JAMMU, May 29: Vigilance Organization, Jammu today booked then Executive Officer, Municipal Council Udhampur and others for making construction in violation of building permission.
A case under FIR No.21/2017 u/s 5(1) (d) r/w 5(2) J&K PC Act and Section 120-B RPC, has been registered against Ravi Kumar, the then Executive Officer, Municipal Council Udhampur and the beneficiaries namely Neeraj Gupta and Dheeraj Gupta, sons of Rattan Bushan of Ward number 2, near Ram Leela Ground Adarash Colony Udhampur.
The case has been registered on the basis of a verification conducted into the allegations that Neeraj Gupta and Dheeraj Gupta had made constructions in violation of building permission/sanctioned plan. Verification revealed that residential building permission vide order No. MCU/2011-12/1202 dated 28.09.2011 was issued by then Executive Officer in favour of the beneficiaries with permission to cover 3189.5 Sq ft. at ground Floor and 2582 Sq ft. at first Floor. However, the applicant covered 95 percent of the plot area in league with the accused officials of Municipal Council and constructed 4835.5 Sq ft more than the approved plan.
In order to cover-up the violations and to provide sufficient time to the beneficiaries, a mere formality of issuing notice under section 7(1) was conducted, but no action as warranted under section 7(3) of Municipal Act was under taken.
Thus, the intentional inaction by the accused public servant in league with the beneficiaries paved the way for the beneficiaries to raise the construction in blatant disregard and violation of building permission rules/law.
The investigation of the case has been taken up.
