HC imposes penalty on Secy SSB

Srinagar, Feb 11: The State High Court today penalized Secretary Services Selection Board (SSB) for failing to complying with the court orders despite five opportunities given to him.
Despite several opportunities granted to the Secretary SSRB for filing of response to the petition filed by one Ghulam Mohiuddin Sheikh through Advocate SR Hussain, the official did not pay any heed to the court orders resulting into imposing of costs on him
The official was given five opportunities by the court to file his response in opposition to the contentions raised in the petition but of no use as such court imposed Rs 5000 on him for his conduct towards the court orders.
“In the interest of justice, weeks time is granted to respondent-2 to file response in terms of order dated 25.3.2016 subject to payment of costs of Rs 5000”, Justice Aloke Aradhe directed and said these costs be paid to the petitioner.
Court in the month of November 2015 granted him time for filing the response thereafter in the month of December 2015 further time as prayed for has been granted.
The matter came up for hearing in the month of February 2016 and further time has been sought by the Secretary’s counsel for filing of response but no response from the party. Finally court in the month of May 2016 granted him last opportunity for the same and despite that no response which has caused delay in deciding the case by the court. “However, the aforesaid order has not been complied with till today”, court recorded
When the matter was taken up today State Counsel once again prays for an adjournment which the court granted subject to the costs to be payable to the petitioner.
It is mentioned here earlier also the court in one of the case held responsible the State for its casual approach for defending the cases with observation “the approach adopted has not only increased the litigation but also formed barrier in deciding the cases”.
The court on November 27, 2015, December 14, 2015, February 18, 2016, as well as on March 2, 2016 has granted him opportunities to file the affidavit. It is pertinent to note on May 24, 2015, the court had granted last opportunity of filing response in terms of order dt: 25.3.16. However, the order has not been complied with till today.
When the matter was taken up today, Andreeb, DAG appearing vice M A Wani AAG once again prayed for an adjournment. In the interest of justice, weeks time is granted to respondent-2 to file response in terms of order dated 25.3.16 subject to payment of costs of Rs 5000 to the petitioner.
