HC seeks explanation from DSEK

SRINAGAR, Jan 31: The High Court today sought explanation from the Director School Education Kashmir for giving wrong information to the higher authorities about the court order and sought personal appearance of Zonal Education Officer for violating the court orders.
Observing that wrong information given to higher authorities contrary to the court orders amount to forgery and before proceeding against Director School Education Kashmir in this connection court sought his explanation in writing from the official by next date of hearing.
“Before proceeding against the DSEK, he is granted opportunity to submit his explanation on affidavit within two weeks as also Respondents 3 shall appear in person on next date and explain to why he has not released legitimately earned wages in favour of the petitioner despite the court directions”, Justice Ali Mohammad Magrey directed while dealing with a contempt petition filed by one Arhsid Hussain Dar engaged as Contingent Paid Worker (CPW) by ZEO Kakapora.
Director in his communication dated 21.11.2016 addressed to Commissioner/Secretary School Education in response to his letter dated 5.7.2016 stated that no consideration order till date has been passed by the court, however, it is pertinent to mention here that the petitioner has been engaged as CPW by the ZEO, Kakapora after the ban was imposed by the Government.
But Court has passed a direction way back in 2015 directing the authorities to consider the case of Dar for his permanent absorption against the post of CPW available in the Urichersoo Zone Kakapora.
Advocate Rafiq Ahmad Bhat on behalf of petitioner before the court submitted that DSEK in his communication has made mention that there is no consideration order passed by the court. “The reading of the communication makes it clear that the DSEK is not conscious of the order passed by this court on 22.12.15, therefore, he has based the communication on wrong/incorrect facts contrary to the orders passed by this court”, Justice Magrey said after submission of advocate Bhat.
