HC directs personal appearance of officials

Srinagar, Dec 6: High Court today due to non-availability of State Counsel before the bench sought personal appearance of higher officials and directed the Law department to make arrangement in the matter for tomorrow.
Hearing PIL on protection and preservation of ecologically fragile environs of Pahalgam from encroachments and illegal constructions, the Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey directed the Law Department to make arrangements for tomorrow’s hearing in the matter.
Court directed for personal appearance of heads of various departments in the matter among them are Chief Town Planner, Deputy Commissioner Anantnag, Chairman PCB and Regional Wildlife Warden before the court on December 7.
Court also said that direction issued on October 24 have not been complied with by the authorities and sought compliance of these directions by tomorrow from these officials.
Court on October 24 had directed the State Pollution Control Board to carry out a survey to the Hotels in Pahalgam to check as to whether STPs are functioning within permissible limits.
Court had also directed for complete action plan for treatment of sewage and solid waste and sought report whether the solid waste management rules of 2016 are implemented in letter and spirit and report the court within 3 weeks.
And in this connection, court had directed Pahalgam Development Authority and State Pollution Control Board to consult each other and make a joint action plan to bring the solid waste in line with the provisions of law.
Court had also directed for approval of revised draft Master Plan for the resort and directed that Master Plan of Pahalgam shall also take care of existing structures of both in Wildlife and forest area.
Court had also directed that no further construction shall be allowed with the permissible area and if any repair or renovation of existing structures is required that shall be strictly in accordance with law and in tune with Master Plan.
Court had also taken into consideration the issue of garbage in and around the resort and had directed the authorities to take care of the said issue and save the resort from pollution.
