HC seeks record of candidates for GMC Principal

Srinagar, Dec 16: The High Court has sought clarification from General Administration Department (GAD) about submitting the service record of eligible candidates to the Cabinet for the post of Principal Government Medical College Srinagar.
The direction was issued by the Division Bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar after the counsel appearing for Dr Javed Chowdhry stated that his client is the eligible and suitable candidate for the post of Principal GMC Srinagar in view of his seniority and experience.
Dr Chowdhry had approached the Court to question the appointment Dr Samiya Rashid as GMC Srinagar Principal and the writ court while dismissing the claim of Dr Chowdhry to quash the appointment of Dr Samiya as Principal GMC recorded that the Cabinet did not accord to the recommendations of the selection-cum-establishment committee and returned the case for submission of service record of all eligible candidates.
Challenging the writ court verdict in Division Bench, Dr Chowdhry’s counsel invited the attention of the Court to the finding of writ court wherein it returned the finding against the record as there was no decision taken by the Cabinet and instead asked General Administration Department submission of record of all eligible candidates for consideration of appointment on post of Principal GMC.
When asked to State Counsel about the decision of Cabinet, he failed to show the relevant extract of the decision of the Cabinet asking for submission of records of all eligible candidates in terms whereof the recommendations of the selection cum establishment committee stands returned for submission of service record of eligible candidates and, thereafter, submission of the records to the Cabinet, which was perused on 28.4.17.
Cabinet in its decision (on 28.4.2017) under Government order (dated 8.5.2017) had appointed Dr Samia Rashid as Principal of Government Medical College, Srinagar.
Case of Dr Chowdhry before the writ court was that even though the name of the petitioner alone was recommended for appointment to the post in question by Establishment-cum-Selection Committee and the same was submitted for approval, to the State Cabinet, in the form of Memorandum, yet the State Cabinet has taken a decision to appoint Dr Samia and thereafter the order of appointment was passed.
