HC directs Judges to inspect jails

SRINAGAR, Aug 14:The High Court has directed all the Principal District Judges of the State to regularly and properly conduct the inspection of the jails of their jurisdiction to ascertain condition of the prisoners.
The Division Bench of Chief Justice Gita Mittal and Justice Alok Aradhe said that under Criminal Procedure Code and pronouncements of Supreme Court as also by this court relating to the prisoners, the District Judges are required to regularly and properly conduct the inspection of the Jails.
Court has been informed that the status report filed by some of the District Judges with regard to their visit to the jails have not been received by the counsel for petitioners as such court directed those reports be furnished to the Counsels within one week.
“A direction is issued to the Registrar Judicial to prepare a compilation of the status report which are received from various Principal District Judges”, read the order.
Court also said that interest of justice merits that such reports are submitted online to the Registry of the court by the Judicial Officer as such court directed the Central Project Coordinator e-Courts to take steps for the development of appropriate software at the earlier so that proper scrutiny of the compliance can effectively be conducted.
Court during the proceedings of the case has been informed that the under trials including the juveniles are not produced before the court of law in some of the cases.
Court directed the Principal District Judge to forthwith compile the list of such incidents to enable the court to take action for non-compliance of the directions.
Direction is already in force on the authorities to ensure that the inmates of the jail who are facing trial in different courts are produced before the court whenever production is directed by the trial court.
The earlier report of Home Department  filed by Additional Secretary to Government Home Department, Srinagar revealed that a meeting was called  for removing various deficiencies like drinking water at Central Jail, Srinagar and non-availability of Ambulances in Jails, providing of a contingent of escort for full time to meet the emergency situation like ailment in the Central Jail, providing of services of B-Grade specialist or Assistant Surgeon to the inmates and arrangement for segregation of inmates in respective class as per the Jail Manual.
The Home department, the report showed, has also impressed upon all Jail Authorities to implement the directions issued by the High Court in letter and spirit and provide food to the inmates on time in the evening, the court observed.
