JAMMU, May 9: In a petition filed by the Parents Coordination Committee and others, High Court today directed the Chairman Balaji Educational Venkateshwar Society, Principal KC Intern-ational School and Managing Committee KC International School to receive monthly tuition fee from the parents.
On April 17, 2013 the High Court had issued notice to the respondents and directed the Chairman Balaji Educational Venkateshwar Society, Principal KC International School and Managing Committee KC International School to ensure that the fee under the heads, which are not prescribed in the rules, is not charged.
Advocate GS Thakur appearing for the Committee submitted, “the order was duly served upon the respondents but the latter instead of disclosing the heads to charge the fee as per the Govt order, are pressurising the petitioners by issuing letters with the language that the petitioners are required to be given in writing that they do not have any role in the allegation and were not a part of the group resorting to disrupt smooth functioning of the school”.
“The petitioners are ready to pay the tuition fee prescribed under the statute and only dispute involved in the petition is pertaining to constitution of committee as per the judgment of Supreme Court in 2013 titled Modern School New Delhi Vs Union of India and scraping the head annual charges and miscellaneous charges”, he said, adding “the private respondents are charging fee under the annual charges capitation fee which is prohibited as per the judgment of the Apex Court”.
Advocate Thakur further submitted, “the respondents have adopted another way to compel the petitioners to deposit the fee of their choice by harassing the minor students”.
On this, Justice Tashi Rabstan observed, “prima-facie a case is made out for interference and accordingly notice is issued returnable within four weeks. In the meanwhile subject to objections from other side and till next date before the bench, private respondents namely Chairman Balaji Educational Venkateshwar Society, Principal KC International School and Managing Committee KC International School are directed to receive monthly tuition fee from the parents”.
