Addressing press conference, Advocate Sharma, while referring to the minutes of meeting of the Ministry of Tribal Affairs held on February 14, has restrained Police authorities and all the Deputy Commissioners from extending any help to different authorities in launching eviction drive against tribals without the approval from Tribal Affairs Department.
“This clearly indicates that the provisions of CrPC, RPC, Land Revenue Act and other penal laws of the criminal justice system will not be invoked against the Gujjar and Bakerwals even if they commit a crime under the express provisions of these penal laws”, he further said.
The Government has also passed directions that till a formal tribal policy is formulated and issued tribal population should not be disturbed or dislocated. “This means that all those tribals who are involved in encroachment of State, forest or any other category of land will be able to do it at their sweet will”, he added.
“Even instructions have been issued to the concerned authorities to allow the tribals to freely transport bovine animals from one place to other on the pretext that animal rearing is their profession”, Advocate Ankur said, adding “this direction is in violation of Section 188 RPC and Animal Cruelty Act and despite the fact that tribals are mainly involved in smuggling of bovine animals”.
“Nobody has any doubt that Roshni Act was brought into force to accelerate the demographic change of Jammu region and latest directions of the Government vis-à-vis tribals is not only illegal and criminal but also driven by communal fascist motivations”, Advocate Sharma said.
“Jammu people can no longer be hoodwinked and they are well aware of the machinations of the Government”, he further said, adding “people of Jammu cannot overlook the various dimensions of the demographic assault on this region of the State”.
He also expressed concern over planned settlement of illegal immigrants (Rohingyas and Bangladeshis) in Jammu, induced migration from Kashmir and encouragement to grab more lands without the threat of any Government action”.
