HC issues notice to CS

Srinagar, Feb 27: State High Court has issued notice to the Chief Secretary of the State for not implementing the court orders with regard to appointment of Principal Government Medical College Srinagar.
The notice to CS and other officials has been issued in a contempt petition filed by Dr Javed Chowdhary (claiming to be the eligible candidate for the post of Principal GMC) stating that despite court directions no action has been taken by the State on the issue.
The notice to the CS and other officials has been issued by the Division Bench of Justice Ramalingam Sudhakar and Justice Ali Mohammad Magrey and the CS has been directed to file their statement of facts to the contentions raised in the contempt petition by or before March 29 which is the next date of hearing in the matter.
It may be mentioned here that the contempt petition filed by Chowdhary is the 4th round of his litigation seeking directions upon the authorities to fill up the post of Principal GMC on regular basis as directed the by the Court.
The earlier contempt petition filed by Dr Javed Chowdhary was closed after the information given by the State Council (AAG) provided to him by the Health and Medical Education Department indicating therein that the establishment-cum-selection committee meeting was held on November 30.
The committee has recommended the name of the suitable candidate for the post of principal GMC Srinagar, vide No. GAD (Ser)Genl/70/2006 date 13.12.2016. Court was also informed that the recommendation of the committee are being sent for approval to the State Cabinet in the shape of memo.
“In view of the aforesaid situation, this contempt petition will not proceed further and is. accordingly disposed of”, DB had said while closing the proceeding of earlier contempt petition.
Court in its judgment passed in the month of March last year had directed the State Government to fill up the post of Principal GMC, Srinagar within eight weeks from today (i.e March 3, 2016) on regular basis in accordance with the rules.
Dr Chowdhary had challenged the Government order (dated 19.12.2015) whereby Dr. Kaisar Ahmad Koul has been given the charge of Principal on temporary basis. Dr. Chowdhary challenged the order before the court on the ground that the private respondent (Dr. Kaisar) is junior to him in seniority list of Professors.
