HC directs Home Secy to file ATR on recommendations of HPC

JAMMU, Feb 15: In a significant order, High Court today directed the Principal Secretary Home Department to place on record the Action Taken Report (ATR) on the recommendations of the High Powered Committee regarding regularization of DySPs promoted on Own Pay and Grade (OPG) basis.
These directions were passed in a writ petition filed by eight DySPs (OPG) seeking regularization of their services from the date of their placement as DySPs (OPG) and also to include their names in the final seniority list of DySPs from the date of their placement against the posts.
Advocate Sheikh Shakeel Ahmed appearing for the petitioners submitted that more than 400 Inspectors have been working in the Police Department as DySPs (OPG) ranging from the year 2003 to till date and their cases were never placed before DPC/PSC for regularization in terms of the judgment of the Apex Court titled Suraj Prakash Gupta & Ors V/s State of J&K & Ors.
He further submitted that more than 130 such officers have already superannuated without being regularized, which amounts to violation of their service conditions.
He said that in order to redress the grievances of the petitioners the Home Department accorded sanction for the constitution of a four member committee vide Govt. Order No.451-Home of 2016 dated 02-08-2016 and the Committee was directed to submit its report along with concrete recommendations to the Home Department within a period of two month.
“The four member committee has already submitted its report to the Home Department but there is no headway in the matter as such appropriate directions be issued to Principal Secretary Home to place on record the Action Taken Report with regard to the recommendations made by the High Powered Committee”, Advocate Ahmed submitted.
He further submitted that the direct recruitment to the post of DySPs was made in 1999, 2001, 2004, 2008, 2011, 2012, 2014 and 2015 and the direct recruits have scaled march over the petitioners. Moreover, they have further been placed as Selection Grade DySPs followed by their promotion to the rank of Superintendent of Police and Senior Superintendent of Police thereby greatly prejudicing the service career of the petitioners.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Irfaan Mohd Khan and Suraj Singh appearing for the petitioners, Justice Alok Aradhe directed Principal Secretary Home Department to place on record the Action Taken Report with regard to the directions contained in Govt. Order No.451-Home of 2016 dated August, 2, 2016 whereby sanction was accorded to the constitution of a four member committee headed by S K Mishra, Special DG (Coordination) PHQ which had been assigned the job to undertake a fresh exercise to determine the exact number of vacancies of DySPs (Executive) in the promotion quota with effect from 01-08-1999 to 31-12-2004 and also to review the promotion of Inspectors as DySPs (Executive) made with effect from 01-08-1999 to 21-12-2004 including those made vide Govt. Order No.Home-367(P) of 2007 dated 01-08-2007 and to suggest the revised dates of promotions of Inspectors of DySPs on the basis of the exercise to be taken.
