Convention of
Panchayat representatives held
Panchayati institutions will
be given legitimate
powers: Mangat
Excelsior Correspondent
JAMMU,
Dec 24: Chief Minister, Mufti Mohammed
Sayeed was scheduled to inaugurate the convention
on Panchayati Raj Representatives at Abhinav
Theatre here at 10.00 am.today. When the punctual
Chief Minister reached at dot 10, to his
surprise, he found a different story
all-together. There were few takers from audience
and almost no organisers except one present at
the venue to listen to the Chief Minister. Only
Mr Balraj Puri- director of the Institute of
Jammu and Kashmir Affairs, was there to receive
Mufti Sayeed, who ultimately left the venue in a
huff.
Deputy Chief
Minister, Pandit Mangat Ram Sharma, who was also
scheduled to address the gathering, later
inaugurated the convention. By the time Mr Sharma
was at Abhinav Theatre, the audience and the
organisors had started tricking-in. The
convention was organised by Institute of Jammu
and Kashmir Affairs and Institute of Social
Science, New Delhi.
In his address, Mr
Sharma assured the gathering that the position of
the Panchayat Raj system will be restored in
Jammu and Kashmir and elected Panchayats will be
given their legitimate rights.
The Deputy Chief
Minister said that Panchayats were the foundation
of the democracy and equipping of Panchayats with
legitimate powers were essential for
strengthening democratic institutions.
He, assured the
gathering that new coalition Government headed by
Mufti Mohammed Sayeed will take effective steps
to make Panchayati Raj system functional.
Responding to the
issues discussed in the convention, Deputy Chief
Minister assured that evaluation of Panchayati
Raj Act 1989 will be made and efforts will be
made to implement 73rd and 74th constitutional
amendments acts in Jammu and Kashmir also to make
Panchayati Raj system functional.
Stressing on the
creating awareness among representatives of
Panchayats, Mr Sharma said that Panchayats can
play a dominant role in bringing radical changes
in the society.
Dr George Mathew,
Director Institute of Social Science, New Delhi,
Mr Balraj Puri, Mr L C Jain and others addressed
the convention.
The theme of the
convention centres on the notion of awakening.
The Panchayat System in Jammu and Kashmir is an
evolution from the 1935 Jammu and Kashmir Village
Panchayat Regulation No 1, and is currently a
latent manifestation of the Jammu and Kashmir
Village Panchayat Raj Act, 1989. It is thus
alive, albeit in a dormant State. It was believed
that by awakening the issues that hold Panchayat
powerless, one can awaken the debate of
strategies for overcoming the current challenges.
By awakening this debate, speakers hope to bring
about reforms to the current structure and
mechanisms that will naturally inspire social
change.
It was observed in
the convention that the success of the
Congress-PDP coalition in Jammu and Kashmir will
be gauged on their ability to bring about this
change. Speakers said that it was an imperative
time to discuss the most effective and most
efficient means of rural development by bringing
together the major players from the State and
Panchayat bodies.
Major areas of
concern from the conference were - establishing
Panchayat at the block level to mitigate between
the State Government and the Village Panchayat,
evaluating the current Panchayati Raj Act, 1989
and identify shortcomings and possibilities for
amendment, assessing fiscal efficiency and fiscal
relations between the State and the Panchayats.
The conference
also stressed on identifying the role of NGOs and
the voluntary sector, understanding issues
surrounding militant influence in village
affairs, ensuring transparency and accountability
in Panchayat affairs, identifying the roles of
Panchayat in community development, rural health,
education, poverty alleviation and local
infrastructure such as roads, education,
irrigation and electricity.
The Institute of
Social Science has taken considerable strides in
voicing the concerns of the J&K citizens
through recent election study highlighting the
central political and social issues of the
electorate. Their results have received
widespread acclamation from media organisations,
activists and concerned citizens. Institute
dedication to the people of the State is seen
also its work in Jammu and Kashmir State
Development Report, conducted on behalf of
Planning Commission, aimed at specific policy
recommendations for the Central Ministry, and our
various State specific publications including
Panchayati Raj in Jammu and Kashmir. Our mandate
is to conduct socially relevant research with the
aim of inspiring an action oriented public
opinion, hence the reason for this conference.
Our goal is twofold. First, it is to bring
Panchayat leaders together to discuss the current
challenges facing grassroots democracy. Institute
understand that only villagers know village
problems and we understand our limitations being
outsiders to both the area and the issues.
Second, by bringing these issues to light,
Institute has to awaken these grassroots
institutions, transforming them from their tired
State into a meaningful, flourishing institution.
By analyzing the current limitation and
challenges in regard to the official State
policy, Institute can take the first step in
awakening the spirit of participatory development
in a participatory democracy.
Regarding status
of Panchayati Raj in Jammu and Kashmir, it was
observed that the differences in political and
social dynamics of Jammu and Kashmir are both a
source of pride and a cause of alienation amongst
the population. The diverse history has led the
State in a different direction than the rest of
India, providing a central influence to the
federal make-up of this country. However, this
diversity has thrown un unique challenges in the
political mechanisms of the State, particularly
in regards to the Panchayati Raj institutions.
This can be seen in that the State is under no
obligation to adhere to the provisions of the
73rd and 74th constitutional amendments,
including the 33 percent reservation for women
and reservations for the members of the SC and ST
communities.
It was observed
that the current reality facing the Panchayat
System in Jammu is bleak, as today they are
effectively non-functioning. First, elections
have yet to be held at the block and district
levels preventing any sort of Panchayat-State
relations. Second, although all Govt schemes are
available to the Panchayats, the 73rd and 74th
amendments are not applicable in the State,
currently adding to the painstakingly slow rate
of rural development and maintaining general
ignorance towards Govt schemes and assistance.

of the rules in force. No Objection Certification

establishing un-authorised college like those run
without the permission of the Government and
those affiliated to a University with its seat
outside the J&K State. However, an exception

centres affiliated to the IGNOU and DOEACC
Society, Government of India.
Besides the Act,
provides for regulating the appointment and
service conditions of the staff, admissions of
