HC seeks report on granting bail to fraudster

Srinagar, Feb 1: High Court today sought report from the Principal District Judge Baramulla about the granting of bail to fraudster.
Justice Ali Mohammad Magrey has sought report from the court of Principal District Judge Baramulla with regard to granting bail to one who has played fraud to the court itself.
The accused has played fraud while executing a mortgage deed before the court of Sub-Registrar with regard to a land which belongs to his sister. Accused Gulla Batia, brother of petitioner Mareena Begum has executed mortgaged deed before the court by representing his wife as his sister.
Mareena Begum made complaint before the concerned police station and subsequently FIR was lodged against the accused Batia under Section 420, 468, 419, 467 RPC.
Counsel for petitioner submitted before Justice Magrey that prior to passing impugned order (granting of bail) on application for grant of anticipatory bail, the similar application on identical grounds and submissions preferred by the accused along with others, was dismissed  by Principal Sessions Judge, Baramulla.
“Before proceeding further in the matter, Registrar Judicial shall call for report from PDJ Baramulla, as to under what circumstances he has passed order granting bail in anticipation of arrest in favour of respondents in terms of Sections 497-A CrPC”, Justice Magrey directed and posted the matter tomorrow again.
Court also issued notice to the accused persons and asked the processing serving agency of district court Baramulla to ensure serving of notice to all the accused.
Notice on behalf of SHO Bijhama was accepted by the State counsel in open court and SHO was directed to submit status report with reference to investigation and produce case diary by tomorrow.
