HC seeks personal appearance of DC

Srinagar, Nov 9: High Court today sought personal appearance of Deputy Commissioner Budgam and Tehsildar for giving wrong information to the Court on cutting down of popular trees.
The Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey directed DC Budgam and Tehsildar to remain present on November 21 before the Court and explain their position.
“Before framing a rule against DC Budgam and Tehsildar B K Pora, both officers shall remain personally present on the next date to explain their position”, DB directed.
Court before proceeding against these officials for wrong information, in the first instance sought their personal appearance for explaining their position.
It is in terms of previous Court directions DC Budgam was under command to cut down the Russian popular trees existing adjacent to thehouse of the petitioner.
In his compliance report, DC has stated that the Court order has been implemented in letter and spirit through Tehsildar as also the Tehsildar in his  communication has reported that the Russian popular trees from the identified area even standing adjacent to the house of the petitioner in presence of the parties have been cut down.
But the position has been disputed by the petitioner before the Court which prompted it to appoint the Commissioner for inspection on spot and bring the real picture before the Court.
The appointed Commissioner advocate Mir Suhail has submitted the report, which suggested that the direction has not been complied with.
“Compliance report of DC is contrary to the spot position as has been brought to the notice of the court by the appointed Court Commissioner”, read the order.
Report along with the Google map and the photographs clicked on spot showing the site suggest that the order has not been implemented.
