HC directs JMC to remove encroachments within 3 weeks

JAMMU, Oct 28: In a Public Interest Litigation filed by Jagdish Chander Gupta highlighting the illegal encroachments by the shopkeepers and other unknown persons on Mohalla Old Hospital Road, near City Chowk and also in the adjoining areas, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Sanjeev Kumar today directed the Jammu Municipal Corporation to ensure removal of unauthorized rehris or the encroachments on the road within three weeks.
After hearing Advocate Ajay Sharma for the PIL whereas Senior AAG SS Nanda for the State, the DB directed JMC to take the help of the Police and action taken report shall be submitted within three weeks.
Division Bench also directed Jammu Development Authority to file an action taken report with regard to the removal of encroachments within the JDA shopping complex at Purani Mandi.
Earlier, the Division Bench observed that compliance report has been filed on behalf of the Jammu Municipal Corporation wherein it is stated that no rehri licence has been issued by the JMC in the area from City Chowk to Central Basic High School, Purani Mandi, Jammu.
With regard to the removal of encroachments, it is stated that 59 notices have been served to those shopkeepers who had been found encroaching upon the road in the area.
