Srinagar, Nov 28: High Court today sought personal appearance of Financial Commissioner, Secretary Industries and Commerce and Director Handicrafts Kashmir to show cause why they may not be punished for not implementing court orders.
Justice Ali Mohammad Magrey observed that these officials have prima facie intentionally and deliberately violated the court judgment passed more than three years ago and they shall show cause as to why they shall not be punished.
Court while dealing with a contempt petition filed by Mohammad Syed Makhdoomi and others for not implementing the court judgment passed in July 2012 directed these officials to cause their appearance before the court on next date as rule has been framed against these officials for flouting the court judgment.
Court pulled up the authorities and said these authorities are playing pranks with the process of the court by not implementing the judgment which has attained finality. “Years have elapsed and judgment has not been implemented in the manner it is required to be implemented”, said the court.
Court while thrashing these authorities for their rude behavior with the court directions observed this institution like other democratic institutions survives on faith of the people and in case people lose faith in the democratic institutions, then there will be anarchy in the society.
”For maintaining faith of the people in the institution of judiciary, the contempt proceedings are initiated to protect and preserve the dignity and majesty of the courts and for preserving the rule of law”, court maintained.
Court in its final judgment had directed the authorities to consider the claim of the petitioners for being appointed by way of promotion to the next higher post (for grant of Promotion in terms of J&K CSR) with the condition the vacancies that occur in any cadre due to retirement or promotion or otherwise shall be deemed to have been abolished.
