HC directs closure of unregistered coaching centres in Jammu

Srinagar, Feb 10: After the Jammu and Kashmir High Court ordered closure of coaching and tuition centres in Kashmir valley, it today directed the Government to close down all the unregistered coaching and tuition centres operating in Jammu Division.
The Division Bench of High Court comprising Justice MH Attar and Justice J R Kotwal today directed the Divisional Commissioner Jammu to close down all the unregistered coaching and tuition centres as also those which lack facility as provided in regulation of 2010.
“The directions issued on December 30 last year are extended to the coaching centres and tuition centres of Jammu Division also. The Divisional Commissioner, Jammu shall comply with the order and submit detailed report to the court before the next date”, directed the bench.
Court also directed for constitution of committee of officers, comprising Divisional Commissioner Jammu, Director School Education and Inspector General of Police Jammu. “A similar committee for Jammu Division shall stand constituted as has been constituted in terms of order dated December 30 last year and all the directions issued therein shall be complied with by the committee”, directed the bench.
Court directed that the coaching centres operating in Jammu shall file undertaking before Registrar Judicial of High Court at Jammu indicating therein that they are operating their centres in accordance with regulation of 2010 as also with court directions.
“The coaching centres and tuition centres functioning in Jammu shall file undertaking in light of order dated December 30 before the Divisional Commissioner Jammu within 10 days time. The Divisional Commissioner Jammu shall notify the order to all the coaching centres and tuition centres operating in Jammu Division”, directed the bench.
Court had directed installation of CCTV cameras around the tuition centres and coaching centres operating in Kashmir division, deployment of police personnel in the areas where the tuition centres and coaching centres are located and are functioning and the “same direction in terms of today’s orders shall also apply to the coaching centres running in Jammu Division”.
Court with regard to committee constituted for Kashmir Division observed that the “direction passed by the court has not been complied with till date” and directed it for immediate implementation of court directions or face action.
“The committee was constituted in terms of clause-A of Direction- 7 of the aforesaid court order for implementing the court directions and reporting compliance. The committee is to comply with court order forthwith. In case the order is not complied with then on next date contempt proceedings will be initiated”, said the bench.
Court during the proceeding of the matter in order to save the interests of children directed that owners of coaching centres shall not operate their bank accounts. “In order to secure the interests of children who are studying in the unregistered coaching centres and tuition centres, we order that owners and authorized persons of these centres shall not operate their bank accounts which stand in their names”, directed the bench.
Court further observed: “The court is constrained to pass the aforesaid directions to ensure that noble service of teaching is not reduced to mere commercial activity. The interests of children, who are future of the nation is dearer to all and have to be secured at any cost”.
Court made it clear that these directions would be applicable to those coaching centres which remained unregistered till the issuance of order passed on December 30 and not to those who have applied for renewal of their registration.
Court also constituted a committee of two retired District Judges – Ghulam Mohi-ud-din Dar and Abdul Wahid – to verify the statement of those coaching centres who filed undertakings before Registrar Judicial indicating therein that they shall abide by the regulations and court orders while running their centres.
“In order to verify the statements made in the undertakings filed by 183 coaching centres, following committee of retired Principal District and Sessions Judges is constituted. The committee shall inspect all these coaching centres and find out as to whether the undertakings given to the court are correct and whether they have complied with the Regulation of 2010”, reads the order.
Court directed the registry to provide the copies of undertakings and list of these coaching centres to the member of the committee for facilitation and verification of these centres.
Coaching centres operating in Srinagar and other districts (other than Srinagar) have been directed to deposit an amount of Rs. 10000 and 7000 respectively with the Registrar Judicial of the court within a period of 10 day’s time for the said committee members.
Divisional Commissioner Kashmir has been directed for providing of vehicle to the members of the committee for conducting the inspection of these coaching centres and the committee has been directed to submit the report of inspection within two weeks time before the Registrar Judicial.
Court directed the concerned authorities to consider the application of coaching centres ‘ if any filed’ for registration prior to the issuance of order dated December 30 in accordance with rules within a period of 10 days as also application for those who applied for renewal of registration.
