From Ahmed Ali Fayyaz SRINAGAR, Nov 10: Former Chief Minister Dr Farooq Abdullah, National Conference (NC) President Omar Abdullah, Chairman Legislative Council Abdur Rasheed Dar, Speaker of Legislative Assembly Tara Chand and five Ministers of the coalition Government are among 30-odd protected VIPs who have been violating the security guidelines and travelling in non-bulletproof cars in Kashmir valley. Number of such violators is believed to be simply double in Jammu. Both Farooq Abdullah as well as Omar are placed in the "Z-plus" category of security. They are always supposed to travel in bulletproof cars provided by the State Government in Jammu and Kashmir. Both have been frequently travelling in their non-BP Scorpios, making themselves vulnerable to attacks from militants. Prior to October 24th IED blast in Anantnag, Omar had escaped three militant attacks this year alone. Militants have fired upon Dr Abdullahs motorcade at least twice in the last six months. Official statistics, prepared as a mandatory practice by the NSG and submitted to the Union Home Ministry, indicate that Dr Abdullah had breached security guidelinesby driving personally and travelling in non-BP vehicles without proper protection in New Delhimore than 200 times during his term as Chief Minister in 1996-2002 period. Violations in his home State have not been tabulated. Even as Chief Minister Mufti Mohammad Sayeed has been invariably using a bulletproof Scorpio of the SSG and the PDP chief Mehbooba Mufti has been travelling either in a BP Scorpio or in a BP Ambassador, a number of their Ministers have been moving in non-BP cars. They are all in "Z" category in view of threat perception. Minister for Irrigation and PHE, Qazi Mohammad Afzal, has been in possession of a BP car provided by State Motor Garages and Security Wing (SW) of J&K Police. His BP car has often remained parked without reduction in the expenditure on fuel indeed. The Minister has been travelling in a non-BP Bolero, drawn from the subordinate PHE Department. Minister of State (MoS) for Power, Javed Mustafa Mir, has of course been carrying his slain fathers .12 bore gun, as also a "Kirankov" (AK-96 rifle) specially allotted to one of his PSOs. He had requisitioned an official Scorpiocraze of the PDP Governmentwhich was denied to him. The relentless PDP leader made it a point to acquire a private Scorpio. He has been invariably driving the same non-BP vehicle while travelling in sensitive localities in the Valley. Similarly, MoS Industries Raman Matoo and MoS Planning Usman Majeed have been always travelling in their private non-BP Scorpios. Mattoo uses the more vulnerable Honda City in Jammu. Chairman of State Agro-Industries Development Corporation, Mohammad Shafi Bhat, who enjoys the status of MoS in the State protocol and security, has been always spotted on the front seat of his plain Gypsy. All of these Ministers have been provided BP cars by the authorities. Most of them have even spared their official drivers and held the pleasure of driving unto themselves. NC MLAs Ali Mohammad Sagar, Dr Ghulam Nabi Bhat, Aga Ruhullah, PDP MLC Ghulam Nabi Lone Hanjoora as also the former Ministers Chowdhary Mohammad Ramzan and Sakeena Itoo have also been travelling in plain cars and Gypsies. Again, BP cars stand allotted to almost all of them. While as Sagar drives a plain Gypsy allotted to him by the Security Wing, Hanjoora has been often seen in his Maruti-800. One fine morning last fortnight, Sagar was spotted in his non-BP Gypsy, driven by his son Salman on Srinagar-Airport Road. There was not a single PSO with them. Earlier, on August 14th evening, NCs MLA Dr Ghulam Nabi Bhats Maruti-800 was intercepted by a BSF column at Baghat Barzullah Crossing. As the MLA failed to apply his brakes at once, a BSF soldier accosted him and applied a slap on his gentle face. It was only when some passers-by pleaded he was an MLA, Dr Bhat was let off. His only companion in the private car was his wife, Dr Rehana. Bhats father, who was NCs MLA in Tral, and two brothers have been gunned down by militants in the present spell of insurgency. Protectees have also been compromising the security guidelines on their routes and timing of travelling. They have categorical instructions that they should never travel beyond 1700 hours when the paramilitary RoPs are normally withdrawn for night. It was late in the evening when MLAs Ajay Sadhotra and Sajad Ahmed Kichloo were ambushed by militants last month on Srinagar-Jammu highway. Again, it was nearly midnight when militants attacked Omar Abdullah near Sheer Bibi on the same highway. On most of the occasions, neither the Security Wing/ SSG nor other organisations of Police and security forces have any inkling of the VIPs travelling on a particular route. It has also been observed that most of the VIPs either assign their domestic works to their PSOs or take them along without weapon. When militants gunned down NCs leader and former Minister Safdar Ali Beig in Anantnag last month, they first shot dead his unarmed PSO. Another PSO was very much at the VIPs residence. Chairman of Legislative Council, Abdur Rasheed Dar, has been travelling in his official but non-BP Scorpio, both between Srinagar and his Airport residence and between Srinagar and his home constituency of Shangus in the militant-infested Anantnag. Speaker of Legislative Assembly, Tara Chand, does not often travel in the Valleys rural areas but he has always used his non-BP Scorpio in Srinagar. Among the highest protected bureaucrats, Chief Secretary Dr S S Bloeria himself has been invariably spotted in his non-BP Ambassador. Justifying his breach of security, Omar Abdullah said that his BP car was withdrawn by the former DIG of SSG Ram Lubhaya. He said that "in order to win the Muftis pat and ensure his elevation to the rank of IGP", Ram Lubhaya handed over the same car to Mehbooba Mufti. He said that the car was replaced by a ramshackle BP car "which remains more with the workshop than with me". He said that on the other hand, Government of Delhi and the Union Home Ministry would take every care of his security and provide him a perfectly right BP car while in the Union capital. Sources said that Dr Abdullah continued to be in possession of a BP car, which he had procured when he became Chief Minister of the State in 1996. That car has never been replaced. However, SSG officials maintained that a brand new BP car had been placed at the former Chief Ministers disposal in New Delhi. Unwilling to identify themselves for technical reasons, they claimed that BP cars have always been in the Abdullahs motorcades. "They leave the BP cars behind and travel in their luxury vehicles. They dont co-operate with us in such matters", said a senior official. He admitted that old vehicles had dominated the SSGs and SWs fleets but asserted that "all of these vehicles are very much in good condition". Regarding SW protectees, DIG Security Abdus Subhan Lone claimed that all the Ministers and sitting legislators had been provided with BP cars, alongwith drivers, besides escort vehicles, PSOs, house-guards and escort personnel. He confirmed that most of the protectees were not co-operating with the authorities in terms of tour and travel besides staying at particular places. He argued that SW had no authority to force the VIPs to stick to the security guidelines, though the same were being regularly provided to them. |

Mufti's gameplan Excelsior Special Correspondent HIRANAGAR, Nov 10: Reiterating National Conferences demand for restoring special status of the Jammu and Kashmir, former Chief Minister and patron of the party, Dr Farooq Abdullah today demanded political package from the Prime Minister. "Besides some financial or economic package, Prime Minister Dr Manmohan Singh must announce some political package for this violence plagued State", Dr Abdullah said during an informal chat with media persons after distributing trophies and other prizes to players during conclusion of a hockey tournament here this afternoon. When asked to divulge about political package being demanded by the National Conference, Dr Abdullah said that National Conference has already made its stand clear on this issue, with an obvious reference towards demand of the party of granting greater autonomy to the State. "There are some laws which should be scrapped", he said without going into the detail. "All sections of the society should be provided healing touch", he said, adding, "this term must be used in real sense to heal wounds of the people rather than using it as political tool to befool the innocent masses". With an obvious reference towards Handwara incident in which mother and daughter have allegedly been raped, Dr Abdullah said that people of this State deserve healing touch and their wounds should be healed by adopting humane approach. Replying to a question regarding plan of the National Conference to launch agitation against Mufti Government for its failure to provide security to the party leaders, the former Chief Minister said, "ball is now in Centres court to take action as investigation team of the Union Home Ministry has completed its investigation and handed over its report to the Union Government". "We have also brought the entire matter to the notice of the Prime Minister, Dr Manmohan Singh, Union Home Minister, Shivraj Patil and other leaders",he said, adding, "it is now upto Centre to take appropriate action in this case". Pointing towards demand of the National Conference president, Omar Abdullah to revoke Armed Forces Special Power Act in the State, Dr Abdullah endorsed his sons demand. "People of this violence plagued State want some relief", he said and supported NC presidents demand that Kashmiris require political package and not just an economic package. When asked about two years performance of the Congress-PDP-JKNPP coalition Government headed by Mufti Mohammed Sayeed, the former Chief Minister said, "people are the best judges. It is better you ask the common masses about performance of this regime". Chiding the coalition regime for its failure to mitigate woes of the masses, Dr Abdullah said, "performance of this dispensation can be judged by the view points of the people". In an obvious reference towards on-going demonstrations and protests in different parts of the Kashmir valley over alleged rape of a mother-daughter at Handwara, Dr Abdullah chided, "people themselves speaking about performance of this regime". Police detains Malik
outside UN office Excelsior Special Correspondent SRINAGAR, Nov 10: Most of shops and businesses remained closed Wednesday on a shutdown call given by separatists and Jammu and Kashmir High Court Bar Association in protest of the alleged rape of 10-year-old girl and her mother in Handwara. While as Jammu Kashmir Libration Front (JKLF) chief Mohammed Yasin Malik and some of his associates were detained by police near UN Office at Sonwar, police used batons and fired tear gas shells to disperse protestors in Maisuma locality here. Dozens of demonstrators took to streets amid pro-independence slogans at Maisuma locality this morning while protesting against the alleged rape of a woman and her daughter by army soldiers. The demonstrators were also chanting slogans against Government and security forces. As the protesting youth started marching towards Lalchowk area, police swung into action and fired dozens tear gas canisters and used batons to disperse them. The demonstrators responded with pelting of stones and the ding dong battles between the protestors and police continued for nearly two hours. In street protests and battles with the police, about a10 demonstrators and three policemen were injured. Police detained about a dozen youth from Maisuma locality as well. Students of Government Medical College, Srinagar also took out a protest demonstration against the Handwara incident. The protesting students were demanding high level inquiry into the incident and severe punishment to the culprits. Reports said that police resorted to mild can charge to disperse the protestors. Similarly, there were reports of protest demonstrations at Kak Sarai, Nowhatta, Hawal in old Srinagar and Pampore. Angry protestors also burned tyres at Residency Road, Maharaja Bazar and Exchange Road in Lalchowk area. JKLF chairman Mohammed Yasin Malik alongwith his five associates including Ghulam Rasool Dar and Sheikh Abdul Rashid were detained by police as they handed over a memorandum to the UN Office at Sonwar here this afternoon. The JKLF leaders was immediately whisked to Ram Munshi Bagh Police Station and lodged there. In the memorandum addressed to the UN Secretary General, Kofi Annan, copies of which were made available to media, Malik has appealed Mr Annan to intervene and respect human values. "Where is the world conscience? Is this incident not enough to shake the conscience of the world? How many more such victims? We ask for our rights. Where, then, are Kashmiri rights?" the memorandum reads. " world is crying at Abu Gharib in Iraq. We have hundreds of Abu Gharibs here. The only difference being our Abu Gharibs do not give out pictures," it reads. A spokesman of the JKLF in a statement issued here this evening said that police severely thrashed Malik and Sheikh Rashid at Ram Munshi Bagh Police Station. The spokesman said that Malik was later put behind the bars in injured condition. Opposition National Conference (NC) took out a protest rally led by former Minister Ali Mohammed Sagar and the NCs womens wing head, Shameema Firdous from party headquarters to Lalchowk. The NC activists were chanting slogans against healing touch and failure of Mufti Mohammed Sayeed led coalition Government. Later in a statement, Sagar accused the ruling People Democratic Party (PDP) of doublespeak. "While the Chief Minister vehemently denied the charges, his daughter and the PDP president, Mehbooba Mufti, is busy putting a political cloak to seek political mileage out of the incident," he said. Sagar challenged the Mufti Government to probe all such incidents since NC came to power. "They will see how they have broken the records in human rights violations and killing of innocents." Meanwhile, there was a partial response to the strike call. Though most shops and businesses remained closed in Srinagar and most of the other towns, vehicular traffic plied on roads almost as routine. NEW DELHI, Nov 10: Firebrand BJP leader Uma Bharti was today suspended from BJP and removed as general secretary on a charge of indiscipline after she defiantly walked out of a party meeting demanding action against some leaders who she alleged were planting news against her in the media. The party also issued a show cause notice to the 45-year-old leader asking her why she should not be expelled. The dramatic developments, climaxing a month-long cold war between Bharti and former BJP president M Venkaiah Naidu and Pramod Mahajan, took place in full glare of television cameras, something unknown to BJP. Bharti, who resigned as Madhya Pradesh Chief Minister in August following revival of a criminal case against her in Karnataka, was suspended from the party shortly after "on account of her conduct" on the demand of office bearers, senior party leader Jaswant Singh told reporters. The backward face of BJP, who is also a leading participant in the Ram temple movement, has often spoken out on issues in the party and was only last week made general secretary after a show of reluctance. As the first meeting of newly appointed office bearers was on in which Advani referred to quarrelling among party leaders through the media and pointedly referred to Bharti saying "there is a limit to how much departure from discipline can be tolerated." This provoked Bharti who got up and attacked "four-five" leaders in the meeting who she charged with spreading stories against her in off the record briefings. She demanded a discussion on the issue. As a shocked of BJP president L K Advani, and Jaswant Singh, sitting on the dais, she left the hall in the party headquarters when Advani dismissed her demand for discussion. Bharti, who has been at the centre of intra-party wranglings ever since she stepped down as Madhya Pradesh Chief Minister and was in a row with former party president M Venkaiah Naidu, Pramod Mahajan and Mukhtar Abbas Naqvi, was red with anger as she left the hall. "There are four-five people in this hall who do off the record briefings (against her) which appear as headlines and people like here were not similarly capable. So we are forced to save our honour by being compelled to speak on record and that is being branded as indiscipline," she said as she walked out. These leaders, she said,"had no work because they are in Rajya Sabha and do off the record briefing. They do not want anything to be discussed." achievements Excelsior Special Correspondent JAMMU, Nov 10: Chief Minister Mufti Mohammad Sayeed has said that Handwara incident was a highly condemnable act and occurrences like these have potential of washing out the good work done by the Government. He said such incidents would not be countenanced adding that he had spoken to the Army Corps Commander and asked him to take prompt action against the guilty. Addressing media persons after the inauguration of a function organized by the State Information Department here today to highlight achievements of the coalition Government in two years, the Chief Minister said that the anger of people on this incident was justified. He said law would take its own course and the guilty would be punished. Investigation into the incident had been initiated and the accused Army Officer has already been removed from that place, he added. The Chief Minister said such incidents were very unfortunate deserving highest condemnation. He said the protest by people was a natural corollary to the shameful act. He, however, added that some elements were trying to exploit the incident for their own political gains and warned them against doing so. Asked if he was for allowing Hurriyat leaders to visit Pakistan, the Chief Minister said that people and various groups of both countries have been visiting each other and he believed in greater interaction on either side. He said frequent interactions would help the peace process and also remove misconceptions in Pakistan about Kashmir. He said the groups of Pakistani journalists and pilgrims that visited the State recently had returned with a changed perception about the situation here. He said they were surprised to see the development of the State and its democratic moorings. The Chief Minister said that he was the one who believed that there was nothing to hide from others in Jammu and Kashmir. He said the State was the window of Indian democracy and secularism that could be showcased to the outside world. He said that he had spoken to the Prime Minister and the Union Home Minister asking them to let people of Pakistan visit the State and see how wrong impressions had been fed to them back home about Jammu and Kashmir. He said a delegation of journalists from Jammu and Kashmir would soon visit Muzaffarabad and a large contingent of 1000 peace marchers including 150 from Jammu and Kashmir would visit Wagah and cross to other side with the spirit of goodwill. About the reports that Prime Ministers visit to Jammu and Kashmir had been postponed, Mufti Sayeed said that Dr. Manmohan Singh is definitely coming. He said the Prime Minister was keen about visiting J&K as he is interested in the development of the State. Asked about Pervez Musharrafs proposed solution on Kashmir, he said that the Pakistani president had himself laid parameters for the solution when he said it had to be acceptable to India also. Giving an account of the achievements registered by his Government in various sectors, the Chief Minister said that apart from facilitating process of peace and ensuring a phase of unprecedented development, the smooth conduct of the thus far most fair elections held recently for the four assembly segments had won national and international appreciation for the Government. He said a new chapter of Indo-Pak relations had opened for which the people of Jammu and Kashmir had done the groundwork. He said that process of reconciliation between India and Pakistan had a positive impact on the situation in Jammu and Kashmir. He said it had strengthened the peace process here. Within the State, the Chief Minister said that his Government had addressed the feelings of discontent among people of various regions by allowing them equal share in the development process. He said the fractured mandate in the 2002 assembly elections had in fact been a boon for the people of the State as it had ensured participation of all the regions in the development of the State. He said plan allocations had been distributed equitably leaving no room for complaint. He appreciated the central Governments help for the overall development of Jammu and Kashmir. In the power sector, Mufti Sayeed said that financial closure of and institutional finances for the Baglihar power project was ensured. He said transmission lines in both Jammu and Srinagar cities would be modernized at a cost of Rs. 450 crore and for the first time, a transmission line would be laid between Srinagar and Leh costing Rs.350 crore. He said 50,000 educated youth were provided employment in two years in the most transparent manner while self-help groups of 3000 unemployed engineers were set up and work allotted to them. He said industrial projects of Rs.1500 crore were in the pipeline. |

Excelsior Special Correspondent JAMMU, Nov 10: Justice VK Jhanji of the State High Court today stayed the controversial Guest Control order passed by Government on October 27, 2004. Under this order, the State Government had restricted the scale of hospitality, preparation of dishes and number of guests at the wedding and other related ceremonies. This order was passed in a writ petition filed by OP Dogra and others, wherein the petitioners had challenged the controversial order number 1463-GAD of 2004 on various grounds. It was submitted that the first such step was taken by the Government in May 2004 when it indicated the desire to impose restrictions. However, since May-June was the marriage season in Kashmir valley and also because of public unrest that time, the decision was put on hold. The wedding season and ceremonies in Jammu region come around November and December and the present Government on regional consideration imposed the decision by issuing the controversial order, it was asserted. Justice Jhanji after hearing Advocates Sunil Sethi and Sudershan Sharma, appearing for the petitioners and Additional Advocate General BS Salathia for the State, issued notices to the Principal Secretary General Administration Department (GAD) and Director Consumer Affairs and Public Distribution Jammu/Kashmir. The notices were accepted by Mr Salathia on behalf of the respondents. While staying the order, the High Court observed that it was of the view that till objections are filed and considered, "the operation of the order impugned dated October 27, 2004 has to be stayed". The Registry was directed to list the petition in the week commencing December 13, 2004 and in the meantime, objections be filed. In the petition, the petitioners had further submitted that their wards are getting married and they have already booked banquet halls and distributed invitation cards to number of their relatives within and outside the State. They pointed that the number of such guests invited for attending the marriage, could be above 1000, whiles the Government had restricted the number of guests to 200 and 250 for serving non-vegetarian and vegetarian dishes respectively. |

NEW DELHI, Nov 10: Prime Minister Manmohan Singh is going ahead with his much-anticipated visit to Jammu and Kashmir from November 17. Reacting to news reports about postponement of Singhs visit, a spokesman in the Prime Ministers office said today there was no change in the schedule and the Prime Minister "is looking forward to his visit to the State and to meet and interact with a wide cross-section of the people." He termed the media report as "factually incorrect" and said "there is no change in the Prime Ministers scheduled visit to the State." "Apart from being factually incorrect, the news report is tendentious in dealing with a subject of national importance," the spokesman said in a release. According to sources, during his visit to the State, the Prime Minister is likely to make an announcement of a Rs 3,000 crore package for the militancy-ravaged State. The sources said that during his two-day visit, he was likely to lay the foundation stone of South Kashmir campus of Kashmir University in Anantnag. The Prime Minister, who had to cancel his visit last month due to the bypolls in the State, would be meeting the business community to discuss rejuvenation of the shattered economy of the State. The ground work of the visit was laid by Union Home Minister Shivraj Patil during his three-day visit to the State. The Home Ministry would be submitting a detailed report to the Prime Minister soon. HC bans import of faulty globes NEW DELHI, Nov 10: The Delhi High Court today banned the import and marketing of the China-made globes in the country showing Jammu and Kashmir as not an integral part of Indian territory. Directing the Government not to permit circulation of such faulty globes in the market, a bench of Chief Justice B C Patel and Justice B D Ahmed pulled up the customs department for not taking up the issue seriously despite its order. "After the order made by this court, the consignments were received at Chennai and the customs officials allowed marketing of toy globes depicting the Indian territory incorrectly," the bench said. Observing that such toy globes could not be permitted to be circulated in the market here, the bench said "we direct the customs officials not to permit the import of toy globes depicting territory of India incorrectly." The bench perused the CBI investigation report which pointed out that the toy globes depicting the Indian territory incorrectly was being manufactured by four firms in China and Hong Kong. Government counsel Siddharth Mridul informed the court that action has been initiated against customs officials negligent in their duty while examining the consignment of toy globes. The Public Interest Litigation (PIL) filed by advocate S P Gautam, had pointed that the China-made globe showed Jammu and Kashmir in different colour than rest of India creating impression that the State was an "independent" country. The court disposed off the PIL directing Centre to pay Rs 10,000 to the petitioner. The PIL had alleged that the globe, maps and Atlas made in China has a objectionable feature showing Jammu and Kashmir totally surrounded by Pakistan boundaries in contravention to the Constitution. The petitioner had informed the court that the faulty globes and maps were being imported by a Chennai-based importer Overseas Incorporation and was sold under the registered trade mark "toy house". The court has ordered CBI probe into the issue on May 27 following unsatisfactory reply from the police of several states. The bench had expressed its unhapiness over the manner in which Tamil Nadu Police probed the matter and submitted its report to the Home Ministry. While ordering CBI probe, the court had said that Chennai police despite being provided with the address of the importer have reported that it did not recover any incriminating globe from the godown. DNA samples collected in Handwara Excelsior Special Correspondent SRINAGAR, Nov 10: Experts of Forensic Science Laboratory (FSL) today collected blood samples of Major Rehman of Rashtriya Rifles 30th Bn for forensic examination at Handwara. As already reported, a 34-year-old woman, Ayesha Begum, and her 11-year-old daughter, Shabnam, have alleged that the Army officer stripped them both at their house in Badar Payeen village and committed rape on them, more than once. Sources told the EXCELSIOR that on the requisition of Handwara Police, Director FSL deputed a team of forensic experts, which collected the accused Majors blood samples for DNA testing at Police Station Handwara today. Blood samples of Ayeshas husband, Abdur Rasheed Dar, were also collected for the same purpose. The samples were collected in presence of an executive magistrate, Police officials and senior citizens. Sources said that the samples, alongwith the womans vaginal swab and the marks of semen found on her and her daughters body, would be matched to scientifically ascertain as to who had committed intercourse. These samples, as also the two womens torn out clothes, would be sent to Central Forensic Science Laboratory Chandigarh. Sources said that copies of the CFSL observations would be provided to all the three inquiries going on simultaneously. In addition to registration of a criminal case with Police, Army has constituted its own Court of Inquiry against the accused Major. Besides, Additional DC Kupwara, Sharafat Ali Khan, is conducting a time-bound magisterial inquiry. A team of doctors at Sub District Hospital Handwara, headed by Medical Superintendent Dr Shubeena, has already confirmed sexual violation of Ayesha and molestation of her daughter. DNA fingerprinting is being conducted to establish whether the marks of semen were those of the accused Major or those of the complainant womans husband. |
