NEW DELHI, Nov 5: Affirming Indias commitment to make "an honest and sincere effort" to resolve all outstanding issues with Pakistan, Prime Minister Manmohan Singh today, however, made it clear that this was conditional on President Pervez Musharraf not allowing Pakistani territory to be used for cross-border terrorism. "We are committed to make an honest and sincere effort to resolve all outstanding issues (with Pakistan)," Singh said during a question-answer session after he delivered his keynote address at the `Hindustan Times leadership initiative conference here. "The only condition", he said, "is that the commitment that was made by President Musharraf in January with (then) Prime Minister (Atal Bihari) Vajpayee that territory of Pakistan will not be allowed to be used for purposes of cross-border terrorism, if that commitment is honoured in letter and spirit I think the two Governments haveat least we certainly have the will to engage Pakistan in a constructive dialogue towards resolving all outstanding issues bilaterally, and that included the issue of including Jammu and Kashmir". A galaxy of eminent personalities including Sri Lankan President Chandrika Kuamaratunga, former British Prime Minister John Major, former US Secretary of State Henry Kissinger, Pakistans cricketer-turned-politician Imran Khan, Union Ministers and members of Parliament are attending the two-day conference. The Prime Minister and other guests were welcomed by Hindustan Times vice-chairperson and editorial director Shobhana Bhartia. In his wide-ranging address on the theme India and the world: A blueprint for partnership and growth, the Prime Minister touched upon issues relating to the countrys foreign policy, its economy and its democracy. Maintaining that India was a responsible nuclear power, Singh said it was firmly committed to nuclear non-proliferation and would cooperate with the world community to prevent proliferation of Weapons of Mass Destruction and deal with the threat of terrorism. India, he said, will also pursue energy security within a cooperative framework working with other countries to ensure security of oil supplies, of pipelines and sea-lanes of communication. "We will continue to strengthen our wide-ranging and many-sided relationship with the United States, European Union and Russia," he said. The Prime Minister said India wanted mutually beneficial relations with all its Asian neighbours and would work closely to realise "our combined aspiration to make the 21st century an Asian century. "We would like to see widening and deepening of our economic relations with China, Japan and the member countries of ASEAN, the Central Asian Republics and our traditional friends in west Asia and Africa," he said. Singh said "as a responsible nuclear power, we are firmly committed to nuclear non-proliferation and will cooperate with the world community to prevent proliferation of Weapons of Mass Destruction and deal with the threat of terrorism". The Prime Minister said New Delhi wanted a neighbourhood of "peace and shared prosperity" in which people, goods and services could travel with ease across borders. "South Asia must regain its pre-eminence in the global economy as a sub-continent of creativity and enterprise," he said. The Prime Minister said his Government would like to inject new energy into regional associations like the South Asian Association for Regional Cooperation and the Bay of Bengal initiative for multi-sectoral Technical and Economic Cooperation (BOMSTEC). "It is in our shared interest to wage a joint struggle against poverty and ignorance" the Prime Minister said. The Prime Minister said that his Government would like to give the highest priority to an acceleration of the rate of economic growth through a proces of economic and social development that is equitable and just. "India has to be an active trading nation and is therefore committed to strengthening a rule-based transparent and consensual multilateral trading regime," he said. Maintaining that he would like to see closer and wider economic engagement between India and its Asian neighbourhood, he said he would like the countrys business leaders to explore the full potential of the creation of an Asian economic community. The world, he said, has increasingly come to accept that open societies and open markets are the most natural and stable form of social and economic organisation. "What is now increasingly clear is that an inclusive democracy, based on the principles of pluralism and multi-culturalism, is the most enduring means of dealing with the challenges posed by open markets and open societies," he said. Contending that the world community has been actively engaged in recent years in dealing with the perceived threat of globalisation and political extremism in its various manifestations, ranging from ethnic cleansing to "Jehadism", he said, "there are no military solutions to such challenges. "There are no unilateral solutions either. Any meaningful solution must be based on the principles of democratic pluralism and inclusivism, the respect of the rule of law and of diversity of opinion and faith. The voice of moderation has to be empowered in all societies to make the world a better place to live in. The principle of an `eye for an eye, as Gandhiji often reminded us, would leave us all blind," he said. Referring to the idea that even if nations may clash with one another, cultures and civilisations can co-exist, Singh said "the defining feature of the 21st century is not that it will be marked by a clash of civilisations, but that it will be shaped by a confluence of civilisations". Stating that the world community could deal more meaningfully with the challenge of globalisation and the threat of terrorism by enabling a dialogue between nations and a confluence of civilisations, he said India must actively engage the world towards this end. "By rejecting the politics of exclusion and voting in favour of the values of secularism and pluralism that we cherish, the people of India have once again given us a reason to hold our head high in the comity of nations." Replying to a question on the priorities before him, now that he has spent six months in office, Singh said he wanted to focus on agriculture, infrastructure development and education and health to provide a boost to the economy. With the education provided by the IITs and the management institution and Indias achievements in the IT revolution and the opportunities in various sectors coming up, the country has proved that "we are second to none", he said. moratorium on Kashmir NEW DELHI, Nov 5: Former Jammu and Kashmir Chief Minister Farooq Abdullah today favoured a 20-year moratorium on Kashmir issue for normalisation of Indo-Pak ties and differed with Pakistans cricketer-turned-politician Imran Khan who suggested a Switzerland-type of status for the State. Khan, president of Tehreek-e-Insaaf Party, emphasised the essentiality of ascertaining wishes of "genuine representatives" of Jammu and Kashmir who could be chosen through "free and fair elections under UN supervision in the entire undivided State in demilitarised condition." "For a solution to the Kashmir issue, we can look at Switzerland where people of different ethnicities live in an autonomous and proper democratic set-up. Kashmiris may like to have such a system," he said. Abdullah, sharing dais with Khan at Hindustan Times leadership initiative conference here, differed on this solution and favoured grant of "maximum autonomy" to all parts of the undivided State under the prevailing structure. The National Conference leader suggested conversion of Line of Control (LoC) into "soft" International Border across which people of the State could freely "meet, interact, do business and even marry". "Frequent people-to-people interaction will help overcome the misgivings regarding the other part of Jammu and Kashmir prevailing due to ignorance," he said. Khan admitted that those attacking Parliament, Assembly or innocent people are terrorists, but underlined that "one mans terrorist may be another persons freedom fighter". Favouring the idea of 20-year moratorium on Kashmir issue to help in normalisation of Indo-Pak relations, Abdullah said this would allow cooling of tempers and new thinking could emerge with new generation emerging in both the countries. He said South Asia could have emerged as a big common market if Indo-Pak hostilities did not exist. Agreeging on the need for frequent people-to-people contacts, the Pakistani politician said the public in both India and Pakistan was eager to have good relations with each other but the "problem" lied with the leaderships of the two countries. Advocating "bold and flexible initiatives" from both sides, he asked "why cant the leadership in the two countries rise above petty politics? matters more serious than Kashmir issue have been solved across the world." Although his party is opposed to Pakistan President Pervez Musharraf, the Tehreek-e-Insaaf chief praised him, saying he had displayed "courage and sincerity" recently by proposing a roadmap for solution of the Kashmir issue. "He (Musharraf) has stuck his neck out. India should respond to his proposals," Khan said but noted that he did not approve of Musharrafs "misadventure" in Kargil. Responding to Khans proposal on elections, Abdullah pointed out that "free and fair" elections have been held in Jammu and Kashmir over the last five decades even as people in Pakistan-occupied Kashmir (PoK) and northern areas have been denied this right. Khan said a solution to the Kashmir problem lies with the people of Jammu and Kashmir and suggested that the leaders of the two countries be bold enough to translate the popular mandate. Showering praises on former Prime Minister A B Vajpayee for several initiatives he had undertaken, Mr Khan said he admired the Indian leaders sincerity. "I think, we should keep moving in that direction." Mr Khan did not agree with the suggestion of National Conference leader Farooq Abdullah that people-to-people contact and relaxation of rules alone would reduce the tension. "It is for the leadership of both the countries to take a decision." he said he was always for CBMs and a definite roadmap. On the leadership issue, he said people would follow any leader who had credibility. Asked whether Pakistan President Pervez Musharraf lacked credibility, he said let us wait till the next elections. Referring to the recent India-Pakistan cricket series held in his country, he said the situation had changed since 1979 when he visited India to play cricket. The people of both countries had tremendous enthusiasm for resolving the Kashmir issue. "If the people have such a will, why not their leaders," he wondered. Mr Abdullah said trust was the most important factor in resolving the Kashmir issue. Referring to Mr Vajpayees initiative after the Kargil war, he said the first step should be to allow free trade and free flow of information. Referring to Mr Khans suggestion for holding a free and fair election in Kashmir, including PoK, Mr Abdullah said India had held such polls in Jammu and Kashmir. "Let us start people-to-people contact." Meanwhile Imran Khan will soon visit Kashmir as India has agreed to grant him permission to tour the Valley. "I am extremely grateful to External Affairs Minister K Natwar Singh. He has assured me and agreed that the Indian Government will grant me permission to visit Kashmir," Mr Khan told reporters here. "I am so happy and enthusiastic about the visit...It is my childhood dream. My parents used to visit Kashmir before partition. My mother used to tell me a lot about the place," he said. The former Pakistan cricket captain said he has been invited several times by Kashmir university and other friends to visit the Valley. "But there have been many hurdles...Now, as the Indian Government has given the clearance, I will speak to them and then plan the visit," he added. Mr Khan said his visit will definitely send positive signals to the people of Pakistan and called for more such exchanges. "It is better if people like me visit Jammu and Kashmir rather than the cricket team," he said when asked if the Pakistani cricket team could play a match there.(Agencies) |
PCC-I delegation calls on PM, demands package Excelsior Special Correspondent New Delhi, Nov 5 : A high level delegation of Jammu and Kashmir Pradesh Congress Committee led by the president, Peerzada Sayeed called on Prime Minister Dr. Manmohan Singh here last evening. They submitted a memorandum of demands to the Prime Minister. This was disclosed here today in a joint press conference addressed by Mr Sayeed and Deputy Chief Minister Mangat Ram Sharma. Mr Sayeed said that high level delegation that called on the Prime Minister requested him to consider the demands included in the memorandum on the eve of his proposed visit to the state of Jammu and Kashmir. He said that the delegation also requested the Prime Minister to consider inclusion of these demands in the package which he intends to announce during his proposed visit to the State. Giving details, Mangat Ram Sharma said that the PCC(I) requested the Prime Minister that the Union Government should remove ban on recruitment in Jammu and Kashmir state because of rising ranks of un-employed youth. He said the delegation highlighted tremendous shortage of electricity which the State is facing. They requested that 10 more Hydel Power Projects may be taken up for construction. Saif-ud-Din Soz, MP said that the Prime Minister was briefed about shortage of Industrial growth in the State particularly in the Valley. He said that Fruit Industry is the only source of income which can provide employment to the large number of people, but the Industries needs modernization and announcement for some concession. Mr. Soz said that Dr Singh was kind enough to consider their demands and we hope that a special economic package will be announced by him during his visit. He said that some more demands such as upgradation of Horticulture, conservation of water bodies including Dal Lake, Wullar Lake, Mansar and Tsomoriri Lake were also discussed. He also said that the rehabilitation of Kashmiri Pandit Migrants and their return to their home with dignity and the problems of migrants of PoK who have migrated in 1947 and the Border migrants were taken up with the Prime Minister. Minister of State for R&B G.A.Mir said that a separate memorandum was also submitted to Prime Minister by his Ministry, in which we demanded reconstruction of road links, better communication facilities and reconstruction of damaged bridges ,and buildings. Earlier, in a memorandum submitted to the Prime Minister the delegation demanded special package for hydel power generation, improvement of sewerage system in Srinagar and Jammu, augmentation of water supply from river Chenab, developing tourist resorts, Horticulture sector in Jammu region, conservation of water bodies of Dal, Wullar, Ranjit Sagar and Mansar, rehabilitation of industry, rehabilitation of border migrants of Akhnoor sector and for one time settlement of PoK refugees. The delegation pointed out that ban imposed by previous Government on employment has badly affected the youth of the State and special job avenues be provided to J&K youth. The State is facing tremendous shortage of power while vast water resources are flowing wastefully. They pointed out that some important power projects like Sawalakot, Bursar in Doda, Pakal Dul in Doda, Uri-II , Parnal in Poonch, Kishen Ganga, Nimmu Basgo in Kargil, Panjtirthi Ujh in Kathua and Chowki Bal in Kashmir may be undertaken in the State Sector and sufficient funds be provided for the same. Special funds are needed to be provided for creating tourism facilities in Bhaderwah, Kishtwar, Poonch, Rajouri, Lakhanpur, Basohli, Bani, Sarthal, Ranjit Sagar dam site, Kargil and Leh. Sufficient funds are required for modernization and augmentation of water supply schemes in the State and improving sewerage and drainage system in Jammu and Srinagar cities. It is again urgently required to provide land to those families who have been living close to the LoC and the IB and are within firing range, at some safer locations as per promise made by Congress. They demanded funds for conservation of lakes like Wullar, Dal, Tso Moriri, Mansar and Ranjit Sagar. |
Amalgam refuses to hold
dialogue NEW DELHI, Nov 5: Just a few hours before commencing his three-day visit to Jammu and Kashmir, Home Minister Shivraj Patil today hoped that his efforts to bring the Hurriyat to the negoticating table would succeed even as the amalgam decided not to hold any dialogue with the Centre till its leaders were allowed to visit Pakistan. Speaking to reporters about his visit to the State, the Home Minister said, "our effort will be to talk. We will be happy if they respond and I hope they sometime later...I leave all this question open. We have already said we are for unconditional talks." He, however, refused to be drawn into any argument saying I dont want to discuss it any more. I have put it to them. In Srinagar, meanwhile, Hurriyat (moderate) chairman Mirwaiz Omar Farooq told reporters at the historic Jama Masjid after the Friday prayers that they had decided not to hold any further talks with the Centre. "We have decided not to hold any further talks with the Centre. We should be allowed to visit Pakistan first to hold talks with the Pakistani leadership...We have already held two rounds of talks with the Centre. Now, we just want to visit Pakistan first because it is one of the parties to the dispute," he added. The Mirwaiz said his group had not so far received any invitation from the Centre for the third round of negotiations. "We are not shying away from the dialogue process. Negotiations are the only way to resolve the Kashmir issue," the separatist leader said, adding that any meaningful dialogue with the Centre would be possible only after the Hurriyat leadership held talks with political and separatist leaders in Pakistan and Pakistan occupied Kashmir (PoK). "You can take it as a preparatory meeting to forthcoming visit of Prime Minister Manmohan Singh, who I have been told, will be visiting the State in third week of this month," he said. Patil said "I would acquaint myself with aspirations........And convey the same to the Prime Minister." Besides meeting Governor S K Sinha, Chief Minister Mufti Mohammad Sayeed and other political leaders and senior officials, the Union Home Minister will also take stock of the security scenario in the state with top security brass amidst reports of new militant training camps coming up across the borders. Asked whether the opening of new militant training camps meant that their number had gone up, officials said there was no increase as these camps had been relocated. Reports also suggested that launching pads for militants which had been closed down were being reopened. The ministry, which circulated a paper on the security situation in the State, said on the political front, Pakistan has launched another vigorous attempt to regain control of the secessionist movement by trying to unite them under Syed Ali Shah Geelanis leadership. Besides visiting the border areas in Jammu region where fence has been erected, Patil will hold meetings with civil, para-military and military officials including GoC of 14 Corps. The Home Minister, during his stay in the summer capital of the State, will also meet leaders of parties in the ruling coalition, MPs from the State, MLAs and MLCs, as also State secretary of CPI-M Mohammad Yousuf Tarigami, they said. Patil will discuss the security situation in the State with the General Officer Commanding, Northern Command, Lt Gen Hari Prasad, the sources said. Deputy Chief Minister Mangat Ram Sharma will host a lunch for the visiting dignitary while Speaker of the State Assembly Tara Chand will host him at dinner, the sources said. On Sunday, Patil will fly to Jammu to hold similar meetings there before returning here to brief the press at an Iftar party in the evening. He will visit Ladakh on November 8, they said. Patils visit comes ahead of the Prime Ministers visit to the State on November 17. The Home Minister will assess the situation in the State before Singhs visit, during which he is expected to announce an economic package for the State.(Agencies) |
Delhi based trader sold 10,000 fake certificates in Jammu By Sanjeev Pargal JAMMU, Nov 5: A New Delhi based businessman and an underworld don had pumped more than 10,000 fake certificates of different classes in Jammu and Kashmir during last about six years which, in turn, were sold to gullible youths by four racketeers of Jammu, according to the Jammu Crime Branch, which has taken up investigations in the largest ever fake certificates racket last week. Four accused including a retired Head Master and an Education Department official have made important disclosures during their sustained interrogation by the Crime Branch over last couple of days, DIG Crime Branch, J&K, Gulzar Singh Slathia, who was supervising the investigations in view of wide spread ramifications of the racket, told the Excelsior today. Although a number of rackets engaged in selling fake certificates had been busted in the past, this is for the first time that the Jammu Crime Branch has come across a racket, whose New Delhi based kingpin had pumped as many as 10,000 fake certificates in the State, mostly in the Jammu region. The kingpin identified as Vijay Kumar, who owned a printing press in Jamia Masjid locality in New Delhi, used to visit here every six to seven months and hand over 500 to 600 fake certificates to the Jammu based racketeers as sought by them for further providing to the unemployed youths. The certificates were published by him in his printing press in New Delhi. They nearly resembled to marks-sheets and diplomas issued by J&K State Board of School Education and Jammu University. Certificates of Matriculation, Higher Secondary Part-II and Graduation were issued by the accused by typing names and addresses of the gullible youths at a rate ranging between Rs 2000 to Rs 5000. "Rates of the racketeers depended upon the division and marks a youth wanted to fill in the marks-sheet and diploma", the Crime Branch sources said. Four local racketeers, who were arrested by the Crime Branch, last weekend have been identified as Master Pitambar Lal Sharma, a retired Government Head Master, a resident of Krishna Nagar, Miran Sahib, Vijay Kumar, an Education Department official posted in Government high school, Mareen, Pandit Ram Lal son of Isher Dass, a resident of Gole Gujral and Krishan Kumar son of Charan Dass R/o Chatha, Satwari. "We have started identifying the youths, who had taken fake certificates from the accused", the sources said admitting that it was a difficult process to trace them since the accused didnt know addresses of many of them. However, the accused confirmed that a number of fake certificate holders had managed to get themselves recruited in Army, para-military forces, Jammu and Kashmir Police, banks and other Government departments, the sources said. They disclosed that the racketeers had also set up their network in Rajouri and Poonch districts where they had sold about 1500 fake certificates, mostly in the rural areas. Investigations by the Crime Branch have also revealed that Pandit Ram Lal used to meet Vijay Kumar alone and purchased certificates from him in wholesale. Later, the certificates were distributed by him among three other accused. According to sources, the Crime Branch has alerted New Delhi police and other agencies for the arrest of Vijay Kumar. However, he has gone into hiding. Kumar was stated to be a resident of Himachal Pradesh but was operating from New Delhi. Meanwhile, Crime Branch today arrested two more accused in a bank fraud case. They have been identified as Sonu Kumar son of Darshan Lal and Naveen Kumar son of Ram Rakha, both residents of Ghou Manasan. Sonu posed himself as BSF ASI B S Negi while Naveen Kumar posed himself as BSF Sepoy Mohinder Singh. They had drawn Rs 75,000 and Rs 50,000 from Bank of Baroda fraudulently. The investigating agency has also recovered a Colour Television set and a scooter from the possession of another bank fraud accused Suresh Kumar, who was already in the Crime Branch custody. The CTV and scooter had been purchased from the money which was fraudulently withdrawn from the bank. The Crime Branch has also arrested one Mohd Amin of Sidhra in connection with a land scam. Amin and his mother Malika Khatoon had executed a fake sale deed on the name of Tabar Hussain of Mendhar for land at Sidhra. |
VHP snubs Advani, skips RSS meet HARIDWAR, Nov 5: The differences in the Sangh Parivar burst out in the open today with the VHP top brass boycotting the first days session of the RSS national executive here protesting the presence of BJP president L K Advani and demanding his party return to Hindutva ideology. However, both RSS and Advani sought to play down their absence, RSS leaders have also ruled out "for the time being" VHPs demand for floating a parallel political alliance. For the first time in the organisations history, VHP supremo Ashok Singhal and secretary general Pravin Togadia despite persuasion from the Sangh top brass including general secretrary Mohan Bhagwat, stayed away from the session even as they offered special prayer at a nearby Ashram. "We will not sit with Advani till the party completely returns to Hindutva. They not only abandoned the Ram Temple issue but also the protection of cow and river Ganga," a top VHP leader said on condition of anonmity. However, when contacted, VHPs senior vice president Acharya Giriraj Kishore, who is also camping in the holy city, said "the VHP leaders are offering `Anushtan (special prayer) for Hindu resurgence." With Advani leaving the meeting today for some "urgent party work," sources hinted that Singhal and Togadia may turn up for the second and final day of the meeting tomorrow. VHP sources also said they would be meeting the Sangh top brass on Sunday at a "private meeting." RSS spokesman Ram Madhav claimed at the press conference later that Singhal and Togadia were not present due to "personal reasons" and they had taken prior permission for the same. He, however, conceded that such an abstention was happening perhaps for the first time after VHPs formation. "These are family matters and they will be sorted out," he added. Emerging from the meeting, Advani said he was not "informed" that the VHP leaders had boycotted the meeting due to his presence. Sources said during the meeting, presided over by RSS chief K S Sudarshan and general secretary Mohan Bhagwat, various Parivar outfits were highly critical of the BJP for abandoning Hindutva ideology. Both Advani and his predecessor M Venkaiah Naidu informed them of the correctives being applied by the party. Meanwhile, RSS sources said the leaders, while being critical of BJP, have categorically ruled out any alternative to the saffron party as demanded by VHP. The Sangh leaders wanted to adopt "wait and watch" approach towards the party in the coming days. The criticism of the BJP within the parivar was so much that the discussion on three scheduled resolutions on pet issues like Bangladeshi infiltration had to be kept in abeyance, the sources said. SHO among 7 injured in Pahalgam blast Excelsior Special Correspondent SRINAGAR, Nov 5: Seven persons, including three Police personnel, sustained injuries when militants lobbed a hand grenade near Pahalgam Hotel at Pahalgam today. Sources said that 40 minutes after the Chief Minister Mufti Mohammad Sayeed left back for Srinagar, suspected militants lobbed a hand grenade on a Police party near Pahalgam Hotel at Pahalgam, at 1550 hours. It exploded, causing injuries to SHO Pahalgam, Inspector Shabir Ahmed, constable Zahoor Ahmed, constable Tanvir Ahmed and driver-constable Nisar Ahmed. Two passers-by, namely photographer Rajinder Singh R/o Tral and Abdur Razaq R/o Aeshmuqam, besides a female tourist from Kolkata, also sustained injuries. The injured were rushed to Anantnag and Srinagar for medical treatment. However, their condition was stated to be stable. Meanwhile, .12 bore rifle of a security guard of Jammu and Kashmir Bank, namely Mohamad Akbar Sheikh S/o Mohammad Rajab Sheikh R/o Nagnaar, Annatnag, went off accidentally at Wanpoh branch of the bank today. An orderly of the bank, Mohammad Yaqoob Dar S/o Ghulam Hassan Dar R/o Gundbal, Khudwani, sustained critical injuries and later died at hospital. Sources said that the guard, reportedly an ex-serviceman, was disarmed and detained at a Police station for alleged negligence in handling of his weapon. Meanwhile two persons got killed and six others sustained injuries when a Srinagar-Jammu Tata Sumo, JK03-1655, collided head-on with a speeding tipper, JK02G-1953, at Nepora Mirbazar, near Qazigund today. Sources said that a RAW official, namely Jasbir Singh of Fareedabad, and another commuter, Prem Singh of Mahore Udhampur, died on spot. Six more commuters of the ill-fated Tata Sumo sustained critical injuries. They were all evacuated and rushed to hospital. |

driver held Excelsior Special Correspondent SRINAGAR, Nov 5: While as Army today seized the vehicle, used by militants in yesterdays bank robbery at Imam Sahib, and also apprehended its driver, Police seized cash worth Rs 35 lakh and returned the same to the Jammu and Kashmir Bank authorities. Informed sources said that after looting the bank at Imam Sahib on Thursday, the militants had dropped Tata Sumo, JK03-9017, near Mohanpora Trenz. Troops of RR 55 Bn rushed to the spot and seized the vehicle. Sources said that militants, still hiding in the locality, opened fire on troops. Exchange of gunfire continued for about five months. As the militants vanished, troops seized the vehicle. A cordon-and-search operation was carried out in Khuram and Mohanpora villages but troops could not get any of the militants. Later, the owner and driver of the vehicle, namely Imtiyaz Ahmed Rather R/o Hillown was also apprehended and detained for sustained interrogation. During the preliminary questioning, he revealed that a group of militants took him on gun point and made him drive upto the bank at Imam Sahib. He stated that after looting the bank, the militants let him off at Mohanpora. Sources said that some eyewitnesses, who had spotted the words "Imtiyaz Coach" painted on the rear windshield of the vehicle, provided useful inputs to Army which swung into action and finally seized the vehicle alongwith its driver at Mohanpora today. While the Armys operation was underway, Police conducted a thorough search of the bank at Imam Sahib and found cash worth Rs 35 Lakh in an open locker. It was immediately seized under continuous videography and later handed over to the bank officials. Sources said that Police were investigating as to why the bank manager had not placed cash worth 50 Lakh in the iron safe inside the strong room. Police opened the iron safe and found a total of Rs 75,000 in it. Now, cash worth Rs 36 Lakh is missing from the branch. |
SC quashes Andhra Reservation Law NEW DELHI, Nov 5: Showing its strong resentment to the politics over caste reservations, the Supreme Court today quashed as unconstitutional an Andhra Pradesh legislation splitting the reservation in Government jobs for Scheduled Castes among four sub-groups of castes within SCs. A five-Judge constitution bench comprising Justice N Santosh Hegde, Justice S N Variava, Justice B P Singh, Justice H K Sema and Justice S B Sinha gave this ruling while setting aside a five-Judge bench verdict of an Andhra Pradesh High Court upholding the Constitutional validity of the law. The Government had notified Andhra Pradesh Scheduled Castes (rationalisation of reservation) ordinance on December 9, 1999 categorising the SCs into four groups of castes for the purpose of sub-dividing the 22.5 per cent reservation available to them in Government jobs. Allowing the petitions filed challenging the High Court order, the Apex Court said reservation must be considered from social objective angle, having regard to the Constitutional scheme, and not as a political issue. "Thus, adequate representation must be given to the members of Scheduled Castes as a group and not to two or more groups of persons or members of castes," it said. The bench said noting the very fact that the members of the Scheduled Castes were most backward amongst Backward Classes, it was not permissible for the Government to further classify them into sub-groups. Terming such micro-classification as violative of right to equality guaranteed under Article 14 of the Constitution, the Apex Court said "such classification of the members of different classes of people based on their respective castes would be violative of the doctrine of reasonableness." It said Article 341 of the Constitution provides that exclusion of "even of a part or group of castes from the Presidential list can be done only by Parliament". "State legislatures are forbidden from doing that," the bench said and added that the ordinance was "beyond the legislative competence" of the State Government. "An uniform yardstick must be adopted for giving benefits to the members of Scheduled Castes for the purpose of the Constitution. The impugned legislation being contrary to the above constitutional scheme, cannot, therefore, be sustained," the five-Judge constitution bench ruled terming the ordinance as "ultra vires" of the Constitution. On October 25, 1998, the Andhra Pradesh Chief Minister had convened an all party meeting on the issue and it was resolved that the permission of President would be sought. On November 29, 1999, the Ministry of Home Affiars, Government of India had conveyed the instructions of the President approving the promulgation of the ordinance. (PTI) |
Two ultras held, one surrenders Excelsior Special Correspondent JAMMU, Nov 5: Security forces today arrested two suspected militants from Kirpalpur in Domana area while another militants surrendered in Rajouri today. Defence sources said two militants were arrested this morning from Kirpalpur under the jurisdiction of Domana police station. They have been identified as Abdul Rasheed son of Abdul Bariq and Hafiz-ul-Rehman son of Khaleel Mian, both residents of Sonam Ganj. The militants have been shifted to a safer place for interrogation. Another militant Mohd Sharief son of Salal-ud-Din R/o Prankote, Udhampur, today surrendered before security forces at village Chana in Thanol area of Rajouri district. He handed over one AK rifle, six magazines, 157 rounds, one hand grenade and one radio set at the time of surrender. Sharif was an activist of Hizbul Mujahideen Pir Panjal Regiment (HMPPR). Security forces today busted two hideouts of the militants at Mohra Bachai in Surankote and Drabri in Doda. Recoveries made from the hideout include one AK rifle, four AK magazines, 175 rounds, one SLR magazine, six hand grenades, nine rounds pistol ammunition, 13 rounds Pika ammunition, one detonator and one camera. |
