HC closes PIL on 2010 killings

Srinagar, Dec 11: High Court today closed the PIL seeking report of one man commission (Justice M L Koul) with regard to killings of 2010 be made public.
The petition was filed by an NGO with a prayer that the State Government be directed to make public the report submitted by the Koul Commission regarding the killings of 2010 unrest.
Further direction from the court was sought that State be directed to implement the recommendations of the Koul Commission including the recommendations with regard to grant of compensation to next of kins of  the victim families and also submit the action taken report with respect to findings of the Commission before the Court.
The Division Bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar after examining recommendations of commission and the Action Taken Report said it is satisfied that the respondents-authorities have taken the requisite steps for implementation of the recommendations in tune with the directions passed by the Court.
It was submitted in the petition that during the unrest of 2010 in Kashmir Valley about 120 youth were reported which engaged public resentment in consequence were of the respondent state constituted a commission of enquiry under the J & K Commission of Enquiry Act comprising retired Justice M.L Koul.
“We are conscious of the concern shown by this court in the said petition, PIL, while registering the constitution of the Commission of Enquiry by the Government”, DB recorded while referring its earlier direction passed in the year 2015 on this issue.
It may be mentioned here that the State Government had shown reluctance to make the recommendations of the Commission public because of the sensitivity involved in the issue.
But authorities were under direction to place the report and recommendation of commission before court for its perusal which the authorities did and submitted the same in a sealed cover.
The State Government, in the reply, is on record saying that the requisite steps for implementation of the recommendations with reference to payment of ex-gratia amount have been taken.
Court after taking overall facts & circumstances and the relief prayed for in the PIL, satisfied that the issue involved in the instant PIL is taken care of by the order passed by the court in earlier petition.
Court however, said that if any individual is dissatisfied with the investigation or the quantum of relief released by the Government shall be at liberty to approach the competent forum for seeking the appropriate relief.
