He said tourism infrastructure is being expanded to cater to the requirements of the tourists. He said Development Authorities set up for planned development of tourist resorts by the coalition Government have done a good work and things would further start looking up in a due course of time that would help in popularizing various destinations of the State.

Referring to Pahalgam tourist resort, the Chief Minister said that in view of the vastness of the area, there is a greater scope for development and the Authority must prepare a perspective plan that should meet the tourist requirements over the years without disturbing the natural settings and environment.

The Chief Minister referred to the Indo-Pak ties and said that the peace initiative that Prime Minister Atal Bihari Vajpayee took from Kashmir is bound to fructify into a lasting peace. He said whatever happened last week, both nations know well that there is no way out except for pursuing dialogue as people of both countries overwhelmingly want friendly ties. He said the common minimum programme of the five-party coalition Government also specifically mentions that dialogue is the only alternative to address internal and external dimensions of Kashmir imbroglio and we are pursuing it. He said his Government would continue to follow this approach to the problem and is confident that a solution would be found out for a lasting peace. He said since the process is time consuming, the Government has to address other problems concerning day-to-day life of the people of the State.

Mufti Sayeed expressed optimism that Jammu and Kashmir would once again become an abode of peace and tranquility, not because he or his Government is endeavouring for it but because it is the resolve of the people of the State.

The Chief Minister said that Jawahar Institute of Mountaineering is being shifted to Pahalgam and then to Aru that would also give boost to adventure tourism.

Deputy Chief Minister Mangat Ram Sharma said that the successful conduct of Amarnath yatra in which 1.56 lakh pilgrims participated, arrival of more than 1.60 lakh tourists in Kashmir valley, holding of Inter-State Council meeting and over 100 national and international conferences, Congress Chief Ministers’ conclave in Srinagar and visits of President, Prime Minister, Congress Chief and nearly 440 MPs in connection with parliamentary standing committees meetings have helped in restoration of normalcy in the State.

The inauguration of the function was marked by a large participation of locals. Several tourists were also seen in the crowd.

Chief Executive Officer, Pahalgam Development Authority, Abdul Latif Deva assured the Chief Minister that the Authority will come upto his expectations and the resort would be developed as round the year destination.

Earlier, as part of the fortnight long festival, the Chief Minister laid foundation stones of two projects. One related to setting up of Kolhai Park spreading over 150 kanals. It will involve a cost of Rs. 20 lakh. The second project is municipal shopping arcade involving Rs. one crore. As many as 125 shops are proposed to be constructed which include 25 shops reserved for shopkeepers affected by beautification drive at Mina Bazar and Bus Stand. The project taken up by Pahalgam Development Authority is self-sustaining and environment friendly.

It was an event marked by festivity, riot of colours, excitement and enthusiasm of participating gathering as well as the artists.

The festival began with wan wun, traditional marriage song sung by Kashmiri women on the arrival of the bridegroom.

About two dozen cultural items were presented, each was better than the other, with a total involvement of hundreds of participating locals who had come with their families in a typical festive mood, and some tourists.

The two and a half hour programme was the beginning of such musical and cultural feast that the tourist festival would unfold on the weekends during the fortnight. It was an effort widely appreciated by one and all.

Deputy Chief Minister Mangat Ram Sharma announced a prize of Rs. 50,000 on behalf of the Chief Minister and another of Rs. 25,000 on his own behalf for the students of various educational institutions who participated in the cultural bonanza at the festival.

Jansangh files petition in Supreme Court
for scrapping Art 370

Excelsior Correspondent

JAMMU, Oct 4: Veteran leader and president of the Akhil Bharatiya Jan Sangh, Prof Balraj Madhok has filed a petition in the Supreme Court for scrapping Article 370 of the Indian constitution, This was disclosed by Ponam Raj Prohit, general secretary of the Jan Sangh while addressing a press conference today.

Mr Prohit recalled that Sardar Patel had merged over 500 princely states into India. "However, it was because of Pandit Jawahar Lal Nehru that special status was given to the State of Jammu and Kashmir under Article 370 as temporary provision", he said, adding, "there is no definition of the word ‘temporary’ in the constitution".

Defending the demand of scrapping Article 370, Mr Prohit said that over one lakh Hindu refugees entered Jammu and Kashmir after partition in 1947 but still today they donot have right to vote for the candidates in the Legislative Assembly due to Article 370. He said that Article 370 is the discriminatory violation of Article 14 of the Indian Constitution.

He argued that there was no need to get the recommendation of J&K Legislative Assembly for scrapping Article 370 as the President of India vests the power under Section of 3 of the Article 370 to scrap the same without the approval of J&K Legislative Assembly.

Mr Prohit also supported demand of the reorganisation of the State and said that political and economic aspirations of the people of Jammu, Kashmir and Ladakh will be fulfilled only after reorganising the State.

Jansangh leader further stressed on the need of curbing terrorism with iron hand. He said that there was a need that those who aids and support the militancy will be dealt strictly. He was of the opinion that just instead of blaming Pakistan for spreading terrorism, Indian Government should take strong steps to curb militancy.

Legal Line
Cow slaughter is an offence under RPC

By Rajesh Bhat

Dear Readers: We are in the maiden issue of Legal Line and in this issue, we have taken up RPC and how it is different from IPC. We seek readers’ suggestions to make this column more interesting so that it could benefit the common men, who are one way or the other connected with law. We will be happy to solicit your views and incorporate the same in our future columns. Such Advocates, who want to talk about the particular issue, may contact us directly any time without any inhibition. The basic idea of this column is that people should know law and the rights which they enjoy under Indian Constitution. Contact us on Legal-Line, C/o Daily Excelsior Janipur Jammu any day so that your view point on a particular subject could be projected in the right perspective.

The recent move of the Centre to introduce a Bill on ban of cow slaughter, could not be passed due to certain reasons, but the ban on cow slaughter was imposed in the State of Jammu and Kashmir way back in 1871 when Maharaja Ranbir Singh was reigning the State. The Maharaja had visualized that such a ban was necessary in the Princely State of Jammu and Kashmir which comprised the people of different regions and religions.

Maharaja Ranbir Singh could not, however, codify the law which included banning cow slaughter in the State. It was only in 1932 when Maharaja Hari Singh codified the separate law for Jammu and Kashmir and named it after his grandfather as ‘Ranbir Penal Code’ (RPC)

It is this Ranbir Penal Code that is still in force in Jammu and Kashmir and all criminal laws have been incorporated and dealt under this Code. Since Jammu and Kashmir was not part of British India, a separate law/code was formulated for the State and the same was dedicated after the name of Visionary Maharaja Ranbir Singh who had taken several revolutionary steps during his rule as the King of the State.

According to noted and Senior Advocate Mr SS Anand Lehar, Ranbir Penal Code is infact the replica of Indian Penal Code (IPC) but with a difference that it carries a ban on cow slaughter and an act of adultery is an offence under this Penal Code. These two offences are no where in Indian Penal Code.

Mr Leher said that IPC in the shape of RPC was enforced in erstwhile J&K State under Indian Law Department Notification Number 23-L/1989, dated August 6, 1932 and RPC was made applicable to the entire State of Jammu and Kashmir including that area which is presently under the illegal occupation of Pakistan.

Mr Lehar says that under IPC, cow slaughter is not an offence, while’s under RPC the same has been incorporated as a major offence under Section 298-A RPC. Under this Act, all bovine animals come, including buffalo, ox etc. And if a person is convicted under this Act, he/she can be awarded 10 years imprisonment with a fine. Similarly, adultery is an offence under this Penal Code.

Elaborating ‘adultery’, Mr Lehar says that if ‘A’ is a man and has illegal relationship with ‘B’ who is a wife of ‘C’ then both ‘A’ and ‘B’ are tried under RPC while’s in case of IPC, only ‘A’ is held guilty.

These two basic differences make RPC different from IPC. Rest of the sections that are carried in IPC are the same that have been adopted in Jammu and Kashmir under the name and style of Ranbir Penal Code.

Sri Rama and Sri Rama alone is nothing
exists at all: Swami Paul

Excelsior Correspondent

JAMMU, Oct 4: Navratra festival organised by Swami Paul’s Meditation Home, Jammu concluded here with the ‘Puranahuti’ of Maha Gayatri Yagna on Mahanavmi day today.

During the 9-day festival, apart from Gayatri Yagna every morning, the ‘Dhayana Sessions’ followed by Kirtan and devotional songs were held. The presence of the spiritual head of the Meditation Home Swami Paul Ji Maharaj and his divine guidance in each spiritual activity was regarded as a valued treasure by the participants. The disciples also exchanged their views regarding the role of religious values in daily life to achieve spiritual elevation. Large number of devotees from various parts participated in the festival.

Through his discourse on the concluding day, Swami Paul discussed various aspects of spirituality. Swamiji explained that continued recitation of the names of Shri Rama is a panacea for all ailments and put an end to all troubles. It ends all misfortunes. In this area of unrest and turmoil, afflicted with the mental and bodily anguish, obtuseness of understanding and egotism, distemper and grief, animosity and ill will, rivalry and strife, enmity and violence, discord and poverty and divine name alone is the sovereign recipe for riding the living beings of the whole universe of all the aforementioned afflictions and visitations and bringing all round happiness to them as well as for enabling them to attain the ultimate and supreme goal of human life in the shape of final love for the supreme God.

Swamiji described the repetition of the blessed name of the lord is open to men and women of all classes and communities. This alone constitutes the "sum mum bonum" of life. One need not to go out in search of God. One need only to fasten the mind on Him, purging it of everything else. The reality will then surely come to view of itself. Realinging that "Sri Rama and Sri Rama alone is....nothing exists at all’; you have achieved the object of your life. The individual self is so fully and wholly one with the "Brahma" that he is only removed from it by the thin veil of Maya or elusion; which vanishes with the downing of the knowledge of the true and original status of its perfect identity with the absolute.
