HC quashes detentions, directs release of detenues

Srinagar, June 8: High Court while hearing various petitions challenging order of detention by various persons quashed their detention and directed the authorities to release them from the preventive custody.
Court quashed the detention orders of Naseer Ahmad Bhat S/o Ghulam Nabi Bhat R/o Malangpora, Tehsil Awantipora, passed by District Magistrate Pulwama, Javid Ahmad Mir S/o Gh. Mohi ud Din Mir R/o Hajin Tehsil Kralgund Qaziabad and Suhail Ahmad Bhat passed by District Magistrate Kupwara, Abdul Rashid Sheikh S/o Abdul Ahad Sheikh R/o Behrampora Rafiabad, Gh. Mohi-Ud-Din Malik and Jameel Ahmad Bhat S/o Ghulam Mohi-ud-Din Bhat R/o Chechiloora, Pattan passed by District Magistrate Baramulla, Shahid Ahmad Wani S/o Ghulam Ahmad Wani R/o Kanigam passed by District Magistrate Shopian.
Court while allowing the petitions of these detenues said a citizen cannot be deprived of personal liberty, guaranteed to him by the Constitution and of which, he cannot be deprived except in due course of law and for the purposes sanctioned by law.
“Life and liberty of the citizens of the State are of paramount importance. A duty is cast on the shoulders of the Court to enquire that the decision of the Executive is made upon the matters laid down by the Statute and that these are relevant for arriving at such a decision”, judgments passed in these petitions read.
