HC directs Govt to overcome deficiencies in CCIs

SRINAGAR, Oct 1: Admitting that there are deficiencies in various State run Child Care Institutions (CCIs), High Court today directed the Government to submit a timeline before the court in order to overcome these deficiencies.
The Division Bench of Chief Justice Gita Mittal and Justice Alok Aradhe after perusal of report filed by Social Welfare Department in which it has been admitted that the CCIs are lacking facilities, directed for submitting timeline for overcoming all the deficiencies in these CCIs.
DB was surprised over not providing little extra curriculum activities to these institutions by Youth Services and Sports Department. In this connection representing counsel informed the court that a communication has been addressed to Commissioner/Secretary of the department to provide an estimated amount of Rs 31.50 lakhs to provide sports facilities to all the CCIs.
Commissioner/Secretary has been directed to address the issue and make appropriate arrangements in this regard within one week failing which shall remain present in the court on next date.
Court also directed the authorities to ensure that sufficient medical care, food, education, transportation, teaching aid and reading material is made available to all the CCIs.
State counsel has also been directed to inform the Court about the recommendation given by Ms Bharti Ali.
Ms Bharti Ali, HAQ, Centre for Child rights, New Delhi has provided a list of facilities and programmes which are required to be provided and are being provided in Child Care Homes (both for children in conflict with law and those in need of care and protection).
It has been pointed out before the court by Senior advocate Bashir Ahmad Bashir who is representing as amicus in the matter that he has inspected several children homes and has found deplorable conditions therein.
Amicus-Bashir also drew the attention of the Court to the mandate of Rule 38 of the Juvenile Justice Act , as applied to the State of J&K and in order to pass holistic orders.
