HC seeks assurance for appointment of FSC

SRINAGAR, Dec 15: High Court today sought assurance from the Health Department counsel that the appointment of Commissioner Food Safety be put in place before Cabinet in its forthcoming meeting.
The Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey expressed it serious concern over the lackadiaskal approach of Government with regard to appointment of Commissioner Food Safety.
Court during the course of proceedings observed to State counsel that how long court is monitoring this issue and it is yet to be accomplished by the Government. Court asked the counsel to contact the authorities and have instructions as to how and in what manner they are going to implement to court orders.
After a while State counsel came with information before the court that the Finance Department has approved the proposal and sent it to Commissioner Secretary GAD and the proposal would be placed before the Cabinet which is going to meet of 21st of this month.
Earlier, senior Advocate B A Bashir who is amicus in the matter submitted before the court that Chief Secretary be summed and he be asked that within how much time Government is going to complete the process or face for consequences. “Keep him personally responsible otherwise nothing would happen on ground level”, he submitted.
Court observed to State counsel to ensure availability of Cabinet memo before the court one day before next hearing in the matter and ensure the issue be positively taken in next Cabinet meeting.
With regard to providing transport facility to the Presiding Officers of Food Safety Appellate Tribunals, court has been informed that Presiding Officer in Srinagar has been provided with transport facility and Presiding Officer at Jammu will be provided it by tomorrow.
Deputy Secretary to Government, Health and Medical Education Department on behalf of Principal Secretary to Government, Health and Medical Education Department submitted that the department is committed to implement the provisions of Food Safety and Standard Act-2006 and its rules and regulations across the State.
