Srinagar, Apr 21: High Court today directed Central Government to provide the check list of mining places to the petitioner to enable him to file the combined check list of all mining sites before the court.
The Division Bench of Justice Ali Mohammad Magrey and Justice MK Hanjura directed the counsel representing Central Government-Tahir Shamsi (ASGI) to provide the check list to M I Qadri Senior Advocate appearing in the petition so as to enable him to finalize the combined check list and submit the same before the court.
Check list has been sought from all the concerned in order to ensure the proper safety of mining places as also individuals across the State.
During the proceedings of the case, court has been informed that check list has been prepared by all except Central Government and copies of the check list have been furnished to Advocate Qadri who has to submit the final check list before the court as per directions.
Qadri submitted before the Court that Central Government has not furnished the check list so as to enable him to finalize the check list to be submitted before the court. Advocate Shamsi ASGI, submittedthat he has received copy of the check list and shall provide it to Qadri within a period of one week.
Court directed that on receipt of the check list from Union counsel, advocate Qadri shall ensure finalization of the process of formulation of the check list and file the same before this court on the next date of hearing.
Counsel representing in the PIL submitted before the Court that the authorities particularly Commissioner Secretary Industries & Commerce Department as also Director Geology & Mining have ignored the objective of supervision and inspection of the mining activities in the State which has adversely affected the landscape and has caused heavy loss of lives, property and has adversely affected the environment besides polluting air, water and soil.
