Lt Col, others acquitted after 25 years of trial Excelsior Correspondent JAMMU, Nov 3: Special Judge Anti-Corruption Jammu, Mr MK Hanjura, in a landmark judgment has acquitted Lt Col AN Seth, Raghubir Dass Malhotra, Hans Raj Naik, Havildar Gouri Sahay, Havildar Sahib Singh, Chaman Lal and Madan Lal, the canteen contractors of 216 Transit Camp Canteen from the charges of corruption, conspiracy and embezzlement after a trial of 25 years. The case against the accused was during 1976 to 1978 when Lt Col Seth in the capacity as Sub Area Commander was the Chairman of Sub-Area Station Canteen. RD Malhotra was the Manager of the Canteen whiles Chaman Lal and Madan Lal were the canteen contractors and other accused were salesman and Store-incharge of the canteen. Lt Col Seth used to purchase on his credit his house-hold items and liquor from the private contractor to the tune of Rupees 16,670 at the end of January 1977. Col Seth with a view to overcome the difficulty of liquidating such huge debit entered into criminal conspiracy with other accused and with a common object some of the duty free rum, meant for armed forces personal only, illegally into the hands of contractor for sale at the rate of duty paid or at the rate higher than the duty paid at the canteen. On the complaint, a case was registered by Central Bureau of Investigation (CBI) and after completion of the investigation, the challan was presented in the Court of Special Judge, Anti-Corruption Srinagar. The case was transferred from Srinagar to Jammu by the order of the High Court. In his 20 page judgment,Mr Hanjura observed that the accused have committed the crime imputed to them from 1976 to 1978. The accused have been charged in a single trial which was in violation of the mandate of law, which clearly admits of trial of any number of act of breach of trust committed within a year as amounting only to one offence and this being so, the instant case suffers from the vice of mis-joinder of charges which is clearly against the statutory law. The Judge maintained that the investigation and the trial of the case has been stretched unreasonably to a long period of over 25 years, when some of the accused have already entered in their 9th or 10th decades of life. With these observations, the court acquitted all the accused. |

Public Opinion By Gopal Sharma JAMMU, Oct 3: Mixed response has been observed from the representatives of various Jammu organisations and intellectuals over the bandh call given by some Jammu organisations on the opening day of the Civil Secretariat after shifting of the capital to Jammu. Former Vice-Chancellor of Jammu University Prof M R Puri expressed that the people of Jammu who are dissatisfied with the past and the present Government have the only democratic way to express their resentment by giving bandh call on this day. The people feel that by lodging their protest they can raise their problems in a big way before the Government. But the problems can also be raised at some other occasion. Shifting of State capital to Jammu for winters is really a welcome occasion. A large number of people from Jammu region are benefitted with the shifting of Capital to Jammu. Otherwise they have to move to Srinagar for any work in the Secretariat. Earlier, some city organisations gave bandh call for certain years and it has now become symbolic. The Kashmiris should not feel it that they are not welcomed here and a wrong signal should not go from here. The people are infact against the system. The Government should also realise its responsibility and should try to remove discrimination and resolve the general problems of the people here. Only then it can be welcomed here. This time several organisations rendered support for this cause and it shows that people are not happy with the present system. Dr Rama Kant Dubey, state unit president of Vishav Hindu Parishad expressed that in a democratic country the people have right to give bandh call and hold demonstration to raise their issues in peaceful manner. The intension behind giving bandh call on the opening day of Civil Secretariat here is to draw attention of the Government towards the basic problems of the people here and not to create violence or to hishonour the Kashmiri employees or officials in Jammu. It is not customery but issue based protest by the Jammu organisations against the past and the present Governments which have always caused discrimination with the people of Jammu. The people here strongly express resentment against the Government attitude and warn it to treat Jammu of people equally and ensure fair justice with them. There is no change in the attitude of the Mufti Government also and therefore, people of Jammu against went for protest demonstration on the very first day of the functioning of Darbar Move offices. The problems of Jammu can only be resolved with the creation of separate state and even Centre has always given preference to Kashmiris whether Hurriyat people of others. He confessed that protest can also be held on any other day but the organisers referred this day and it was their decision, we have nothing to say about it. Moreover, they garnered massive support this time. President Muslim Federation Jammu, Mr Abdul Majid Khan said that bandh call on the opening day of the Civil Secretariat is not justified as with the Move of the offices, Jammus people are benefitted. The trade and industry grows well and moreover, people feel convenience to get their works disposed off in the Secretariat when it is here in Jammu for six months. It is politically motivated as only one group of the city for some vested interests and also to display its power holds protest and gives bandh call and it has now become the routine practice. There are other means to convey public resentment against the Government moreover, such bandh calls will send wrong signals to other quarters. At least Jammu organisations behind this bandh should take all the communities into confidence becuase their interests are also common. It can be held on any other day. " We should welcome the opening of Darbar Move offices in Jammu", he maintained. Veteran jouranlist Mr Balraj Puri, however, expressed that people have the right to lodge their protest against the Government in support of their issues but a wrong signal should not go to the public. There is no doubt that shifting of capital to Jammu for six months is a welcome occasion for the people of this region as they can move to Move offices freely for different works of their interest. They can discover other ways to lodge their protest and raise issues. They should also take various people into confidence and the they should be very clear on the issues. It is also true that sense of deprivation is prevailing among the people here and they do not have other option show expressed their resentment. The people should not be given an impression that they are against the people of Kashmir. They should send clear signals that people are against the Administrative system and Government and were never against Darbar move. Mr Ram Sahai, president Jammu Chamber of Commerce & Industry when contacted said that sentiments of the people of Jammu are involved because they are being discrminared. But we hardly find any effect on the Government of this bandh on the very first day of the functioning of Move offices in Jammu winter capital. He admitted that there were other ways to lodge protest and raise issues. A table talk can be held with the Government on the basic issues. But this bandh is not against the Move or show disrespect towards people of Kashmir. This has been against the Government and its attitude towards the people of Jammu. The question of going wrong signals to other side does not arise because protest is always against the Government and its policies and not against the Darbar Move or the people of Kashmir, he maintained. |

He said the company has liquidated all its loans and is debt free and has for the second consecutive year paid Rs. 45 lakh as dividend to the government. To reduce the production cost, the company has, for the first time, manufactured large quantities of blended cement using fly ash, Mr Sharma added. He said the Government has laid emphasis on revival of sick units, as according to the survey nearly 50 per cent of the 36000 SSI units operational in the state prior to militancy, has gone either sick or defunct. He said an attractive package is being offered to these unit holders for reviving these units. To ensure quality and uninterrupted power, the Government is planning to segregate and provide dedicated power supply for industries, he said and added that entrepreneurs would be welcome to set up hydro power projects to generate more power. The Government also plans to rationalize the items on the negative list. He laid stress on creating awareness among the prospective entrepreneurs about the incentives being provided by the Government under the industrial packages for promoting industrial investment in the state. He asked the officers to provide required infrastructural facilities to the entrepreneurs and help in establishing such units in the state for which the state has raw material available locally. He asked the Principal Secretary Industries to immediately clear all the pending proposals and also monitor the progress on the cases referred to the Centre for clearance. |

Interview of the Week By Dinesh Manhotra Initially it was looking as routine Yagna but with the passing of days Ati Vishnu Maha Yagna is becoming a historical event in the history of the City of Temples. For the last two days, lakhs of people have visited the Yagna to participate in the Parikarama. Main source of this Yagna is Balak Yogeshwar Dassji Maharaj of Badrinath Dham who orginally belongs to the Pouni area of Reasi. Balak Yogeshwar Maharaj himself was not expecting such over-enthusiastic response from the people of Jammu region. Due to financial constraints and non-availability of Yajmanas, the proposed Yagyashalla of 1296 Kundas was curtailed to just 100 Kunds but encouraged by the response of the people Balak Yogeshwar is determined to complete Yagna of 1296 Kundas very soon. Balak Yogeshwar returned to his birth place after 21 years and as per Hindu rituals he formally took Bhiksha from his mother. Interacting with EXCELSIOR, Balak Yogeshwar discloses reasons for organising such a big Yagna in the City of Temples. Excerpts. * Why you have chosen Jammu as a place to organise such a big Yagna despite being the fact that this area is gripped with terrorism ? Main aim of our Yagna is to restore peace in the universe in general and India in particular. Being crown of the nation, we have to start every good work from Jammu and Kashmir. This State is also land of Rishi Munies and Devatas so we decided to organise Yagna at this holy place. Secondly, our aim is to restore peace so we thought that Yagna must be held at that land which is plagued with violence. * Are you expecting such a over-whelming response ? Being son of this land, I am very much aware that people of Jammu are very religious minded. I have visited many places but I never found people as devoted and religous minded as people of Jammu are. I am really happy to see response of the people in the Yagna. With the blessing of Thakurjee (Lord Krishana) we are organising this Yagna so we were expecting such a response. *Your aim of organising this Yagna is to restore peace. Do you think that peace will be restored in this region ? No doubt about that. We are confident that peace will be restored in this region as like all prayers the Yagna prayer occupies a most important place in Hindu scriptures, most revered and a paramount importance, a sacred prayer to attain spiritualism as well as to save the universe from deluge and disaster. We are expecting that after the culmination of the Yagna, there would be some visible results of purification. *You mean that through the power of prayer we can attain peace? Of Course. The power of prayer is universally acknowledged. When in trouble, one often finds oneself very isolated, vulnerable and characteristic testing. In order to emerge triumphant from the ordeals one needs to draw upon ones inner reserve of fortitude. One discovers hither-to-unknown channels to the Supreme Being and realises that even when ordinary mortals are unable or unwelling to come to ones aid. He is ever ready to answer to the call of distress. * What are others importance of Yagna ? The Yagna, when performed, jointly amidst chanting hymns and recitation of Mantras, is to invoke the blessings of God to strengthen the devotees resolve to overcome even seemingly insuperable odds. The practice of Yagna can easily be gauged and discerned almost all the religions, sects, communities all over the globe. The Agarbaties, Dhup and other modes, in religious functions are used in particular to sanctify the atmosphere and remove the environmental ill affects and impurities. The contents in the preparations and manufacturing these articles are aforesaid, by and large, have similar resemblance to Havan Samigri, used in oblations, if not total. Therefore, there is no second opinion, as general believed, these rituals are observed with the aim to achieve happiness of human beings. The Vedas laid much emphasis on Yagna rituals but with the changing time this aspect is getting ignored, nevertheless, still it continues when the people face drought like situation. There are certain countries, which have realised the value of Yagna, observe it in one form or the other. Keeping in view its importance, the countries like America, Chile, Poland, Germany etc adhere to the practice more or less on the lines similar to what we have with us. |
