Life imprisonment awarded to 2 in murder case

Srinagar, Mar 15: A local court today awarded life imprisonment and fine of Rs 25000 to two persons involved in murder case.
The Court of District and Sessions Judge presided by Rashid Ali Dar today convicted two persons in murder case and awarded them life imprisonment and fine of Rs 25000 to each which shall be payable to victim’s family.
Court while announcing the quantum of sentence said that it is proper to sentence them for life along with fine. “Execution of the same shall be subject to confirmation of the High Court in terms of Section 374 of Cr.P.C. They are further awarded imprisonment for 3 years under Section 148 RPC and further imprisonment of 3 months under Section 447 RPC”, reads the order.
Trial court however, made it clear that all the sentences shall run concurrently and in case of default in payment of fine, both the convicts  will further undergo for  6 months simple imprisonment.
Court convicted the other accused Parvaiz Ahmad Mir for imprisonment of 3 years under Section 148 RPC and further imprisonment of 3 months under Section 447 RPC.
Another convict Ghulam Qadir Mir has been sentenced to imprisonment of 2 years, 11 months and 24 days for commission of offences under Sections 148 and 447 RPC i.e the period which has been already undergone by him. The period of sentence, court said, stands thus set off in terms of Section 397-A Cr.P.C.
The accused persons have been convicted for the killing of their neighbour Mushtaq Kuchay in 2010 in Lajoora Pulwama.
Two accused who have been awarded life imprisonment are Rayees Ahmed Mir and Nazir Ahmed Mir, who had killed a PHE employee at Rakhi village in  Lajoora Pulwama.
Two other accused Parvaiz Ahmed Mir and Ghulam Qadir Mir were held guilty under the offences under Section 148,149,447 RPC, for usage of deadly weapon and criminal trespass.
Another accused Kaisar Sultan Bhat involved in the case is absconding and court has already issued warrant against him under Section 512 CrPC and has directed SP Pulwama to arrest the accused and produce him before the court.
On 21 August 2010, a minor scuffle broke out between two neighbours about a compound wall at Village Rakhi, Lajoora Pulwama where Rayees,
Parvaiz, Ghulam Qadir, Zahid Ahmed Mir and Kaisar were quarrelling with their neighbour Mushtaq Kuchay when Rayees instigated by Nazir to uproot the wall and instigated him to injure the victim.
