Life-imprisonment awarded in rape, murder case

SRINAGAR, Dec 15: Principal Sessions Judge Budgam, Mohammad Yousuf Wani has awarded life imprisonment to a rape and murder accused.
The accused Kamal Jeet Singh of Attina Beerwah had on October 3, 2002 kidnapped two girls from their lawful guardianship, confined them wrongfully in an abandoned house, subjected them to rape and then further proceeded to kill them.
A case in this regard was registered in the Police Station Beerwah and after investigation challan was presented in the court of law at Budgam on November 27, 2002. Thereafter, trial of the case was conducted and finally on December 10, 2016 the accused was convicted.
Today, Principal Sessions Judge Budgam awarded imprisonment of 10 years and fine of Rs 25,000 to the convict for the commission of offence punishable under Section 366 RPC. He was also awarded imprisonment of one year and fine of Rs 1000 for the commission of offence under Section 342 RPC; rigorous imprisonment for life and fine of Rs 30000 for the commission of offence under Section 376 RPC and rigorous imprisonment for life and fine of Rs 45,000 for the commission of offence under Section 302 RPC.
“The sentences of imprisonment awarded for the offences under Sections 366 and 342 RPC shall stand set off against the period already undergone by the accused. The accused shall now suffer the rigorous imprisonment for life concurrently under Sections 376 and 302 RPC and shall also be liable for payment of fine as awarded”, the court said.
“Since the imprisonment for life awarded by this court under each of the sections is subject to the confirmation by the High Court in view of Section 374 of the Code as such, the proceedings of the case are submitted to the High Court for confirmation of the sentence of life imprisonment”, Principal Sessions Judge said.
“The convicted person shall remain in the Central Jail Srinagar subject to the confirmation of the sentence of life imprisonment awarded against him. In case of confirmation of sentence of life imprisonment by the High Court, the requisite warrant for execution of sentence as mandated under Section 381 of the Code shall follow”, the court said.
