HC grants bail to 8 in Kishtwar riots

JAMMU, Jan 9: Vacation Judge of High Court, Justice Bansi Lal Bhat has granted bail to Neeraj Kumar, Sanjay Kumar, Ranjeet Kumar, Koshal Kumar, Shakti Kumar, Narinder Kumar, Sewa Ram and Milan Singh, who were allegedly involved in Kishtwar riots.
After hearing Senior Advocate Sunil Sethi with Advocate Parimoksh Seth appearing for the petitioners whereas Monish Chopra for the State, Justice Bhat directed that upon surrender of petitioners they shall be released on bail on furnishing personal bond and surety bond in an amount of Rs 30,000 each to the satisfaction of Special Judge Kishtwar.
“The petitioners figure as accused in a case registered under FIR No. 150/2013 with Police Station Kishtwar. They are alleged to have committed offences under Section 436 RPC which are triable by Special Judge”, Justice Bhat said, adding “during the course of hearing it emerges that some of the accused in the FIR have already been admitted to bail”.
“In view of the mandate of law engrafted in Section 295-A read with Section 497-D of CrPC providing that the investigation shall be concluded within two weeks and trial shall as far as possible be concluded within a period of three months coupled with the fact that in the instant case trial is pending before the Special Judge Kishtwar”, High Court said.
“In so far as grounds urged for quashment of charge-sheet are concerned, petitioners shall be at liberty to raise these questions at the stage of framing of charge before the Trial Court”, High Court said while disposing of the petition.
