HC directs Law Secy to file response on recommendations of Registrar General

JAMMU, Mar 7: In a petition filed by Secretaries of High Court Judges seeking induction in KAS, Justice Tashi Rabstan today directed the Law Secretary to file an affidavit before the next date of hearing indicating the steps taken on the recommendations sent by the Registrar General on May 28, 2012.
When the PIL was taken-up for hearing, on the request of Senior Advocate Sunil Sethi, Principal Secretary to Finance Department was arrayed as party respondent and notice was accepted by Senior AAG for the newly added respondents.
While arguing the case, Senior Advocate Sunil Sethi assisted by Advocate Veenu Gupta submitted that the petitioners’ category has already been treated at par with their counterparts attached with the Ministers and the matter already stands decided by Apex Court.
“Whatever benefit is given to the counterparts of the petitioners category, has to flow to them also”, they said, adding “counter parts of the petitioners’ category have been given benefit of induction into KAS and subsequent high grades in terms of SRO 368/2008 dated December 1 2, 2008 were given to them. However, this benefit was denied to the petitioners’ category”.
They further submitted that recommendation have already been made by the Registrar General of High Court to Secretary Law Department vide order dated May 28, 2012, but no action has been taken by the State for release of benefit to the petitioners category as have been granted to their counterparts.
Upon this, Justice Tashi Rabstan directed Senior AAG to file an affidavit of Secretary Law Department indicating the steps taken on the recommendations made by the Registrar General to him. Justice Rabstan also directed Registry to list the PIL on April 1, 2014.
