HC quashes appointment of Functional Manager

JAMMU, Dec 23: High Court has quashed the appointment of Master Popsy as Functional Manager under the OSC Category in J&K Industries and Commerce (Gazetted) Services.
After hearing Advocate Abhinav Sharma appearing for the petitioner, Justice Alok Aradhe directed PSC to consider the case of the petitioner Vijay Kumar for appointment under the OSC category with effect from the date other selected candidates were appointed in pursuance of the advertisement notice dated 10.02.1999 issued by J&K Public Service Commission and to accord him all consequential benefits.
“In case vacancies are available as asserted by the petitioners it will be open to the State and PSC to accommodate Master Popsy against any vacant post in accordance with law”, High Court said.
Earlier, during the course of hearing Advocate Abhinav Sharma submitted that Master Popsy in his objections in categorical terms had admitted that he did not apply under the OSC category and therefore he could not have been appointed under the quota reserved for OSC category candidates.
It was further submitted that four candidates were appointed and the petitioner was next in merit and since the appointment of Master Popsy is bad in law the petitioner ought to have been appointed on the post in question.
