HC orders probe against Ansari

SRINAGAR, Sept 29: High Court today ordered probe against Minister of State for Youth Services and Sports Imran Raza Ansari, for threatening a Lakes and Waterways Development Authority (LAWDA) official.
Court came down heavily on LAWDA for not taking action against BJP MLC who violated the court order.
The court ordered probe by retired Principal District Judge on a complaint against Sports Minister for threatening a LAWDA official.
The complaint against Ansari was filed by Deputy Superintendant of Police (Enforcement Officer LAWDA) alleging that the Minister called him on phone when he along with his staff was conducting demolition drive in Dal lake area.
It was alleged in the complaint that the Minister used abusive and un- parliamentary language against Enforcement Officer while calling him on phone, which the Minister vehemently denied in his reply.
Court in order to reach to proper conclusion and to recommend any action in the complaint said it is required to be enquired. “We accordingly appoint Syed Javed Ahmad, retired Principal District Judge as enquiry officer. He will enquire into the complaint”, directed Justice Muzaffar Hussain Attar and Justice Ali Mohd Magrey.
Court also asked the enquiry officer to provide opportunity of hearing to both the parties and start the enquiry proceedings in one week from the date when copy of order is received by him.
Chief Secretary has been directed to provide vehicle, room, stenographer and one clerk and one person to the enquiry officer within one week.
Court observed that why not action be taken against BJP MLC Ajat Shatru Singh for raising the illegal construction on green belt. “If he has violated the orders of the court then why action be not taken, reason being he is the grandson of Maharaja. Are law made only for poor people. We will direct for closing the cases registered against those poor persons who have violated court orders”, Division Bench said.
Counsel of the BJP leader submitted that his client will file undertaking that he (Singh) will not raise any construction in violation of court orders and the laws occupying the field and will also tender apology. Court granted him two weeks time for it.
Singh’s property at Gupkar Road was sealed after the direction of the court last month and sealed portion was given under the Superdari of Deputy Commissioner Srinagar through Naib Tehsildar Buchwara. “It is reiterated that any person or authority, whosoever, high, he may be, is not above the law”, DB said.
Court also directed to Pollution Control Board to inform it whether the management of the Hotel Grand Palace has replaced the Sewage Treatment Plant (STP) as earlier directed and sought compliance from the hotel management about the factum of the compliance of the orders.
The violators who were present before the court were directed to file bail bonds and surety bonds in the amount of Rs 50000 to the satisfaction of Registrar Judicial.
Court issued bailable warrants against those who were not present in the court and directed the SSP for execution of warrants against them to the tune of Rs 20000 each. “In case, any of the warrants is received unexecuted, then SSP shall appear in person before the court on next date”, DB said.
