JAMMU, Dec 31: State Vigilance Organization has booked then CEO Patnitop Development Authority and others for granting illegal building permission.
A case under FIR No. 32/2016 has been registered under section 5(1)(d) read with 5(2) J&K PC Act Svt 2006 and 120-B RPC on the basis of a verification conducted into the allegations that the officers/officials of Patnitop Development Authority (PDA) permitted Shakuntla Kotwal wife of Late Omkar Kotwal of village Karlah Patnitop to raise construction of a hotel without any valid permission and in violation of laid down terms and conditions.
No NOCs were obtained from Forest Department, Pollution Control Board, Fire & Emergency Department and Town Planner, which clearly shows that the officials/officers of PDA in criminal conspiracy with members of Building Operations Controlling Authority (BOCA) acted with dishonest intention to benefit Shakuntla Kotwal in utter violation of the prescribed formalities required for raising construction of the building at village Karlah Patnitop.
The verification reveals that there were seven members of BOCA, which had to grant permission. These members included AC(R) Udr-Doda, XEn PDD Udhampur, XEn PHE Udhampur-Doda, XEn UEED, Town Planner UDR-Doda, DFO Udhampur and Chairman (BOCA), who was CEO PDA at that time. On the permission granted in favor of Shakuntla Kotwal, there are signatures of only AC(R) Udr-Doda and no other member of BOCA including then chairman K K Gupta (CEO PDA), has appended signatures on the said document, which is glaring and physical manifestation of criminal misconduct on the part of concerned officers/officials of PDA and members of BOCA.
Verification also reveals that the permission was granted without verifying/clarifying the exact location of the site and whether the same falls under market commercial complex or otherwise. The verification further reveals that no NOC was obtained from the Forest Department as well as from the State Pollution Control Board and also final NOC was not obtained from Fire and Emergency Services Department.
The verification has established criminal nexus and abuse of official position by the then Chief Executive Officer PDA and others to confer undue benefit to Shakuntla Kotwal for granting illegal building permission.
