SJA organizes workshop on Intl Humanitarian Law

JAMMU, Mar 26: State Judicial Academy in collaboration with International Committee of Red Cross (ICRC) today organized one day workshop for District and Sessions Judges and Chief Judicial Magistrates of Jammu province on International Humanitarian Law.
The workshop was organized under the guidance and patronage of Chief Patron of State Judicial Academy, Justice R Sudhakar, Acting Chief Justice and Governing Body of the State Judicial Academy, Justice Alok Aradhe, Chairman, Justice Ali Mohammad Magrey and Justice Janak Raj Kotwal, Members.
Justice Alok Aradhe, Chairman, State Judicial Academy, in his inaugural address, said that several provisions of Constitution make direct or indirect references to international law. “High Courts and Supreme Court have increasingly relied upon international treaties and customs particularly, in the sphere of human rights and environmental law”, he added.
Justice Janak Raj Kotwal, in his special address, emphasized that everyone has right to life, liberty and security of person. “The right to life is undoubtedly the most fundamental of all the rights. All other rights add quality to the life. Right to fair and speedy trial flow from Article 21 of the Constitution”, he added.
Rene Boeckli, Deputy Head of Delegation ICRC Regional Delegation, New Delhi gave an overview of the programme and deliberated upon the importance of the programme for the Judicial Officers who are day in and day out interpreting, expanding and creating the law.
Earlier, Abdul Rashid Malik, Director State Judicial Academy highlighted the importance of Article 21 of the Constitution of India and said that right to fair trial is not only integral part of Article 21 but also part of Article 12 of Universal Declaration of Human Rights. “Supreme Court has held that denial of fair trial is the crusification of human rights”, he added.
In the 1st working sessions, Prof Manoj Kumar Sinha, Director, Indian Law Institute and Supriya Rao, Legal Advisor, ICRC deliberated upon the basic principles of Indian Humanitari-an Law and interplay between International Humanitarian Law and IHRL and in the 2nd Session Prof  Sri Krishna Deva Rao, Vice Chancellor, National Law University, Odisha along with. Fahad Ahmad, Legal Advisor, ICRC deliberated upon ensuring Judicial Guarantees and Preventive Detentions.
There was very lively and creative interaction between the participants and Resource Persons.
