhu Khullar as Principal AMT School Bakshi Nagar, as she was not qualified to hold this post

While allowing the petition filed by Mrs Shakuntala Sharma, Justice RC Gandhi of the State High Court held that the respondent should post a person who is eligible to hold the post possessing the requisite qualification and should not break rules. " Once rules are framed to govern the service, it is the duty of the employer to take action in accordance with the rules. In the present case, rules have been broken to accommodate Dr Khullar, who otherwise has no right or claim against a post of the Department of Medical Education of which Dr Khullar is not a member", Justice Gandhi held.

In her petition, Mrs Shakuntala Sharma, while seeking quashment of Dr Madhu Khullar’s posting, mentioned that the latter doesn’t possess the requisite eligibility qualification as prescribed by the rules to hold the post of Principal AMT College.

It was stated that Dr Madhu Khullar is an Assistant Surgeon borne on the service of Health Department and not a member of Medical Education Department, while’s the post belongs to Medical Education Department.

The Court held that the rules prescribe that a candidate must possess Masters Degree in Nursing and 10 years experience in teaching in a school/College of Nursing. In this case, Dr Madhu Khullar didn’t possess the requisite qualification. If a person who doesn’t possess requisite qualification, cannot be permitted to be appointed de hors the rules, Justice Gandhi held.

The Court, however, directed that the State-respondent is at liberty to transfer the petitioner ( Mrs Shakuntala Sharma) wherever they feel suitable in the interest of the administration. Mrs Sharma, it may be mentioned here, was removed from the post of Principal ATM and posted at an insignificant place only to accommodate Dr Madhu Khullar in October last year.

Mahamaya hills to be developed as
"Jammu Jangal Resort"

Jammu, Dec 2 : State Government is actively considering to develop Mahamaya terrain situated across the river Tawi along the historic Bahu Fort endowed with natural beauty, as " Jammu Jangal Resort". Government would also take necessary steps to create required infrastructure for the development of proposed resort, which has a tremendous tourist potential.

This was announced by the Minister for Forests and Housing Tariq Hameed Qarra today during his extensive visit of the area to explore possibilities for the development of the area spread over 355 hectares, as Jangal resort.

Besides, Chief Conservator of Forests Jammu Molvi Shafat Ahmed, senior officers accompanied the Minister.

The Minister said that a comprehensive project would be formulated to create necessary infrastructure for the development of the area so that local as well as the tourists from other parts of the country and abroad can visits the resort throughout the year. He said the resort will also facilitate the Vashno Devi pilgrims besides easing the tourist rush on neighboring Bahu-Fort.

Forest Minister said that keeping in view the expansion of the greater Jammu and the need of Jammuties, Government intends to develop Mahamaya site as a tourist resort of national status. He said the step would also provide Job-opportunities to the people besides supplementing the socio-economic development of the state. The Minister said that the existing structure of cafeteria, rest house and view points in the area would be re-located and constructed at the pattern of Glulmarg tourist spot to preserve environment and ecology too, while as the 7 Kms long existing track would be improved to connect the whole area of this site adding that parks would be developed in the plain areas where round the year growing flowers would be cultivated.

Mr. Qarra directed the concerned officers to prepare the draft of the proposed plan for the development of the area and asked to incorporate the facilities like parking lots and latest light system in the plan.

The Minister went round the terrains by foot and took stock of various spots, which could be developed as tourist places.

JAMMU, Dec 2: Chairman State Legislative Council, Abdul Rashid Dar has stressed the need of population control, sincere efforts from the Government and other agencies and awareness among the people in general to keep a check on the increasing problem of pollution on the earth.

Mr Dar, who was the chief guest at a function organised in connection with the National Pollution Control Day by ICELA & Friends Club-India here this evening said that God has created this beautiful world and gave us the varied nature but the selfish and greedy human being made it a hell. Its natural wealth was exploited to the extent that it started showing its effects on the earth.

Worst is the condition of our rivers, forests are turning barren and natural resources are nearing extinction. There is an urgent need of giving a serious though towards the problem otherwise the coming generations will perish. He said it is the prime responsibility of the Government and even other organisations to pay much attention towards this problem. Appreciating the initiative taken by the ICELA president Ashok Sharma (MLC) and his team in organising the function Mr Dar assured to constitute a committee of the legislators on environment to give its recommendations for the welfare of the people of this State.

This way it would get adequate funding from the Central Government and international donar agencies. Major projects could be taken up for environment protection and conservation. Deputy Mayor Jammu Municipal Corporation, Rani Gargi Bleoria said that it was the collective responsibility of every citizen to contribute towards keeping check on pollution and keeping surroundings and the city clean. She further said that political compulsions sometimes become headache to keep a check on the problem but one has to rise above these compulsion.

PHE employees observe black day, dharna enters 11th day

JAMMU, Dec 2: On 11th day of their ongoing dharna in the premises of Chief Engineer’s office, members of Water Works (PHE) Employees Association today observed ‘black day’ by wearing black badges.

The agitating employees raised slogans against the PHE authorities for not considering their genuine demands which include regularisation of daily wagers, amendment in SRO 380, change of designation as per nature of job, filling up of vacant posts, holding of DPC etc.

Speaking on the occasion, State INTUC president Shiv Kumar Sharma lamented that PHE daily wagers were without pay for the last eight to 20 months and the PHE authorities were still insensitive towards their plights.

Mr Sharma also highlighted other demands of the PHE employees and said that engaging the unemployed youth on mere Rs 200 to Rs 1800 per month by the previous Government was in violation of Labour Act.

Others who addressed the dharna, included Om Parkash, Thoru Ram, Vinod Kumar, Vijay Kumar, Anchal Singh, Gian Chand, Bhader Singh, Bhagwan Dass, Parshotam Lal, Amreek Singh, Ajay Sharma, Sat Paul Singh, Bishmaber Nath and others.

They appealed to the PHE employees to remain united in their fight for the demands. They also warned the PHE authorities to either consider their demands or face direct action.

JAMMU, Dec 2: The participants of ongoing North Zone Youth Festival at Jammu University had an interaction with Chief Minister Ghulam Nabi Azad who visited the JU campus today.

Recalling his student days, Mr Azad said that right from his school days to the University, he had been taking keen interest in extra-curricular activities which are catalyst for all round personality development.

On the occasion, Mr Azad also released a 16-minute documentary titled ‘Search for Tomorrow’ detailing the present status of academics and extra-curricular activities, faculty status as well as infrastructure and future vision of the Jammu University.

The students presented a copy of newsletter ‘Umang’ , brought out on the occasion of Youth Festival, to the Chief Minister.

Meanwhile, on third day of the ‘Umang’, eight events of different categories were held. These include ‘One Act Play’, ‘Classical Instrument Solo’, ‘Poster Making’, ‘Folk Dances’, ‘Light Vocal’ (Solo), ‘Clay Modelling’, ‘Mimicry’ and Cultural programme.

The day started with Poster Making competition and topics for event were ‘Stop AIDS’, ‘Do not touch abandoned items, it can be a bomb’ and ‘Girl Child’.

Six more teams today performed in the One Act play competition which was being organised at the Abhinav Theatre.

In Classical instrumental solo (non-Percussion), six team from different universities participated.

The folk dances at Abhinab Theatre by the participants from different universities, enthralled the audience at Abhinav Theatre. Through the folk dances, the students presented local culture of different States and mesmerized with their performance.

Two motor-cycle lifters held in Gandhi Nagar

JAMMU, Dec 2: Gandhi Nagar police today arrested two motor-cycle lifters within a couple of hours after they lifted a CBZ motor bike from Gole Market this afternoon.

The motor-cycle lifters have been identified as Mintu Sharma son of Mulkh Raj Sharma R/o Sector No. 1 Trikuta Nagar and Sumit Sharma son of Chander Prakash Sharma R/o Airport Road.

Both the accused were students of 12th class in SRML Higher Secondary School Jammu.

The duo lifted CBZ motor-cycle of Anil Goswami R/o Shaheedhi Chowk from Gole Market at 1 pm and straightway took it to a workshop for modification.

On a tip off, a Gandhi Nagar police station party led by SHO Inspector Diwakar Singh raided the workshop, recovered the motor-cycle and arrested both the accused.

They were shifted to Gandhi Nagar police station where a case has been registered against them. Their questioning was expected to lead to more recoveries of stolen motor-cycles and scooters.

The recovered motor-cycle is being restored to the owner.

Police said the theft case was worked out within a couple of hours.

BSP demands CBI probe into mysterious death of youth

JAMMU, Dec 2: Accusing the Police and other investigative agencies of falsely implicating a Dalit family in mysterious death of a youth in village Patyari, Hiranagar, on June 23, 2003, State unit of Bahujan Samaj Party had demanded a CBI probe into the death.

Talking to media persons, here today, State BSP president Dr Sat Pal alleged that the local police and other investigative agencies were falsely implicating Des Raj and his family in the murder of one Roshan Lal.

Narrating the whole incident and the circumstances under which Roshan Lal had died, the BSP leader claimed that the deceased was never beaten up by Des Raj.

It may be mentioned here that Hiranagar police has registered a murder case against Des Raj and his wife for allegedly beating up Roshan Lal who died the very next day.

" During examination by the doctors, it was established that the youth had consumed poison and it was a clear case of suicide but the police is now making it a case of murder without any solid ground," he said and produced the medical reports which mention that there was only one injury on left side of Roshan Lal’s face during his medical examination on June 23 at the time of his admission in the Hiranagar Hospital.

Further, the BSP leader added, the police never tried to find out truth behind the suicide note which also proved to be fake one by the forensic experts.

Listing all the reasons as a proof the innocence of Des Raj and his family in mysterious death of Roshan Lal, the BSP leader demanded CBI probe into the death so that truth can be established.

CM asks BSNL to improve telecom service

JAMMU, Dec 2: Chief Minister Ghulam Nabi Azad has impressed upon the BSNL authorities to further improve the telecommunication services in Jammu and Kashmir to make it consumer-friendly.

The Chief Minister was interacting with Chief General Manager, BSNL, J&K, K. C. Jindal who alongwith General Manager, BSNL Jammu, R. K. Koul called on him here today and apprised about the status of telecommunication network in the State and its further expansion plan.

The Chief Minister appreciated the expansion programme of the BSNL in the State and said that mobile service has also proved quite helpful. He also lauded the scheme launched by the BSNL for the Government employees to convert their existing plans of post-paid mobile connections to Rs 100 plan.

Mr Azad enquired about district-wise status of the telecommunication facilities and stressed for expanding these further to cover all the areas.

Mr Jindal apprised the Chief Minister that in all the earthquake affected areas of Uri and Tangdhar, telecommunication network has been restored and plans have been formulated to improve it further in next six months.

Regarding mobile phone service, Mr Jindal informed the Chief Minister that by March next, 50 percent villages in the State would be covered. He said 1.50 lakh new mobile phone connections, 75000 each in Kashmir and Jammu divisions, would be provided in the State within next four months crossing the figure of five lakh by March next. He said that about 30000 more connections on CDMA WLL will be released this year to cover the difficult areas where landline facility is not possible yet.

The Chief General Manager said that the BSNL has made latest telecommunication technology available in Jammu and Kashmir to improve reach and quality of the services.

Truckers disrupt traffic on highway at Hatli Morh

KATHUA, Dec 2: Traffic on Jammu-Pathankote National Highway remained disrupted for about two hours as truckers staged a protest demonstration near Hatli Morh.

The truckers were protesting, what they alleged, against high handedness of the Traffic Department. The dharna was lifted following intervention of the senior police officers and members of the Truck Owner Union.

Reports said that officers of the Traffic Department were conducting checking of vehicles on national highway. During the checking officials also removed pressure horns from various vehicles. This act of the officials irked drivers, who resorted to shouting slogans against the officials. They parked their vehicles in between the national highway resulted into blockade of the road.

The protest continued for about two hours and large number of vehicles were stranded on the road. Senior police and civil officers rushed to the spot and pacified the drivers. Office bearers of the Truck Owner Union also rushed to the spot and intervened in the matter. Following intervention of the senior officers, truckers lifted the dharna.

 

Training programme on ethical issues in
administration organised

JAMMU, Dec 2: A 5-day training programme on "ethical issues in administration" sponsored by Ministry of personnel, public grievances and pensions, Government of India was organized by J&K IMPA Jammu under the course directorship of Prof Indu Aima.

The training programme was attended by 11 senior officers in the rank of Special Secretaries of J&K Government.

Director General IMPA S. Maria Desalphine delivered the valedictory address and distributed certificates among the officer trainees. Mr Maria spoke about adopting a positive approach while performing duties and reminds them that whatever action they take would definitely have some impact on the overall development of the state and the country as a whole.

Prof Indu Aima stated that the training package was focus on various ethical issues, which were debated and discussed so that a fresh understanding and insights could be developed for better and transparent governance.

Eminent Guest speakers like Dr Ashok Bhan, Justice (Retd) O. P Sharma, Mr Manoj K Dwivedi, Prof Rekha Choudhary, Prof S. K Sharma, Prof S. R Khan and Prof Ashok Aima interacted with the senior officers of state.

JAMMU, Dec 2: Officiating Inspector General (IG), Border Security Force (BSF), Jammu Frontier, G S Virk today appealed the people to come forward for noble cause of donating blood and save precious human lives.

Talking to mediapersons after inaugurating the Blood donation camp organized by the BSF at its Paloura Hospital in connection with celebration of 40th Raising Day, Mr Virk said that people should volunteer themselves for blood donation after taking a cue from BSF officers and jawans who are always ready for this noble cause.

On the occasion, Dr Kum Kum Sharma, HoD Blood Transfusion Department, Government Medical College (GMC) Jammu and Dr D KSharma, CMO BSF, Hospitals Jammu were also present.

On the occasion 50 officers and jawans of BSF donated blood. Commandant Communications Mohinder Singh was among the prominent officers who donated blood in today’s camp.

Congratulating the BSF officers and jawans for organizing the blood donation camp, Dr Kum Kum Sharma said BSF really deserves praises as besides the national security it pays attention for the needy patients.

She said the motivation of people is needed for donation of blood as out of five liters of blood which every healthy human body has, only three and half liters are needed by the body while the rest one and half liter gets exhausted after 120 days. Instead of letting this blood to get waste the people should donate it for noble cause,she added.

She said under the Blood Insurance Scheme the close kith and kin of a donor will be provided blood by any blood bank in the country without exchange. The donors will be issued registration cards for this and this cards will be renewed every year, she added.

Gujjar Bakerwal Joint Forum criticises "vested interests"

JAMMU, Dec 2: The state president, Gujjar Bakerwal Joint Forum, Haji Shamsher Ali Boken at a meeting criticised the " vested interest trying to dilute the Tribal character of various communities and ride upon the established proceedures and set practices to tribal status".

The forum, in a press statement today, faxed a memorandum to the Prime Minister, Dr Manmohan Singh and Union Home Minister, Mr Shivraj Patil submitting that some people are trying to get the tribal status on the name of Pahari language so that they may secure certain benefits which have been given to the tribal people only.

The 7-point memorandum has listed some of the issues and demands of the Gujjar and Bakerwal tribes which have been granted Scheduled Tribe status.

Regarding Pahari speaking people’s claim to ST status, the forum argued that the term; " Pahari or for that matter, Pahari speaking people" has never been defined either by the J&K Government or the Union Government. Such class of people has neither been defined in any works of history, anthropology or census nor even mentioned in revenue records.

Paharis are not recognised class under SRO 394 of 1981 of State Government, it was pointed out. The demand of Pahari speaking people is merely based on the premises of language while the dialect or the language is not any criteria to declare any class as ST.

827 free eye operations performed

UDHAMPUR, Dec 2: The District Blindness Control Society, Udhampur and Rotary Club, Udhampur performed 827 free eye operations in district Udhampur upto October 2005 by holding eye camps at Sangaldan, Dharmari, Thial, Sudhmahadev, Kambal Danga, Nagolta, Hartaryan, Landhar which included 211 plain eye operations and 616 Intra Ocular Lens operations. The patients who undergo plain eye operations were provided spectacles free of cost besides free boarding and lodging facilities.

Under Tuberculosis and Leprosy eradication programme, 455 patients suffering from T.B. have been administered Direct Observatory Treatment (DOTs) free of cost for a period of six to eight months duration and 19 new cases of Leprosy detected in the district ending October, 2005.

This was disclosed at a District Officers meeting convened to review the achievements made by the District Blindness and Tuberculosis Control Societies and District Leprosy Nucleus under the chairmanship of District Development Commissioner, Udhampur, Ashok Parmar, here today.

The Chief Medical Officer, Udhampur, H. K. Badyal, Chief Planning Officer, Rakesh Jamwal, District Tuberculosis Officer, District Leprosy Officer, Chief Education Officer, President, Rotary Club, Udhampur, Rajesh Gupta and Social Workers, Kidar Nath Sharma and Sita Ram Sharma attended the meeting.

Speaking on the occasion, the District Development Commissioner stressed upon the functionaries of Health Department, Societies and Social workers to put in sincere efforts for effective planning, monitoring and implementation of schemes and ensure optimum results on the ground. He also asked for taking due care of patients inhabiting in remote and hilly areas who need the guidance and treatment from the functionaries of health department and other allied agencies. He also called for holding awareness programmes.

RBI convenes first meet of Empowered Committee

JAMMU, Dec 2: Rural Planning and Credit department of Reserve Bank of India (RBI) convened the first meeting of the Empowered Committee set up to review stepping up credit to small and medium enterprises here today.

Regional Director RBI Jammu O P Aggarwal presided over the meeting and briefed the participants about the issues confronting the SME sector and stressed that multifarious problems of this segment called for an integrated and multi-pronged approach from all concerned with the development of this important sector of the economy.

Mr Aggarwal reiterated the concern of the Governor, RBI in the annual policy statement of 2005-06 and emphasized the need to overcome the bottlenecks in the flow of credit to SMEs. Following detailed deliberations on various terms of reference of Empowered Committee, it was decided to obtain district wise data from the banks showing outstanding to the SME sector as on March 31, 2005 and Sept 30 2005 and also to convene meetings of the committee at district / cluster level. It was also decided to suggest ways and means to bring term lending institutions of the State Bank to health.

The meeting was also attended by senior officers from banks and financial institutions.

Panthers Party holds one-day convention at Udhampur

UDHAMPUR, Dec 2: One-day convention of Panthers Party active workers and delegates, held under the chairmanship of Balwant Singh Mankotia, MLA and president of the Young Panther, adopted a resolution supporting the party’s decision to continue support to the State Government for 40 days ( 30 days have already passed).

Prof Bhim Singh, chairman, JKNPP, was the chief guest at the convention which was attended by large number of delegates and party workers, as per release.

In a 11-point resolution, the party session expressed support and solidarity to the Panthers Party leadership and pledged to follow the line of action of the party after 40 days in case Wazir Commission is not implemented and Delimitation Commission constituted.

The convention’s another resolution pleaded for creation of districts of Kishtwar, Samba, Reasi and Bandipora without delay.

The party session hailed the Prime Minister, Dr Manmohan Singh for his assurance that the State Government would implement the Common Minimum Programme (CMP).

The party demanded reservation for Gujjars, Bakerwals and Gaddies (ST) and PoK refugees according to constitutional mandate.

Through another resolution, the party demanded adequate relief to the migrants from Doda, Rajouri, Poonch and Udhampur according to judgement of the Supreme Court (25-11-2005) and the High Court (20-7-2002) providing relief to the Jammu migrants at par with other migrants from the Valley.

It was also impressed upon the Government to ensure fair distribution of kerosene oil and other essentials provided in the ration card to the villagers without delay.

Prof Bhim Singh, in his address at the convention, said that the Panthers Party stands for unity, integration and progress of all the people in all the regions in Jammu and Kashmir. He also underscored upon the need for implementation of CMP.

Compensation released; heavy cost on Insurance Cos imposed
DB decides batch of LPAs in accident claims

JAMMU, Dec 2: The Division Bench of the state High Court Jammu Wing comprising Acting Chief Justice Bashir Ahmed Khan and Justice JP Singh has decided batch of appeals filed by the Insurance Companies against the judgment of Accident Claims Tribunals with minor modification and imposed heavy costs upon Insurance Companies and released laces of Rupees as Compensation.

In an appeal filed by New India Assurance Company Limited, the DB imposed costs of Rs 50,000/- to be recovered from the person who so ever launched this litigation and in other case of New India Assurance Company Limited versus Sharifa Begum and others imposed costs of Rs 50,000/- with the observation that since the accident dates back in 1987 and the appellant Insurance Company has been filing appeal after appeal for the decade or so, dragging the claimants to this Court, they required to be compensated to meet their litigation expenses at least and imposed cost of Rs 50,000/- on the insurance company.

In an appeal filed by New-India Assurance Company Vs Mohd Iqbal and others, the DB imposed costs of Rs 30,000/- on the insurance company to meet the litigation expenses of the claimants and dismissed the appeal.

In another case of New-India Assurance Company Ltd Vs Frida Begum and others DB imposed Rs 20,000/- costs and dismissed the appeal.

The Division Bench in an appeal filed by National Insurance Company Vs Santokh Ram and others, dismissed the appeal.

In an appeal filed by New-India Assurance Company Vs Sakshi Gupta and others with minor modification directed the insurance company to pay Rs 6.5 Laces with 12% interest from the date of application to the date of payment minus the amount already received within one week from today. In an appeal field by United India Insurance Company Vs Babli Devi and others, the DB after hearing the counsel for the appellant, who submitted that the appellant would enjoy the liberty of approaching the Tribunal in terms of the impugned judgment dated February 10, 2003, the DB dismissed this appeal with liberty to the appellant to raise the issue of validity of driving licence in terms of the impugned judgment. The DB directed Registrar Judicial to release the deposited amount to the claimants within one week.

The Division Bench in an appeal filed by National Insurance Company versus Krina Devi and others the DB decided this appeal with the observation that parties have filed a joint application for disposal of the appeal in terms of the settlement reached by them. Under that settlement the appellant shall now pay Rs two lakh in lumsum in full and final satisfaction of the claimants. The insurance company is directed to deposit this amount before the Registrar Judicial within two weeks.

In another appeal filed by United Insurance Company Vs Shakuntla Devi and others in which the counsel appearing for the company submitted that the appellant be granted liberty to take up any other issue before the Tribunal which is permissible under law. The DB said in view of the statement made by the counsel for the appellant, this appeal is dismissed with liberty to the appellant to raise the issues, which may be permissible under law and directed Registrar Judicial to release the deposited amount to the claimants within one week. In another appeal field by National Insurance Company Vs Geeta Devi and others, the DB dismissed this appeal as settled.

In an appeal field by Oriental Insurance Company Ltd Vs Wali Mohd Bhat and others, the Division Bench disposed of this appeal with the observation that the counsel for the appellant Mr. DS Chouhan submitted that this appeal was limited to the issue of 12% interest awarded by the 1st Appellate Court which should have been less. He submitted that Tribunal has only 9% interest and 12% interest was on higher side.

In these people’s friendly judgments, the Division Bench decided cases of accident claims which were pending before the Court for years.

 

Gang of criminals busted, several cases worked out

UDHAMPUR, Dec 2: Police today busted a gang of criminals involved in attempt to murder, robberies and theft cases in and around holy town of Katra and arrested all the three members including kingpin.

Senior Superintendent of Police (SSP) Udhampur Rajesh Kumar said that in recent past three notorious criminals intercepted one of the members of the rival group near the town and inflicted severe injuries on him with sharp-edged weapons.

After critically wounding the member of rival group, all the three criminals escaped in the car of the victim bearing registration number JK14-0752. Since then police has been looking for them.

Today,on a specific information, a police party from Katra Police Station led by SHO S S Sambyal, under the direct supervision of SDPO Katra Anil Magotra conducted raids at several places and arrested all the three members of gang of criminals.

The arrested criminals have been identified as Mangal Singh alias Kaka, son of Karan Singh, Vipin Kumar, son of Ram Chand and Dev Raj, son of Hem Raj.

While kingpin of the gang Mangal Singh was arrested from Udhampur, the other two nabbed from Nangal and Jib Thathi areas. A case under Section 307, 379 RPC and 4/25 Arms Act has been registered against them.

The vehicle of Deep Sharma and several sharp-edged weapons were recovered from their possession.

The SSP said that with the busting of the gang, several cases of robberies, thefts and attempt to murder have been worked out and added that further questioning of the arrested criminals was going on.

First batch of Haj pilgrims to leave for Jeddah on Dec 3

SRINAGAR, Dec 2: About 9306 Haj Pilgrims are leaving for performing Haj 2006 from Jammu and Kashmir State this year. The first batch of pilgrims will leave for Jeddah on December 3, 2005.

This was stated at a high level meeting of officers convened to finalize the arrangements for the comfortable stay for Haj Pilgrims. The meeting was presided by Deputy Commissioner, Srinagar Dr Asgar Samoon.

It was stated in the meeting that the first batch of 215 Haj pilgrims will leave tomorrow at 1.25 pm from Srinagar airport to Jeddah. It was also told that the website and E-mail facility has been made available free of cost for the Haj pilgrims of Jammu and Kashmir state so that they could contact their relatives, while performing Haj in Saudi Arabia.

Meanwhile, the Additional Deputy Commissioner, Srinagar has informed to the Haj Pilgrims of District Srinagar to collect their documents in the office of the Deputy Commissioner, Srinagar before one day of their proceeding.

Professional competitions of Homeguards organised

JAMMU, Dec 2: On the second day of the week long celebration in connection with the Raising Day of the Homeguards and Civil Defence, a professional competition of Homeguards volunteers was organised in Auxiliary Police Lines 2nd Battalion Jammu.

Additional Director General of Police PHQ R V Raju was the chief guest on the occasion and he exhorted upon the Homeguards volunteers to become true professional to enhance the image of their organisation as well as of J&K Police.

He said that role of Homeguards and Civil Defence has become more important in view of natural calamities like earthquake and Tsunami during which they have done laudable work.

IG Homeguards and Civil Defence Navin Aggarwal, in his address, said that Homeguards which was earlier facing identify crisis will get a boost through such professional competitions. This, he said, will help them to improve their professional skills.

On the second day, fire fighting, first aid competitions and physical test were organised. In the fire fighting competition, District Baramulla secured first position while District Rajouri was the runner-up.

In the first aid competition, District Poonch was the winner while District Jammu was the runner-up while in the Physical Test, District Rajouri got the first position while second position was achieved by District Poonch.

DIG Homeguards and Civil Defence Gulzar Singh Slathia, Divisional Warden Homeguards Jammu S M Khatotra, Commandant T Phunsog, Gh Sarwar Chouhan, R K Bhat, Mohd Majid Malik, P D Sharma, Suram Singh, B L Koul and Taj Mohd were among others who witnessed the competitions.

Road connectivity priority of Govt: Charak

SRINAGAR, Dec 2: The Minister for R&B, Gulchain Singh Charak presided over an officers meeting of Roads and Buildings department here today to review the pace of on-going developmental projects taken in hand.

Among others, Managing Director, JKPCC, Mohammad Amin Nowsheri, Chief Engineer, R&B Shamus-u-Din Koka, Superintendent Engineers of Budgam and Srinagar and all Valley based Executive Engineers of R&B were present in the meeting.

The Minister was informed that work on 4-Lane National Highway Bye Pass project of Rs.168 crores is going on and will be completed very soon.

The meeting also reviewed the 6-lane Batmaloo-Qamarwari road, which is under progress, besides physical and fiscal progress of the schemes taken in hand under NABARD.

The Minister said that providing better connectivity to people is the priority of the Government and directed the engineers to complete all the schemes taken up under Prime Minister’s Gram Sadak Yojna (PMGSY) and NABARD.

Earlier, the minister inspected snow clearance Control Room set up in Engineering Complex, Raj bagh and directed the concerned to be ready as the winter has set in the Valley. He directed that there should not be any complaint on account of snow clearance in the Valley.

CEC LAHDC Kargil visits far-flung villages

LEH, Dec 2: With a view to ascertain the problems of the people and to take stock of developmental works of remote and far flung areas, Haji Asgar Ali Karbalai, the Chief Executive Councilor, LAHDC, Kargil conducted extensive tour of villages of Sanko and Taisuru blocks of Kargil district. Tashi-Yokma, Achambur, Kochik, Choskore, Prantee, Panikahar, Taisure, Maita, Kargee, Khawoos, Namsuru, Thulus, Pursa, Yuljuk, Damnsa, Thangbu, Purtikchey, Gialing and Sangrah etc.

He was accompanied by executive councils Nasser Hussain Munshi, Sonam Namgyal, Kachool Gulzar Hussain, MLA Ghulam Raza, Deputy Commissioner/CEO LAHDC, Kargil Kachoo Isfandyar Khan, Superintending Engineer, S K Ganjoo and team of district and block officers.

The representatives of these villages put forth a charter of demands which include repair of hand pumps, construction of foot bridge, telephone facilities, opening of medical centre etc.

Mir seeks intervention of CM to solve
fruit growers problems

SRINAGAR, Dec 2: For-mer Minister for Tourism & Urban Development, Gh. Hassan Mir has sought the intervention of Chief Minister, Ghulam Nabi Azad in solving the problems of fruit growers of Kashmir valley.

In a statement issued here, today, Mr Mir said that the matter regarding hardships being faced by the fruit growers due to non lifting of third grade Apple from the Valley needed to be mitigated otherwise they will be put to heavy loss.

He said the Government has formulated the Market Intervention Scheme to lift the low quality fruit from the growers of the State, but the authorities at the gross root level are not lifting the fruit from them for unknown reasons.

Mr Mir regretted that authorities have been giving excuses of non availability of vehicles which is not the reason. Any further delay in this regard will further compound the problems of the fruit growers of Valley, he added.

He said the fruit growers of the Valley will be put to heavy loss in case the low quality apple is not lifted by the Government as was promised earlier.

The senior PDP leader, while appealing the Chief Minister has sought his immediate intervention so that the problems of the fruit growers are redressed.

Divisional Consumer Forum's directive
to Insurance company

Jammu, Dec 2 : Divisional Consumer Forum Jammu comprising Mr SL Pandita as its President and Mr. JK Gandotra and Mrs. Meenu Sharma its members in a complaint field by Vinod Kumar owner of the tanker, which met with an accident in the month of June 2000 in which the complainant seeking claim for damaging of tanker and also loss of Kerosene Oil, directed New India Assurance Company to pay an amount of Rs 20,553 the loss caused to the tanker and Rs 83,724 Loss Caused to Kerosene oil product carried in the tanker because of accident dated June 8, 2002 that took place near Batote on Jammu-Srinagar National Highway as the tanker under product was covered by the Insurance policy issued by New India Assurance Company Ltd.

The Forum also ordered that the amount shall carry interest at the rate of 6% P.A from October 2000 till realization.

The complainant is held entitled to cost of Rs 1000/- as litigation has been forced upon him.

While allowing the compliant the forum said that the New India Assurance Company Bari-Brahmana is held guilty of deficiency of service and unfair trade practice and issued direction to pay the amount to the complainant.

Traders Federation deputation calls on Transport Commissioner

JAMMU, Dec 2: A deputation of Traders Federation, Ware House , Nehru Market under the presidentship of its senior vice president, Ved Prakash Gupta called on Transport Commissioner here today.

The delegation apprised him of the difficulties being faced by the traders of Ware House, Nehru Market regarding the recent Government order under which the restrictions were imposed on movement of trucks between 8 am to 8 pm in the Ware House and Nehru Market.

As per a release, Mr Gupta said the delegation of traders met the Transport Commissioner, in his capacity being the chairman of the high level committee formed by the Government to see the grievance of the effected persons by the recent Government order.

A memorandum as also submitted to the transport Commissioners regarding the problems being faced by the traders of Ware House and Nehru Market.

The memorandum said that the entire business of the traders has come to a standstill due to the ban. It said that the Government has not provided any alternative space where traders could be settled and with this decision hundreds of families will be effected.

The memorandum demanded that in case the vehicular traffic movement in ware house area is to be stopped or restricted the same be postponed till Government provides alternative to Nehru Market and Ware House.

NC constitutes committees for Marh,
Satwari, Mahanpur blocks

JAMMU, Dec 2: In the on-going organisational elections, National Conference today constituted committees for block Marh, block Satwari and block Mahanpur.

Th. Baldev Singh has been elected as president of block Marh while as Raj Singh for block Mahanpur and Subash Chander for block Satwari. Election for block Marh was held under the supervision of Th. Suram Singh, ex-Minister and K L Bhagat. Newly elected block president constituted committees which comprised of Jagdish Chander Sharma, Paras Ram, Karan Singh, Capt (Retd) Om Parkash, Master Milkhi Ram Bhagat, Kasturi Lal, Gurnam Singh, Prem Saini and Raj Kumar.

Subash Chander was unanimously elected as block president Satwari. Election was held under the supervision of K L Bhagat and Th. Suram Singh.

For block Satwari, Ambo Ram was elected as vice-president, Behari Lal as secretary, Hans Raj as joint secretary and Darshan Lal Mottan as cashier.

Raj Singh was elected as president for block Mahanpur. Elections were held under the supervision of Gurdeep Singh Sasan. Newly elected president also announced block committee which includes Kamal Kishore as vice-president, Sadanath Sharma as cashier, Mohammed Saleem as joint secretary and Sant Kumar Abrol as cashier.

PHE employees highlight demands, support dharna

UDHAMPUR, Dec 2: District Udhampur executive body meeting of PHE employees Association was held under the presidentship of Som Nath, provincial secretary of the Association, which extended full support to the indefinite dharna being launched by provincial body at PHE Complex Jammu in support of their demands.

The demands pertained to end of discrimination being meted out to over 10000 consolidated rate wagers in Jammu province who are being paid on 17 different rates and called for payment of minimum daily wage of Rs 70 to all of them as no such worker existed in Kashmir province.

The meeting called for holding of DPC meeting which has not been held for the past over five to six years in Jammu province for field as well as clerical posts thus blocking their promotional avenues and benefit of Essential Service to all PHE employees by way of providing them two and a half day extra salary.

Other demands included grant of 4% DA instalment from July 2005, appointment of 15,756 new employees in PHE Department in Jammu province as existing staff was performing double duty without any incentives and change of designation of employees as per nature of job being performed by them. As regards post of helper, it gets automatically abolished on the death of helper as a result of which the benefit of SRO 43 gets hindered. The meeting called for removal of this anomaly and for extension of SRO 43 in the death cases of daily wagers.
