HC dismisses petition of Pawan Hans Ltd

JAMMU, Aug 1: High Court today dismissed a petition of Pawan Hans Limited seeking allotment of contract for helicopter services on Katra-Sanjichhat-Katra route.
The petition was filed against order passed by District Judge, Reasi on application filed by Pawan Hans Limited under Order 39 Rule 1 and 2 CPC alongside the suit titled Pawan Hans Limited Versus Shri Mata Vaishno Devi Shrine Board, Katra and Others by virtue of which the Trial Court had declined the relief of temporary injunction.
The dispute inter se the parties relates to allotment of contract for operation of helicopter flights on Katra–Sanjichhat-Katra route.  Vide NIT dated 30.10.2013, Shri Mata Vaishno Devi Shrine Board invited tenders from registered aviation companies having a fleet of minimum three airworthy light helicopters for operating flights on Katra-Sanjichhat-Katra route purely on leave and licence basis for a period of three consecutive years with effect from April 1, 2014.
After hearing both the sides, Justice Bansi Lal Bhat observed, “petitioner having failed to demonstrate existence of a prima facie case in its favour and balance of convenience not tilting towards it”, adding “further no irreparable injury being shown to have been caused to petitioner by rejection of its price bid coupled with the fact that petitioner has failed to demonstrate that the decision making process in allotment of contract in favour of private respondents suffered from any material irregularity”.
“The impugned order does not suffer from any legal infirmity. The Trial Court has exercised its discretion of declining the equitable relief of injunction on sound judicial principles and same does not warrant interference by this court”, Justice Bhat said while dismissing the appeal.
