Notice to Khyber for unethical practice

Srinagar, Aug 29: The Deputy Commissioner Srinagar has taken strong exception to “unethical” practice by Khyber Agro Farms Pvt. Ltd, asking it to showcause why action as per law shall not be taken against it for putting post manufacturing date on a particular batch of curd sold by it.
The action by the Deputy Commissioner Srinagar followed as a number of people took to the social media with the pictures of the cup on which a Batch No: BH: 27 with MRP Rs 18 had the manufacturing date written as 1/9/2018.
“Whereas your enterprise Khyber Agro Farms Pvt. Ltd., is registered for the manufacture of Milk & Milk Products, which includes Khyber pro-Active Dahi; whereas one of the samples of pro active Dahi bearing batch No, BH:27 with an MRP of Rs. 18 shows manufacturing date of 01-09-2018 has gone viral on social media on 28-08-2018, clearly bringing out that you have post-dated the manufacturing date of the batch,” read the notice by the Deputy Commissioner Srinagar Syed Abid Rasheed Shah.
“Prima facie this act of yours has made it possible for the perishable item Pro-Active Dahi having limited shelf life to sustain longer in the market to earn profits, clearly an unethical market practice which could risk the health of consumers,” the notice said.
“Underlining that Rule 2.6.1 Sub-rule 4 of the Food Safety & Standards Rules 2011 puts an onus on the manufacturer to clearly indicate the use by date (the date by which the product remains consumable in the given conditions.),” the notice said.
“For the default committed and adopting unethical marketing practices and putting to likely danger the health of consumers by yours errors of omission and /or commission, you are directed to show cause in public interest within 02 days from the date of receipt of this notice before the undersigned (Deputy Commissioner Srinagar),” the notice read.
“In case of failure, the Deputy Commissioner said that it will be presumed that Khyber Agro Farms Pvt. Ltd has nothing to say in the defence and strict action as per the law shall follow”, read the notice.
