Murder accused acquitted as prosecution fails to prove guilt

JAMMU, July 30: The Ist Additional Sessions Judge Jammu, M A Choudhary, acquitted the accused persons in a case of alleged murder as the prosecution failed to prove charges against the accused persons for the commission of the offences punishable under Section 302/ 120-B reads with 34 RPC, for  want of cogent, credible and trustworthy evidence.
According to prosecution story on August 11, 2010, one Kanchan Kour alias Sonia, wife of Surjeet Singh Labana, R/o Kullian, tehsil R S Pura was found dead at her home under suspicious circumstances. The  police arrested husband of the deceased Surjeet Singh alias Nitta alongwith his brother Jagmeet Singh alias Pappu and his wife Surinder Kour and son Sukhvinder Singh alias Garu. All the accused were chargesheeted.
Taking into consideration the prosecution evidence in its totality, the court held that prosecution has not succeeded to prove its case to bring home the charge against accused for commission of offences punishable under sections 302/ 120-B read with 34 RPC, for want of cogent, credible and trustworthy evidence. Accordingly the court dismissed the case and acquitted the accused of the charges. The under-trial prisoners were directed to be released forthwith from custody. The bail and personal bonds furnished by the accused on bail were ordered to be released.
