Prosecution failure leads to acquittal in murder case

JAMMU, Apr 28: Principal Sessions Judge Reasi S R Gandhi has acquitted Sukhdev Singh, who was involved in a murder case.
As per the prosecution case, on 19.04.2013 an information from reliable sources was received by Police Post Thub on 18.04.2013 accused Sukhdev Singh trespassed into the house of Pritam Singh at village Thub and committed his murder by inflicting axe blow.
During the course of investigation, it was found that accused was involved in the criminal activities since his childhood.
“Considering all relevant facts and circumstances, this court is of opinion that the evidence of prosecution witness is wholly unacceptable being fraught with improbabilities, doubts and oddities inconceivable with normal human conduct or behavior”, Principal Sessions Judge said.
“The prosecution witness’ phlegmatic reaction to the murder of her husband and the suggestive weak motive is sufficient to demolish the fragile structure of the prosecution case. The doubts crept in the prosecution case could not be dispelled by the prosecution. Thus, the evidence on the record cannot be acted upon as the basis of conviction”, the court further said.
Stating that prosecution has failed to prove its case against accused beyond all reasonable doubts, the court said, “there are many doubts in the prosecution story which could not be dispelled”. With these observations, court acquitted the accused from the charges leveled against him.
