JAMMU, Dec 3: M/s Sanyog Enterprises Private Limited has rejected allegations of fleecing the patients/customers by selling them the medicines at comparatively higher rates than the price being charged by the other chemist shops in the market.
In a press release issued here, the company refuted allegations that M/s Sanyog Enterprise is fleecing the patients/customers by selling them the medicines viz Enclex-60 and LMWX-60 at comparatively higher rates than the price being charged by the other chemist shops in the market.
“The order in question passed by Drug Inspectors Jammu on December 1 is against the principles of natural justice and speaks of gross injustice, statutory violations of the provision as contained in Drugs and Cosmetic Act 1940 and Drugs and Cosmetic Rules 1945 as no prior notice for disallowing or suspension of license to run the pharmacies in question has ever been issued”, the release said.
The company said that notice is misconceived, as the terms of contract mandates sale of drugs at 10% discount on MRP. The Sanyog pharmacies have not sold any drug at any of its outlet at a price higher than MRP or less than 10% discount on MRP, as all the drugs are sold at lesser rates than printed MRP thereon.
The drugs in question Enclex -60 and LMWX-60 have printed MRP of Rs 581.10 and Rs 581.07 by their manufactures viz. Cipla and Abbott, respectively. Sanyog pharmacies are bound under the provisions of terms and agreement of tender to allow only 10% discount on MRP of drugs allegedly in question. However, all pharmacies of Sanyog are selling the said drugs at a discount ranging from 45-55% at these MRP.
Stating that the allegations in the notice are grossly misplaced, the company urged the Drug Controller to withdraw the order of suspension of Sanyog pharmacies immediately.
