JAMMU, Aug 10: There has been mixed reaction on the Article 35A of Indian Constitution across the State.
BJP senior leader and MLC Ashok Khajuria today turned tables on NC, Congress and other opposition parties for politicizing the issue of Article 35 A of Indian Constitution and termed it a move to incite the people to launch the 2008 type agitation which is totally unfortunate.
Khajuria said it does not behold good for a leader like Dr Abdullah’s stature to incite people for an agitation for a issue which is subjudice. He said that the decision of the court should be acceptable to every one with humility.
He also took serious note of Chief Minister’s meeting with opposition leaders and termed it an immature decision on her part. Khajuria said it is a fact that people of State have suffered a lot because of Article 35 A and Article 370 of the Indian Constitution the abrogation of the same has been the basic demand of Jana Sangh and party gave many sacrifices for it “as we stand for total integration of J&K with rest of India that is the only solution to all problems and prevailing mess in the State’’.
He expressed the hope that good sense will prevail on opposition leaders including NC and they instead of trying to mislead the people will wait for court decision.
BJP chief spokesperson and senior advocate Sunil Sethi termed recent attempts by NC and Congress to politicize issue of Art 35 A of Constitution of India total political bankruptcy of both parties and lack of understanding on Constitutional bodies.
In a statement issued here, today he said attempt to incite people on the issue by twisting facts, is very unfortunate.
Sunil Sethi said that the issue whether Art 35A is unconstitutional or is permissible under Constitution of India is subjudice before Supreme Court of India. He said that minimum which is expected from NC and Congress is to have faith in Supreme Court of India.
Sethi further said that Chief Minister of State moving with immature hurry in going to opposition parties on the issue and then trying to involve consensus is really surprising and unfortunate as she has fell in the trap of opposition and unwittingly has become party to voice against Supreme Court of India and it’s impartiality. He said that N C and Congress has with definite planning tried to give agenda to separatists and anti nationals to vitiate atmosphere in the State and it was expected that PDP and it’s leadership would have seen through the game plan rather than falling in it .
Shiv Sena today organized a strong protest against State Government for creating hurdles in revoking Article 35 A. The protest demonstration was organized under the leadership of State president of the party Dimpy Kohli.
While addressing the protesters Dimpy Kohli along with Rakesh Gupta , Manish Sahni and Raj Singh  the other leaders of his party criticized the provision, asserting that it encourages alienation, deepens the concept of a separate identity and creates a political gap between the State and the rest of India. He said that Kashmiri leadership is creating hurdles in revoking this article and BJP is hand in glove with PDP only to remain in power in the State.
He said all Kashmiri parties are now united against revoking of Article 35A and are pressurizing BJP. The BJP when in opposition was crying loudly for revocation of Article 370 and now when in power at Center as well as in the State it is singing a different tune making people fool.
The workers of Dogra Front & Shiv Sena under the leadership of its president Ashok Gupta took out a procession in the city against the Article 35A as it has enslaved the women of the State. The ladies tied up their hands with the chain to express their resentment against the Article which has enslaved them in their own State.
Article 35A of the Indian Constitution is an article that empowers the Jammu and Kashmir State’s Legislature to define “permanent residents” of the State and provide special rights and privileges to those permanent residents. The legislature defines or allows to whom the permission has to be given to live in the State.
Gupta demanded the immediate revocation of Article 35A terming it unconstitutional and illegal. It has been extended to the State by the virtue of presidential order and has not been passed by the Parliament, which is a necessary formality,” he added.
Veteran Trade Unionist Mir Ghulam Rasool while commenting the political developments in the State in the wake of controversy of Article 35 A held former Prime Minister of India , Pt Jawahar Lal Nehru and former Chief Minister of the State and NC leader Sheikh Mohammed Abdullah responsible for this mess. He said democracy was never allowed to prevail in J&K State and both these leaders had their political aggrandizement more dear than the interests of the people of country and the State. He also criticized role of former Prime Minister, Bakshi Ghulam Mohammed.
He said had the duo shown far-sightedness and maturity the situation could have been different at present. He said as the State is under going through turmoil for last 30 years now and by raking up controversial issues will further aggravate situation. He expressed the hope that ruling as well as opposition parties will act wisely to avert any controversy in future to allow the democracy to flourish in the State as well as country. Such controversies are neither in the larger interests of nation nor the State at present, he added.
