HC issues notices to VC JU, others in contempt petition

JAMMU, Sept 21: High Court today issued notices to Prof R D Sharma, Vice-Chancellor, University of Jammu, Dr Meenakshi Kilam, Registrar and Prof Jigar Mohammad, Dean Research Studies (DRS) in a contempt petition filed by a PhD Scholar in the discipline of Sociology namely Juhie Mohan asking them to file statement of facts before next date of hearing.
When the contempt petition filed by Juhie Mohan came up for hearing Advocate Sheikh Shakeel Ahmed appearing for the petitioner submitted that on July 26, 2017 the High Court had quashed Agenda Item No.12 dated November 18, 2014 and the decision of Dean Research Studies dated November 8, 2016 whereby the claim of the petitioner for change of her status from whole time PhD Scholar to part time PhD Scholar was rejected.
“The court after threadbare adjudication in the matter had concluded that the case of the petitioner Juhie Mohan deserves consideration under proviso to Statute 13 of the Statutes governing PhD and it was also held that the fresh orders with regard to the petitioner be passed on the analogy of two similarly situated scholars namely Asha Rani and Usha Sharma”, Advocate Ahmed said, adding “a specific finding was returned vide Judgment dated July 26, 2017 that Statute 8(a)(iv) of Statutes governing PhD has no applicability to the case of the petitioner”.
He argued that despite allowing of the writ petition, the Dean Research Studies University of Jammu vide order No.RA/17/2642-44 dated August 28, 2017 rejected the claim of the petitioner on the ground that the case does not fall in any of the categories as envisaged under Statute 8(a)(iv) and also on the ground that the case of the petitioner Juhie Mohan is distinguishable to other two scholars namely Asha Rani and Usha Sharma.
“Dean Research Studies has overreached the directions of the court and despite clear cut findings has rejected the claim of the petitioner for change of her status from whole time PhD scholar to part time PhD scholar on the same grounds when Jammu University had earlier vide order No.RA/16/4678-82 dated November 8, 2016 rejected the claim of the petitioner”, the counsel for the petitioner said.
After considering the submissions of Advocate S S Ahmed, Justice B S Walia issued notices to Prof R D Sharma, Vice-Chancellor, University of Jammu, Dr Meenakshi Kilam, Registrar and Prof Jigar Mohammad, Dean Research Studies (DRS) requiring them to file their statement of facts.
The High Court directed the Registry to list this contempt petition in the first week of October.
